  1. Not sure where i'm supposed to post my questions is under my thread each time? (i.e. here?). Have seen that 44 people have viewed my post but nobody seems to reply- is there a reason?

  3. When you say it has happened before, what do you mean? that you have to go all the way to court? or that someone has lost?
  4. Hi, haven't been in touch for a while as had a million things going on! Not sure where i left off - had a part settlement offer letter from Cobbetts on 15th December offering me a "goodwill payment" of £1,800 - i am claiming over £4,000. I wrote to them on 19th Dec saying i was respectfully declining and that i would be willing to withdraw my claim upon receipt of full settlement - i have not heard from them since! I received a Notice of Allocation to the Small Claims Track (preliminary hearing) from Dartford County Court dated 12th January giving me a preliminary hearing date for 5 April 2007. It states that the judge requires a preliminary hearing because:- special directions are needed in this claim to prepare for the final hearing which the judge would prefer to explain to you in person. Has anyone else come across this? Does it mean that i am going to have to wait until April? Am i expected to have to go to court or will Cobbetts pay up at the last minute? I can't believe it, i thought i was going to get a nice little gift for Xmas. Have i been too greedy asking for the full amount £4,139.86 (instead of their offer of £1,800)? Can anyone help me on this one, I feel like i could have lost this now! Jo p.s. only had 1 reply to date and really would appreciate if anyone could take the time to help me out on this
  5. ok guys, sent of my AQ and £100. Today got a letter from cobbetts offering a 'goodwill payment' of £1,800 - my claim was for £3,195 plus interest £3,911.49 plus court charges £150 + £100 = £4,160 - so obviously dont wish to accept. I've seen the letters for saying will accept part payment but want full settlement etc. If i go down this route are they likely to go to Court or is that a chance i take? Can anyone tell me if they have done the same and what was the outcome - many thanks - (getting nervously excited at the thought of money before Xmas - but also never believe anything until the money is in the bank!!)
  6. On reading through different cases/claims - is there a reason why some people seem to be offered money straight away with NatWest while the rest of us have to go through the lengthy process- it doesn't seem to make sense - do you think it depends on the branch?
  7. Thanks for all your help - can anyone tell me though if anyone claiming against NatWest has actually had to go to court? Also the date Cobbetts gave me to give them their requested info was 15 Dec. I have done this - do you know what they will do now? The reason i ask is that if they do not normally go to court, should i still send of the Allocation Questionnaire to the Court? Sorry to be a pain:o
  8. I have got as far as submitting my claim online. I have received a Defence from Cobbetts to which i am replying today. I have until 15 Dec to do so. I have also received a Notice of Transfer of Proceedings to my local court, and also an Allocation Questionnaire which i have been informed i have to complete by 20 Dec and send to Dartford County Court together with £100 fee. Do you think that i will actually have to go to court? Also not sure on what to answer to A Settlement - do i wish for action to be postponed for one month (I believe probably not?) Would i be asking for Experts (again i think not?) and Other Information - is there anything else apart from my actual claim documents which i will resubmit that i need to put? Sorry for so many questions, but i am hoping that i am nearly there - and we are talking about nearly £4,000! All help gratefully received

Have been following all your steps and advice on claiming - sent 1st letter, pAid £5, got statements, sent second letter stating charges, sent LBA, said they acknowledged my complaint and that they would be informing their solicitors that i may be taking it further - i believe that Natwest owe me £3,195 plus interest. have now (27/10/06) filed moneyclaim on line - can you tell me what happens next? i do try to read everything but get a little lost along the way!
  10. I sent the letter requesting repayment of charges and under what i require i put that i wanted details of all my statements, which is what they sent me. I have today completed a schedule of claim for charges. I estimate this to be £3,195.80 plus the charges with interest at 8%APR of £664.77 totalling £3,860.57. Obviously i do not want to mess this up!

Hi you were very helpful before and wonder if you can advise me of my next step - I sent my first letter to Natwest, they replied asking for £5 to send my statements, which i now have and i have calculated the costs to be over £3000! I am not sure which letter to send next - do i send the second letter (LBA) only it says that I am disappointed that you have not replied to my previous letter..., when in fact they did to send me my statements - sorry to sound like an idiot! Also, my schedule of charges how do i need to present this (even more of an idiot i know!!) I would be very grateful if someone could guide me along the way!
  12. I don't really know how to use this site, but after following instructions issued my first letter to NatWest. I don't exactly know what my total 'charges' are, but do know that in the last year they have been over £2,000. I have today received a letter from them headed Data Protection Act 1998 - basically saying that they can send me a complete list of my charges and transactions at a cost of £5, and to send a cheque. Do i ignore this letter because it does not directly answer my letter to them? I am not sure what to do? They also sent me another letter from a different dept saying that they would be increasing my overdraft limit to £800 instead of £300 - i hadn't asked for that! Any advice for a newcomer would be greatly welcomed!
