  2. how this started is my partner was having a clear out of old paper work and came across old loan agreements from 2003, she was going to shred these documents and i had a look through them first, and it came to our attention that we were mis sold ppi. that we didnt ask for or request, as i was at that time working as a self employed,and we couldnt recollect any of the information that was on the loan agreements one with nat west and one with royal bank of scotland, all we did was write a letter of compaint to them both and our letters we acknowledged as being recieved and would be looked in to, we recieved a telephne call from nat west asking us about our complaint and would recieve a response in the next few days, fast result, £3.500.as settlement ughhh. however the royal bank of scotland wrote and told us that claims for ppi were currently on hold, and we could refer our complaint to the f o s if we wished.. the figures for the nat west loan were.. amount of loan £6.500 interest £2.391.16. ppi £4.350.42 interest for ppi £1.380.74. total amount £8891.16 loan ppi and interest £5.730 total amount.£14620. this settlement figure was as they wrote a gesture of good faith and didnt admit liability or deny any liability. as we were in need of some money to settle other matters we accepted. as its some thing we didnt have and could have made use of, due t the way things are these days. and me currently not working due to incapacity. seems there wasnt any argumets in sorting this out for us. although we were bemused as to how it was dealt with.... i.am not sure how my other claim would be with royal bank of scotland but these figures are.. amount of loan.£6.800. amount of interest.£2.691.16.. ppi £4.754.74 interest for ppi £1880.72 total cost of loan an ppi and interest £16126.32..84 payments of £191.98. we recall this loan being paid of early. but cant remember when. we are confused with the whole thing to be honest ,but the money came just right. thanks again andy.
  3. i have recently sent in payment protection insurance claims to the royal bank of scotland and to the nat west, these were sent at the same time for mis selling of these policies to me, i have recived a response from the nat west and they cleared my complaint with them in under 4 weeks and made an offer of settlement for just over 3k, ,which i have accepted, however the royal bank of scotland have responded to me saying that current claims for mis sold payment protection insurance are currently on hold due to this enquiry that is underway. i have sent in a complaint form to the f o s about the royal bank of scotland and cant understand that the nat west have settled my complaint and they are part of the royal bank of scotland group. as i was aware that no waivers had been given to the banks by the f s a and were to handle complaints of payment protection insurance as per their guidelines. would i be able to point this out to the f o s that the nat west have settled my complaint with them, where as the royal bank of scotland have said that claims are on hold. or would they say that my current complaint with the royal bank of scotland is a seperate issue.. thanks in advance. andy

  6. :lol:thanks to every one for thier help regarding the above post,,i sent a final letter before action toshop direct and was suprised by the amount of telephone calls i recieved from them,3 calls in 2 days ,the last call was to say that they had looked in to our complaint and admited what we were complaining to them about was true and will send us the missing games in due course..result..thanks again to every one for their help..
  7. great universal have finally sent us a letter regaarding our complaint,and have passed this to thier customer excellence department,shop direct for them to deal with we reccieved a letter from them saying that they will look in to our complaint and will contact us again shortly,,this was on the 7th feb,and still we have heard nothing,,seems they like to drag thier heels doesnt it,we contacted consumer direct about this and all they said was to take it to the small claims court, howwever this could be a costly thing to do,and would they even bother to respond to this or even attend the court,,so back to square one,,suprised at consumer direct not getting involved as i thought that they would do,re breach of the sale of goods act,,iam not letting it go and just forget about it ,after all if i didnt pay them for the goods they would soon be sending me letters and threat o grams.should i go back to consumer direct and see if they cant put on pressure on them or do i go down the small claims route .thanks for your support in the past8-)
  8. i have found the name of the customer manager for great universal, emma thorpe,and have sent her a recorded delivery letter and a copy of the original one i sent previously,i have asked for the address for service in the letter,,if this fails to get thier attention and or no response then its off to the county court,seems the only way, now they have been given yet another chance to look in to my complaint,ill keep you posted, as i will need advice on how to approach when i come to dealing with applying through the courts,once again thanks to all of you for your advice.
  9. appologies for the delay in getting back to you about the above,with great universal,,i posted the original complaint by recorded delivery ,how ever royal mail failed to deliver my letter of complaint,confirmed by them over the telephone,so i had to re send the letter,,how ever the time limit of 14 days in which they were given to reply to my compliant expired ,3 days ago and to date they havent even had the decency to respond,,i have been trying to find the customer services manager of great universal to re direct my complaint to them and ask why they didnt have the decency to respond.. or there is the option of county court action..however i will fire off another letter again tomorrow this time ,i will give them a further 7 days to respond.then go down the court action route..well done 1lawyer getting your playstation sorted out,i will certainly remeber that for future reference.kind regards.
  10. hya andy just a quick update,contacted trading standards,and they have put us in touch with consumer direct,who have told us to write to them giving them 14 days to rectify the matter and quote sales of goods act 1979.we are to call back when we have recived a reply from great universal,the man we spoke to brought up the page and agreed they were breaching the sales of goods act.so ill be sending a letter to them tonight,would it be best to send it by recorded delivey?as proof of postage.thanks again andy ill keep you updated as to how we get on.
  11. hya andy your right in what you say,the e/mail to customer complaints that we sent,has been replied to again they say its an error ,but doest even offer a compromise even as a gesture of good faith. they have assured us that they have amended the website. the reference is now pz54216,i have just looked to see if they have amended the page and low and behold its still the same,lol,would you credit it,so a reply will be sent ,i,m not letting this go, as i bet there are some that will say oh well,forget it,,my partner was getting round to that thought and said to me,, you wont get any where ,they will walk all over you any way,, so thats got me more determined now,, and i have tried 4 e/mails of complaint, so i have given them the chance to deal with this, if i didnt pay for the item they would be all over us like a rash.so trading standards and watchdog will be the next approach now,i have printed both page references,and kept copies of e/mails sent and replied to..my partner seems to think i wasnt assertive enough in my e/mails that were sent, and said you need some one that knows how to word complaints so that they take notice..i think she was right as i sent the complaints as more of a general enquiry looking at it.as i,m not to great in the wording of complaints,,any suggestions would be appreciated..many thanks again andy.
  12. many thanks andy. i have sent an e/mail on thier complaints section. and will await a reply,as i have sent previous messages telling them about my complaint and them just telling us it was an error should i be a bit more assertive and mention that my next course of action will be trading standards,up to and including, watchdog,this might make them give us a more posative response,, all we want is what was in the description of the package as advertised.why put this in the description and not adhere to what they state..
  13. we dont mind having the goods,, which we have brought on bnpl,but we will pay that off before the due date,but its the princiaple of them not sending us all the itmes that were described,my partner recived an e/mail from great universal today ,and they said that, its an error and they made a mistaske, as this some times occurs in descriptions and pricing,,as a consumer thats not down to our fault, its thier own, and what you purchase should be as described,,if you take a look at greatuniversal.com and type in the search box,, the item reference pz5420,, youll see what i mean,, my question is now what should be my next approach ,would i be better off contacting trading standards,or again send another complaint e/mail to great universal.and going through thier complaints procedure. many thanks
  14. my partner chose a playstation 3 package deal from great universal on line,the description of the package deal was,160gb playstation3 inc call of duty black ops, medal of honour,a dual shock controller, blue tooth headset,and a hdmi lead. these itmes were pictured...however reading through the description and features of the console,,it stated,,,get your games off to a superb start with,,,modern warefare 2,,call of duty black ops,and medal of honour,,it then carried on about the functions of the playstation blue ray,dvd etc,,,in the key features of the playstation it said comes with fifa 10 and kill zone2.. so my partner assumed as it was written in the descritipn of the product advertised that including what was pictured and the other items,,, modern warfare2 and fifa 10 and killzone 2 would be included,, in the package,, so she ordered the console and expecting all the items listed would be included in the delivery when it arrived,,however modern warfare2 fifa 10 and kill zone 2 werent in the delivery,, she contacted great universal and was told that the package was only for what was pictured as decribed above,,, she pointed wht the decscrition read but was told that those other items are not part of the deal,, ,she has made a complaint to great universal and has more or less been told that only the pictured itmes are in the package and that the others in the descrition are an error,,.she pointed out the trade descrpitions act to them but has been told to make a complaint in writting..are we perfectly right to argue that what is written in the descrition, we were entitled to recive or can they say that it was an error ,and say as they are saying that we have had all the itmes and wont be sending us the rest..
  15. we use great universal and have had items on bnpl, however even if we dont have any weekly /monthly payments to pay we send payments of say £10/£20 a month,, to have as credit ,this then is deducted from what we owe,which makes it an ideal situation for us maybe thinking about that idea,might be of use for future reference.
  16. some great remarks on this subject,lol,,made for fun reading, makes a change hey,, but think its now time that the england team was reformed,,the likes of gerard, lampard terry and heskey all got the boot, i still favour capello to run the england team,its every time we lose its always the manager, well this time its the team and its got to go,, and new faces brought in to the squad,, i couldnt see the likes of brasil playing any worse if capello was to run thier team,, they would perform just as well, so the talk about rednapp taking over will make no difference at all they would still be crap.
  17. postggj,,, have you sent for your files from the csa under the data protection act?i was sent to the magistrates recently regarding arrears,,most of which i have now paid,,however they tried to take me back for a second liability order,, and i had my case files which i had requested and found faults in thier assesment,,i pointed these out to the court and they declined the csa liability order until they had sorted it out,,4 visists later to the magistrates the csa hadn done wht the court told them to do ,so they had to withdraw the application,wht iam saying is its not a open and shut case for the csa,,if you can point out to the magistrates they have errors in thier claim. stand up to them have you written to the csa about your case and they havent contacted you in reply?do they ignore your calls,,have you sent letters to them by recorded dilivery and not had a response?these things show the courts that you have been trying to sor your case out with the csa.

  19. me and my partner took out an unsecured bank loan,of around £24k,ppi was included in the loan,we maintained the repayments,until last year when i became ill and was unable to work due to having angina,we informed the bank that we were going to be unable to maintain the payments,due to this,iam currently claiming incapacity benefits,my partner works part time,we tried to claim on the payment protection insurance but were told that it was the first named person on the loan that was only eliagable to claim,we were not told this,when we applied for the loan,or we would have made alternative arrangemets,in the event that one of us would be made redundant/become ill etc,we defualted on the repayments and were sent the defalt notice,and were then cotacted by the banks dca,we then sent in a budget sheet and an offer of reduced monthly payments, which they accepted until such time our situation changed,we cancelled the ppi and the money reclaimed was paid off the loan,we asked for a copy of the credit agreement wich was sent and seems all in order,we are currently paying approx £60 per month where the amount should be around £400,we have since been contacted by the bank asking us for another budget sheet with a view of us making higher payments,we have paid the £60 with out fail and on time,it seems we are now getting more letters asking us to make higer payments, our circumstances are the same and we are unable to pay any more than we are currently doing,if the bank were to take us to court would they make us pay any more than we could afford to pay,it is now approx £17k that is left to pay on the loan thanks in advance.andy
  20. i had a bailiff contact me about just over a year ago,regarding an unpaid debt (not council) and it can be a stressful time when you think your going to be hounded by these parasites,,but i knew one way or the other it had to be paid and i wasnt trying to escape from paying what i owed, but couldnt afford to pay what they wanted me to originally pay due to finacial circumstances,how ever i did contact the bailiff company which takes some courage for some people to actualy do,due to being scared witless ,and i made a payment arrangement with them and this was accepted and 2 monts ago the last payment was paid and i wasnt bothered by them as long as i kept the arrangement in place or defuat on paying the weekly instalments,i have since finished paying wht i owe and its a relief its done,how ever i dont think that its all down the these rip off merchants,that try to make your life a complete and utter misery its the system its self those in power the courts and the goverment,for allowing these **** to rip you off with ficticous fees,,wonder if the bailiffs were sent to the mp,s that stole tax payers money, and did the same thing to them,made them pay what they stole by way of instalments and ficticous fees
  21. it would be advisable to pay what you can afford direct to the csa,its better to pay some thing rather than nothing,it shows your not refusing to pay. marstons may send your case file back to the csa, then the csa could take you back to court.if this happnes you can show the court that you have at least made an effort to pay,as it can lead to you being sent to prison,for non payment,(as a last resort) and you will still have the amount to pay when you came out,going to prison doesnt wipe off your arrears.youll have to still pay them.
  22. hi gonabreaksoon maggie is right what she says about a liabilty order not being a criminal offence,and that the order will be returned to the court if they are unable to gain entry in to your home or secure payment i would also request all your details under the data protection act as i did and had all my case files sent to me and found errors in thier assesment which i was able to use against them in court and the judge found in my favour,however each case is different,but i woud make payments to the csa on what you can afford to pay maybe £10 a week to show willing your not refusing to pay, but cant pay what they want you to pay,the csa usualy want arrears clearing with in 2 years,so your looking to be paying at least £60 a week to clear them off,if they send the case back to the courts and you pay nothing it shows your unwillingness to pay,but paying what you can afford will help you,the bailiff cant break in to your house or use locksmiths to gain entry,remeber to keep your doors and windows secured,if they come back,are you on benefits of any kind?what are your circumstanses,if any thing has changed did you inform the csa of any changes to update your files?as they wont change the original assesment if you dont inform them of any thing that has changed.
  23. sorry for interupting your thread guys.buit i wondered if the 42 k owed was in the form of a liability order through the courts? could this be statute barred being over 6 yrs if the csa have not contacted him for payment?his assesment should be altered if his circumstances have changed, claiming benefits and being out of work should put him on a nil assesment for the last 3 years if he has informed the csa about any changes in his circumstances if he didnt then they will keep his assesment the same and say he didnt inform them of any changes?the csa use debt collectors to recover the amounts owed and say that these have to be cleared up in 2 years,he should request his infomation under the data protecion act,to check if there are any errors in his file he can complain the csa about,the csa are dont care about your expenditure and house hold income as long as they are collecting the arrears owed
  24. hi sorry for interuting your thread on the csa,but felt i ad to jump in to say something,i ad a liability order made at the magistrates in 2004 for the the amount of £10,000 ,not that i refused to pay,i couldnt afford to pay the amount they wanted,however they used a bailiff firm to collect the arrears,trying to negotiate with the csa was imposible they didnt cae less how your circumstances were oce the liability order was in pace,i ad to pay back the arears at £60 per week which i did however i had an illness in 2006 and had to refrain from work,i asked the csa to reduce the paymens as i was on icapacity benefits but thy refused so i ad to give them all my benefits to clear the arears,hwver i reduced them myself nd wrote telling them that this wasnt a refusal to pay but due to circumstances i had no choice and pad them £10 a week,with out fail,however they send wrote recently saying the £10 weeky payments were no loger acceptable and were sending the matter back to the bailiffs,iam now on incapacity benefits long term and recieving £89.00 per week and having to pay them £60 a week from that,they wont budge and are taking all my benefits off me ,they say that you have 2yrs in which to clear your arrears,and they add inerest on the amount you owe,i have sent letters of complaint to the complaints resolution team and have heard nothing,also my reciepts of payments that i have from 2004,i have paid a total of £7,000 from the original £10,000,but the csa are saying that i owe a further £5,000 and thats it full stop,i have asked for a breakdown of where they got thier figures from but they have sent me nothing,and this was a reqest under the data protection act solicitors dont want to know they wont take your case on it seems no one as any influence over them,even going to see my mp didnt do nothing,my partner works part time and on low wages,and have 2 children,i have tried avery thing i can its a case of pay up and shut up,with the response i get from the csa.and i thought you had human rights issues when you were on benefits.sorry guys i had interupt your thread.
