  1. I'd give them the full 14 days. Are you accepting payment in full, or a part payment?
  2. Have you tried phoning them up and asking for your statements from the last 6 years? That's what I did, I was told there would be a £5 charge (they never charged me though), 10 days later I recieved approximatley 60 envelopes with my statements.
  3. I successfully claimed against Halifax last November. They Paid in full a couple of weeks after I issued the claim with MCOL. To get to the point, the other day I recieved a letter from the Halifax stating that "We are writing to make you aware that you have gone overdrawn without agreement. As a result you have incurred charges on your account". I checked my statement online, and at no point was my account 'overdrawn'. Today I phoned them up to enquire about this charge. I was told that the request for a direct debit was made before there was sufficient funds in my account (or something to that effect). Even though I had deposited funds in to my account to cover the direct debit. How can they apply a charge for going 'overdrawn' when the statement produced by Halifax clearly shows that I was never overdrawn? Should I start a second claim, is it the same procedure as last time, or is there chance that I'll have my account closed? Thank you, Dan
  4. Update. Claim issues 26th Oct. Halifax Acknowledged it 2nd November. How long will it be before I get a letter from the Halifax saying they'll return all charges?
  5. I think that cap one owe me around £50, but every little helps. Is there a certain procedure for claiming against credit card companies or is it the same procedure used to claim against the banks?
  6. Thank you for that advice Angi. I sent the LBA off last week. I've just recieved their reply:- 'Dear X Thank you for your recent letter. As a gesture of goodwill I offered to refund six months worth of charges to your account, which you do not wish to accept. I confirm that we will not refund all the charges you have incuured on your account over the last six years. If you remain unhappy you can refer your concerns to the financial Ombudsman Services as outlined in our previous letter. I'd like to remind you, If you wish to refer the matter to the Ombudsman then you must do so within 6 months of the date of our previous letter.' I believe my next course of action to be the court claim. On the 'money claim online' website where it states 'amount claimed', should I put the charges owed in there or the charges owed plus 8% interest? One more thing, do I need to send Halifax another letter/list of charges? Thanks in advance, Dan
  7. To date I've sent off the intial letter and summary of charges (£371 in total). On Monday I recieved a phone call offering me £55 to settle my complaint, which I declined. I was then offered a final amount of £160. I also declined this and requested the offer to be made in writing. I recived a letter today. Here's an excerpt from it: " As a gesture of goodwill I offered to refund £160 of charges to your account, which you do not wish to accept. We are not prepared to refund all the charges that you have incurred on your account over the last six years. I must stress that future charges will stand and we reserve the right to close your account if you do not manage it correctly. I know this won't be the response you were hoping for, to comply with legislation, I would like to let you know that if you were to remain unhappy you can refer your concerns to Finanacial Ombudsman Service. They can be contacts on 0845 080 1800 or by post" What would you suggest to be my next course of action? Would I be right in saying I need to send off the 'LBA' ?If so, should I accept the £160 as part payment? Dan
  8. I've just received my statements for the last 4 years from Halifax. I'm preparing the first letter to send off to them, one thing I'm not 100% on though, is where you have to include a 'schedules of charges' what exactly should I include? The statements with the charges highlighted? A typed out list, for example: 6/10/04 Charges as notified £30 20/12/04 charges as notified £28 on so on.. Also, where it mentions that I can claim 8% interest on charges, am I eligible for this? I didn't have an authorised overdraft on my account, therefore I wasn't charged any interested for being overdrawn, just the £28/£30 charge. I'd appreciated it if someone could clarify the above points for me. Dan
