  1. Thanks Sarah. Have you read of any other cases of people being succesful in getting a second claimed refunded? I haven't been on this site since November when I won my first claim so maybe I need to look at threads to see if anyone has doen this. Moderators can you point me in the right direction please?
  2. I won my case in November 2006 - approx £310. Since then I have calcualted interest and charges at £251. I sent a Mr Dangerfield a letter several months ago but never got any kind of response. It was ony for £30 at that stage. When the claim reached £161 I sent letter number one but then got whalloped with £90 of charges so resent letter number one with new total. After two weeks without a response I sent the next letter threatening court action. I explained int he letter how I thought it was hillarious thatI had waited so long for any kind of reply but when I went overdrawn I receieved a letter the very next day informing me of a £30 charge! I recieved a letter back on Thursday 29th April saying that as I had already won my last case I did in fact agree that all future penalty charges were fair and that was the end of the matter. This is absurd given I never signed any papers or accepted any of the offers they made, I simply took them to court and they paid up - they didn't ask me to agree or sign anything. I was in Florida the two week prior to them paying up and wouldn't you know it they paid on the very last day of my holiday meaning I had bugger all money to spend until the very last day!! Is this yet another scare tactic? I am going to start court action on Thursday 5th April. Has anybody else claimed their charges back twice? Any Problems? Challenges from the banks?   3. Wow!! Still no reply....i'm impressed. I wonder if you would be so slow in withdrawing any donation I make to the site? I doubt it. I thought I would do this to help others but seems I may be fighting a losing battle. Good luck everybody else and stick with it....
  4. OK my case has been settled please can admin mark with *SETTLED IN FULL* I wasn't expecting any congratulations....uhum! Please can somebody tell me how they closed their MCOL and also how they went about claiming back other charges after they had their original case settled (charges incurred since action)
  5. Hi All, Have been in Florida for the past two weeks and only arrived back on Thursday. After waiting what seemed like a world record amount of time (compared to other people) I won my money back.... I was hoping to get it sooner as I didn't have much to spend on hols but I got it on the last day (after they issued me with two further £30 charges) so at least was able to buy some new clothes at the end. Please can somebody advise me how to close the MCOL? Also what should I do about the two further charges (one of which was taken because the original £30 charge made me overdrawn)? Thanks
  6. Been 9 days now and the MCOL still shows as Issued. Go to Florida tomorrow with literally no spending money.... does anybody know where I can find guitar song sheets?, I am thinking about busking for my breakfast.
  7. Is it worth me sending yet another 'i will accept as partial payment' or just ignore it as my MCOL is not 7 days old and should be acknowledged soon?... or will Halifax hold out until they hear back about my decision?
  8. I got a letter yesterday (Friday) saying blah blah blah you did not accept £70 first offer.... to reach an amicable settlement we will increase this offer to £120 etc etc NOOOOOOOOOOOO! I filed MCOL last Saturday - I was hoping the claim would be acknowledged after 7 days but it hasn't and I'm still getting offered pittance. I go on holiday on Tuesday with litterally no spending money. I'm certain Halifax have been keeping up to date with my thread and will ensure they don't respond until I return from Hols! Pay up!
  9. Has this happened to everybody else with an overdraft? I tried to set a new account up with Alliance and Leicester yesterday - still waiting to hear back but will be on hols when next pay check goes in and Halifax will prob pay out while i'm away too. I will come back from hols with a £1 in my account and over £500 of bounced direct debits/ rent etc ...and then 10 £30 charges for them failing! Yikes ...scary! Another miserable xmas too

Ut oh...they stop your overdraft?? so when i get back from Florida on my next pay day all my wages will be inaccessible (paid off my permanent £1200 OD) ? and all these £1000's of utility bills I have postponed to december will go unpaid... Is this common practice...i knew it was a possibility but has anybody else had overdraft withdrawn. How pathetic and childish of them!!
  11. Thanks Mike, What do people do once they get their money back - do they still visit this site and help or do they become mods themselves? Will you become a lifelong advocate agiant the evil banks?! lol I'm sure I will return and share my new found knowledge if my claim goes through

  14. CONGRATULATIONS MIKE! go take a long vacation...... I see you waited 9 days from filing the claim to getting your cash back .... I filed mine on Saturday 30 and go to Florida (with no spending money) so fingers crossed they acknowledge mine before Wednesday.... Did the status go from Start to acknowledged?

  16. URGENT! Need help please.... The MCOL status screen reads: Description Money owed by Halifax Defendant HBOS PLC Claim Issued(30/10/2006) Judgment Start Do I need to do anything else - when I click on start I get two options but not sure whether to do anything unless it closes my case. It has said start since Sunday (I filed on Saturday) Does this automatically change when Halifax acknowledge the case?

Can someone please confirm that i am correct that the daily interest rate is 19p and also on the money were it says Amount Claimed = 864.00 should I change it to 875.02 to account for the interest too? Daily rate is 0.000022 (can't remember how many numbers - you posted it earlier though) x amount you are claiming (£864) Also i notice that it asks for reference details on the money claim site. I have left this blank but it made me think will the bank be able to identify me by using just my account number thats in the particulars of the claim? All you need to send what you have already posted in the last thread - there isn't really any space for anymore - keep it as short as possible as you will have to tweak it as it is. Ok thanks alot hopefully someone can answer these questions so i can continue with filing today. Lol you will be waiting a while - best reading FAQ's again

  19. I am perhaps not the best qualified person to help but can I ask what this letter is about? Is this after your LBA? I think you need to pull your finger out because you are making threats to the bank and not sticking to them - This is exactly how the bank want you to act.... I filed my MCOL on Sat even though the deadline I set was Friday. The bank say they will consider the case closed after a period of 8 weeks so you really should just file the MCOL. Once you get into the mindset of 'i'll do it tomorrow, it usually never gets done' (from personal experience) Have you also read the FAQs? They are there for a reason and if you are serious about getting your money back you should have read them thoroughly.
  20. The MCOL status has changed to 'started'. What usually happens now? and how long does it usually take for Halifax to respond and then pay up? - I go to Florida very soon and need this cash asap! No chance now they have read this thread.... they'll delay it to the maximum time allowed in order to get revenge on me! lol groannnnn

Hi Just two quick questions that URGENTLY need answering today if possible as I file my MCOL and want to clarify this. 1) How do I calculate the daily rate...i have the interest amount from the calculator but how do you get the daily rate at the very end of this paragraph?: 1984 at the rate of 8% a year from 28/02/01 to 31/05/06 of £ 43.20 and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of 0.00p 2) Who is the defendent? Is this my actual branch or is it Halifax HQ? Thanks in anticipation

How can they let my post move down to page 6....??? lol Right folks as I have waited ever so patiently for folks to help me out while they dealt with those at the advanced stages of action - my time is finally here. Tomorrow is my 14 day deadline so MCOL will be issued. Please could one of you be so kind to tell me what I need to do....I have read FAQ and other peoples posts so many times but seems the advise is slighty different for each case. (second paragraph was only a joke btw - not to be taken as seriously as previous posts. Thanks)
  25. On Friday I file my court case.... need this cash before my holiday. I am sure they read all these threads and compare the amounts owed to the people who have sent them LBAs. Now they will drag it out so I don't get money for my holiday....surely they also look through the statements and see that my wages for the past few years have been paid by DTI in Westminster and now the Police... I'm sure they would think again if they did?! Don't mess me with Halifax...pay up!
