  1. Took the Halifax to court and they finally settled in full this week. It feels like justice. Thank you to all who have helped me on this website. Have made my donation as promised and good luck to all who are still pursuing, don't give up!
  2. I've just had my Anglian Water Invoice in for 2007/2008 and the standing charge is greater than the actual service provided - £112.52 and £141.89 respectively. When refering to what the standing charge covers the description given is for customer related costs such as enquiries and meter costs. Firstly is this a disproportionate charge and, if not, can I claim a rebate as I don't have a meter? I understand the charge does cover surface water but still feel the standing charge is a "cloak" for what amounts to another means of obtaining yet more money! Thanks...
  3. Thanks for your reply. Just to be sure our last charge was on the 25/09/06 and we therefore went back 6 years from there. So does that count as day 1 for interest calculation backward or is it simply all interest up to today's date? I refer to S69 8% and not O/D interest. Thanks.
  4. Hi, when completing the money claim form against the Halifax, do I need to put the defendent's address as Customer relations, Leeds or Registered address in Halifax, W.Yorks. All previous correspondence has been sent to Leeds. Thanks
  5. Hi. i also used to work for this bank and just before I left we was told we could have our salary paid into another bank elsewhere, so if you did decide to pursue your claim (which I would), and they closed your account it would do you a favour. From my experience one department doesn't talk to the other anyway and unless someone actually recognised the staff indicator on your account, they wouldn't realise the complaint was from a staff member!
  6. Thank you Michael - will send a letter today as you suggest. Will keep you advised.
  7. Hi, the last correspondence we received from the Halifax was back in October offering us a gesture of goodwill payment, we don't intend to accept this and want to go to court. We haven't replied to this letter. However, due to bereavement etc we didn't file the forms and now wonder if we can still go ahead or is there a deadline that's now past. Thanks for looking.
  8. Sorry Michael just opened the attachment and now understand the LBA!!
  9. Thanks for your reply. As the prelim offer was sent just over 14 days ago I assume I can send the rejection of settlement letter by recorded delivery on Monday. I'm amazed I got an offer at all!
  10. Hi, had a letter from Halifax offering 1/3 of all charges as full and final settlement. Do I now send the rejection letter stating that I accept the amount they have offered as partial settlement and will be taking them to court for the remainder? How long do I give them to respond? The last letter sent was the prelim letter giving 14 days which has now passed. Is the prelim letter the 'LBA'.
  11. Thanks you have been a great help, will let you know how I get on.
  12. Hi, just about to complete the schedule of charges and notice my statements only quote 'Charges as Notified'. I am not sure if these are for unauthorised ovd or unpaid Direct Debits as the charge is the same for both. Do I have to specify although the Halifax hasn't to me in my statement, or can I just put 'Charges as Notified' and leave it at that. I can't find the answer in the FAQ's. Thanks
  13. Thanks for your reply, it was very helpful and easy to understand. Will send prelim form tomorrow.
  14. Hi, I am new here and trying to piece together everything that I need to know before putting in a claim. I used to work for this horrible bank and therefore never had a charge for years and years as we wasn't allowed to have financial problems. My problems started when I packed up to have the children. My charges total £360 and I am having trouble with the bit about claiming interest as the only interest I pay is on my authorised overdraft and I am always ovd. I have already had duplicate statements sent in response to the Data Protection Letter. Do I now just put in a prem letter for the £360. Thanks for your time.
