  1. I received a letter today from DrydenFairfax solicitors (acting on behalf of CapQuest) warning of intent to initiate court proceedings if I do not settle a claim with their 'client.' I would be grateful for some advice. CapQuest purchased a debt off Lloyds Tsb from a current account which I defaulted on in December 2008. My understanding is that I can issue a CPR letter, especially as no account information has been provided to date. The debt is a couple of weeks from being statute barred. I was wondering if I can claim the Limitations Act on the debt irrespective of whatever information is provided from the DCA over the next month? No payment has been made to Lloyds or anyone else since the account defaulted.

  3. Hi,I have various charges incurred form about 2010 onwards in respect of late payments and overlimit fees on my Barclaycard credit card. My understanding is that from 2006/7ish the OFT deemed these charges should be reduced to an 'acceptable' £12. My qurestion is whether a claim can still be succesfully issued to reclaim these charges form the bank.
  4. Dear All, As a relative newbie here I would be grateful for some assistence. In 2007 I purchased a house from DWH. Being a first time buyer I was unaware that although my house was freehold, the garage from this property was actually leasehold. The garage is 'separate' from my house being under a coach house on the estate. Under the terms of the leasehold, I have to pay ground rent of £150 quid a year and a £71 service charge to a scurrilous property management company called Solitaire Because I have had an ongoing dispute with Solitaire over their service, I have paid nothing to date. I realise this is a mistake and I should have paid the ground rent. In December 2010, Solitaire contacted my mortgage company (Santander) to note that they were owed payment from me. They got nothing. They had requested payment of 822. Last week out of the blue I have been hit with a court proceedings letter for Northampton with Solitaire now suddenly asking for £1600 and I need help with what my next steps should be. So far I have determined that I must pay all the backdated ground rent. The service charges is a completely different matter and I have never received full accounts of what these charges consist of - i.e. what work has been done. In my eyes I would like to admit that I owe money but not in a month of sunday's do I owe £1600. By my reckoning the £800 mark is nearer to the truth. Please can someone help.   7. I really need some advice on Solitaire. I bought a house in 2007 from David Wilson Homes. The house is a freehold, but the garage which sits beneath a coach house is leasehold. My assumption is this puts me into some sort of 'contract' with Solitaire, who have been contacting me for money regarding upkeep of the estate. I never signed anything to say I wanted a property manager, and indeed, this was never highlighted by my solicitor or the salesperson for DWH. I need some help establishing: 1. From the limited info above, is it likely I am in a binding contract with Solitaire? 2. If so, how can I get out of it? Can I buy leasehold on garage for example 3. How could I best proceed with complaint against Solicitor and salesperson Many Thanks, Andy PS Bit worried on all this so help is massively appreciated

  9. Hi, Gone through my statements which i extracted from the internet banking facility and have highlighted thew amounts I intend to claim.... Just one question. How have people who have launched their claim so far 'addressed their claim?' I was looking on the stickies/FAQ's and can't seem to find anything. Have people just sent an accompanying letter stating that 'I intend to claim back x amount which you have charged me in illegal fees etc' or something else?

  11. OK, I have pulled off the information (ie my statements) off the interenet, have the contact centre address and I am nearly ready to proceed my claim. The one thing I need to know is what i am entitled to claim before I send off- I know i can claim back the £30 overdraft excess fee, but can I claim the unpaid cheque fee (the one where it clears only after your balance returns below the agreed od)? Any help gratefully received before I proceed. Also is it a good idea to photocopy the statements I have pulled from the 'net and to send recorded delivery? Thanks, Andy
  12. Princess, You need to click into your statement from the options on the side bar. Then, you need to click on the 'Please select an option box' and select 'Download a statement' and voila, you can select any period you like from July 2002.
  13. Thanks mate, For anyone else with internet banking Lloyds offer statements that far back (although its a bit of a pain- its in 3 month batches IIRC), so I guess it will be a busy afternoon pulling off the data for me.
  14. Hello, I am new here so a happy hello to you all.... I have accumulated a fair few overdraft charges dating back to 2002. These charges have been typically for exceeding my od limit by about £20-£40. I would be grateful if anyone could tell me whether I can claim these costs back this far? So far I have sent a letter to my branch, 'objecting' to the latest charge (which was a pedantic one to say the least) but now feel compelled to go the whole hog and claim back all my charges. Am I right in assuming the customer care centre is the point of contact? Thank you, Andy
