  1. As far as I know BOS like HBOS has an English office so you could claim through english courts. Then you can claim the 6 years and saves you puttung multiple claims in with the scottish limit being £750. If you have an address in England you can use then you can claim via moneyclaim online, otherwise you need to fill in an N1 form. For 5 years in scotland, I think it dates back to 5 years from date you requested statements so break them down into chunks and start the first claim, by the time you get to the most recent one you may even have more charges to claim back...

    I had 2 egg cards which I got into arrears with on and off last year. I explained that I was on maternity leave and was waiting money coming in. I paid them off at the start of the year but they reveiwed my accts and due to my work status, closed them down after. One is actually still open cos it is 2.36 or similar in credit although I dont think I am allowed to use it! I also have a loan with them which had the same problems but all sorted and no arrears. I am going to request statements on all 3 once I find the closed credit card acct number - bit difficult as dont seem to have any statements and my online info doesnt mention the acct anymore.

    If you think I may be suitable then I will try to press ahead with this earlier - I have others I have sent SAR's for but as I dont think Egg owe me too much and I still need the acct number I havent sent off one to them yet. I will do it though if you think it may help other cases. Just not sure if my scenario would make me suitable? Also worried, can they then go and close my loan down? I agreed with them at the start of the year to increase the term of the loan due to a change in circumstances, could they then go and put back to original length or call it in if I try to claim?

Just a thought, but if your partner believes he has a pretty good credit history but is struggling to get a bank acct, and if you stay at the same address, maybe its because they are linking your financial status with his (Sorry to say!?). Just a thought. I know you can put an entry in a credit file to say you guys are not financially linked etc. If I was him I would send for his credit report(S) and leave off getting a joint acct or making any joint applications on anything until you get your credit history cleaned up - this site has got lots of good info for getting defaults removed etc to assist with this.

  4. Well have typed up and printed out my SAR's and am just writing out the envelopes. Will go in by the post office tomorrow, get the postal orders and get them sent recorded delivery. Just the one CITI card acct but I know I have had charges on it so should be claiming something back.

     

    Am also sending SAR's to BOS, Halifax and Capital one tomorrow and have lots more to send out next time I get the chance, will have to check my finances though for all these £10 charges cos along with the postage they all add up!

     

    Oh yeah, is it a good idea to get your credit report just now or wait till I get my money in from all the companies and then check the report?

Hiya, think I have managed to put all my details in the templates for my SARS - was hoping to do more but my oldest is just in bed and the youngest has the sniffles so is waking up more often than usual for a few sucks at the bottle before crashing out again. Not sure about the addresses as there are so many to choose from for each organisation so hopefully they are correct! Just got to address the envelopes tonight, ready to take to the post office for my £10 postal orders and recorded delivery tomorrow.

     

    Am sending for 1 closed BOS acct, 1 open BOS joint acct, 1 closed BOS mortgage acct, my Halifax acct, 2 x Capital One credit cards and 1 x CITI Credit card as well as my mums halifax bank acct. Still got Littlewoods catalogue, flexible and credit card, 2 closed Citi Loans, 1 closed Black horse Loan, Closed Macadam Finance\welcome Finance loans, Closed Egg Credit cards x 2, 1 current egg loan, 1 BOS Preference acct (Passed to Blair, Oliver and Scott), my mums old Capital One CC, Citi CC, and Old Mortgage. Think my sisters are away to dig out old acct numbersloan agreement numbers for me too and hubby may ask me too (Most likely getting divorced) so should be an expert on all this stuff by time I am finished.

     

    Anyway, not sure I fancy going to court much so am crossing my fingers I wont have to as I cant speak in front of people and that the kids give me enough time to keep on top of everything. Was going to send these off last week but they have already delayed things by a few days as has taken me ages to read up on everything and still so much to read and so many different opinions. And have fallen even further behind on the housework!

     

    Finally quick questions, should I send proof of id in with the S.A.R - (Subject Access Request)'s(Will need to find a photocopier and not sure if this village has one as printer ink isnt cheap!)? Think I read somewhere that Capital one ask for it but sure I read something else whch says secure messages count as proof? If they do get back to me asking for proof, is it included in the inital 40 days or does it all start again from the day they received the proof of id? For some organisations I have more than one letter, can I send all letters to the same organsiation all in one envelope or should I post them individually?

     

    think thats all for now but am hoping to be able to get an address in England to do the claims online if they are more than £750 as I dont want to drag this out any longer than need be as I have lots of them to do and not much free time at moment as youngest still wakes through night and oldest likes to stay up REALLY late and difficult to try to get them into routines when they are this close together and I only have one pair of hands! I have always said you should get a second pair with the birth of a baby!

Not sure about the addresses as there are so many to choose from for each organisation but have addressed the Halifax ones to Sarah Briggs in Trinity Road. Hopefully this is correct! Once Amber is asleep I will find some envelopes and get them addressed, ready to take to the post office for my £10 postal orders and recorded delivery tomorrow. I used to get this stuff on my internet access for Halifax. t Think it was something to do with there being lots of transactions on the statement period so they archive and renew (As in more than average for the period you can usually go back in your statements online)? Not sure if I've phrased that correctly, got a hyper 20 month old beside me who wont got to sleep and cant risk putting her down incase she cries and wakes up her 10 month old sister!

  10. Do they not have to prove delivery of the items for you to be liable? As she wont have signed for them then surely that will add top the case? I know a friend who ordered a a laptop but never received - they tried to say he should have paid for secure delivery but he argued it was up to them to ensure safe delivery of the goods, and not his to prove he never received them or to pay extra for the privilege. Think he quoted some Standards and Trading stuff?? I think the end result was they refunded him most, if not all of the money. So anyway surely they have to prove she received the goods?

    My mum gets pretty confused with all this paperwork stuff and when she got this she had lots of other debts she was being chased for but as far as she recalls she believes she spoke to them and they said there was nothing they could do as she had never logged a deferment. If I get all the info together and draft an email would your friend be able to give me an email address to send a query to? Its got to be worth a final try?!

     

    As for council tax my mum had my two sisters staying there and she knew her boyfriends credit history was poor so not sure if she added him or not. One sister was under 18 but other would have been 18-19 then.

     

    Scott and Co got the wages thing done by the court and my mum said she filled in something about income and expenditure so would have guessed that the courts would have decided that was a fair amount. She is really bad with any sort of paperwork, wasnt so bad before I met my husband and had kids cos I lived closer to her, saw her more and she showed me letters she was concerned about and I helped where I could, not so easy now as have my hands full, dont drive and live 35 miles away. I think she must have been embarrased about some of her debts so missed them out as I cant understand how they come up with thus figure. Think I will write to them on her behalf and get sums owed etc from them and ask whether it would be them or the council she would contact for a review on her payments to see if I can get the figures revised.

     

    Would try CAB but their hours are bad, her shifts at work are still hectic just now due to it being a Golf Club and the weather being good, and its diffucult to get a person on the end of the phone, usually just get busy msg saying to try later. Last time I called it took me 2 weeks to get through of phoning on and off every day they were open, and then the kids were such a pain I didnt ask as much as I wanted to!

     

    Thanks again for all advice. Am sending off a pile of DPA's on Monday, just one for my mum at moment as have still to get all her acct details for her closed credit cards, Littlewoods flexible, old mortgage etc! That will be fun and am sure I will be asking advice as although I have been reading through everything, I find that as I have a lot on my mind just now and kids keep me very busy, my memory and concentration span is nowhere near what it used to be and I also lack confidence so will be asking for reassurance! So apologies to everyone in advance.....

  12. I've seen a few people state that credit card companies have closed their accts - is this still happening? Its just I stay in a little village and dont drive and with two kids under 2 I do a lot of shopping online from Tesco's (Asda too far away) but need a credit card to pay as they dont accept Electron cards so dont want to loose them as not sure when I will be able to manage lessons and babysitters to coincide! My cards are Citi and Capital One, and my Electron is Halifax. Cheers for info, advice. Nikki

  13. My sister told me her boyfriends cousin got all his bank charges refunded and now no longer receives charges on his acct. He is with BOS and I am unsure if he went this route or just went in and spoke to his bank. Just wondered if people are still receiving charges on their accts after successfully winning or if the banks\credit card companies learn their lessons?

Thanks for all the advice and sorry if I misunderstood your comments gbzstro - havent had a good run of things myself what with my wonderful husband and his latest girlfriend Ivy from Singapore who incidently is a nice girl but thats a different story. Need to take my mind of that stuff so hence why I am trying to help my mum and on the net all times of day and night! Anyway, she cant put a deferment in on her student loan as they say all the loan is due because she never ever put a deferment in. I never even knew she took one out till she got chased up for the money and she has a bad habit of burying her head in the sand yet my sister and I always bail her out but now neither of us are working and have babies so its a different story.

     

    I think she will have to sell her house. My youngest sister who stays with her 90% of time and has a daughter who is 13 months old will probably finally get housed by the council out of it - she has been waiting on the lists for 19 months so far but doesnt want a skyscraper or anything with a lot of stairs, and that will mean my youngest sister and her partner can live together, which means something good will come out of all this. About time my sister found out just how expensive it is to stand up on your own two feet and try to keep a house with a baby too.

     

    The council tax think will just get worse and worse, at £40 a month it will take 3 years to pay each year off so if they add £40 a month on each year then eventually she will have to pay £120 for council tax arrears along with the £178 in the wages arrestment, and will have to keep negotiating payments with them till the Scott and Co arrestment is cleared. She wants to change job to one that is less physical but cant face the mortification of the wages arrestment at a new employment, she found this one bad enough.

     

    She will not have to declare herself bankrupt though as due to the discount she got cos her house was a council one, she will have about £45000 from the house sale which will clear her feet but will not enable her to get anywhere else, or get a mortgage. When i was working I did offer to buy a share of her house off her to clear her feet and give her money to live on and a life again but my husband put his foot down as it meant that even once I paid off the loan or mortgage the capital would be tied up till she died. I see his point of view but his parents are financially successful and together whereas my mum has basically been a single parent since her and my stepdad split up about 15 years ago. She is not a bad person, she helps me in every way except financially but has been there for me whenever I needed her, its just she is no use with paperwork, small print, finances and confrontation.

     

    Her mobile is a pay as you go and I put about £10 in it bimonthly as we all tend to text each other - easier when you have little ones as reduces risk of the phone waking them when they are just dropping off and means you can reply at a time that suits you. She doesnt put anything it it as she cant afford to.

  15. The story is she is paying just over £170 direct off her wages to Scott and Co for Poll Tax\Council Tax. She remortgaged her house last year and used the extra funds to pay other debts and paid last years council tax. She pays £30 a month to student loans company (She has never earned above limit to have to pay the £1000 off but as she didnt fill in deferments (she says she didnt know she had to and didnt receive any forms) they caught up with her just before she turned 50 and after lots of letters back in forth with her explaining her low wages, her age and that she hadnt received any forms or realised she had to send them in annually she agreed this figure with them. The £40 a month is towards this years but obviously will take 3 years to pay off. My sister and I can help her with this but my situation may make that impossible in future as if I divorce and husband leaves the country he could easily not give me any money for our kids! Also my sisters baby is 8 months old so it would be her family allowance\partners wages she would be utilising so we cannot fund her indefinately. She will then have the same rigmarole next year and every year as she doesnt have the money to pay her £120 per month council tax, or even a percentage of it. Unfortunately she works split shifts, has to cover the other cooks days off, works a minimum of 42 hours but can work 70-80 when there are functions\outings at the golf club, stay at my sisters if working late or early the next morning as she cant get buses to get to her work otherwise, and holidays and has rheumatoid arthritis, hammer toe and is generally in poor health so really cant fit in or manage an extra job or she would have found a key cleaning job but would have to be beside my sisters. I think its unfortunate but unless I split with hubby and go back to work when my maternity leave ends in November, I think she will have to sell up. Have already sorted her utilities out for her but cause of her age and fact she remortgaged last year there is not a lot I can do about her £565 she pays for her mortgage but she does only have just under 9 years to go on that.

My mother doesnt have a social life, is single because my dad was a gambler and used to spend all his wages before she got them, my step father sexually abused my sister and her boyfriend cheated on her and stole any money she gave him to pay bills and spent it on himself. She has little trust of men and has no friends she can go out with or can afford to go out with, She never goes out for meals or gets take away unless me or my sisters treat her for babysitting - would that be unpaid tax too along with her tips (I am presuming thats what you are saying is unpaid income tax?) of about £10 a week. She is not clued up on forms etc so would not even know where to start filling in forms to admit this tax and as other bars, restaurants and social clubs dont keep tabs or force people to declare tips I would guess she is not alone there. As for her cigarettes, she pays £20 for £200 once a month from my sisters boyfriend who works abroad. He offered her them for free as a gift but she doesnt like being considered a charity case and feels at £20 she is already getting them for half price. She has been smoking for 40 years, back when the government were encouraging smoking and has tried to stop but has been unsuccessful. Now as she feels her life is crap she says smoking is her only pleasure in life and helps her cope with stress.

     

    As for the Sky I would guess thats her other pleasure in life. We dont have digital up here and the channels she watches are not available on freeview. Plus she has grandkids who visit and my sister and her baby stay with her most of the time so even I feel the £17.99 a month she pays is worth it and an acceptable expense. She spends more money on her bus fares to get to work than she does on her food and cleaning products etc for house so its not like she is wasting money.

     

    Yes she knows she made mistakes financially in the past but where she stayed at home raising kids from the age of 17 till late 40's with only part time jobs to fit in with the kids till they left school and with her skills more practical than academic, she lost out on the chance of building a career for herself. She only goes on holiday if I treat her and has only ever been acroad with me as I took and paid for her before I had kids for company and to give her a break.

     

    I did not realise these forums were to judge people, I thought they were to make suggestions or offer advice. I know of people who do a lot worse than my mum. She has no car so saves a lot that way. She doesnt waste money or alcohol, taxis, meals out or nice clothes to take the sting out of the fact she is living to work and has been since her split from my stepfather as any spare money in the past she spent on her kids and making them happy. I cannot grudge her the £40 or so a month she spends on her Sky and cigarettes cos I dont think she'd see the point of living without them (apart for her grandkids), and I am sure people in worse financial circumstances than my mum spend more than that on themselves. She could stop all this but that £40 would not make a change to her circumstances and would not help wipe out a debt within the next 2-3 years and improve her financial circumstances so she could see the benefits as its a drop in the ocean compared to what she owes the poll tax and council tax and her life would still stink.

     

    I appreciate what you say about reducing her outgoings so as the £40 is pretty much the only saving she can make till she gets money from the bank for her charges I guess she will have to sell her house, pay her creditors off and then apply for a council house as she is too old and her wage too low for her to be able to buy a house in todays housing market. I may be divorcing my husband as he has had 2 affairs in last 13 months (cant help himself in Asia) while I was looking after our daughter and pregnant with the second one and they are only 20 months and 10.5 months old now so may try and get a house together with her as its only way we will both be able to afford somewhere and I am young enough to get more years on a mortgage so should manage to get somewhere, just got to decide whether to stay with my husband and move to Panama next month or leave him. Think my family is cursed with men!

  17. I took a loan with associates\CITI in May 2003 which I have now paid off. It was to pay off an original loan with them, a loan with another company and give me some money as I was getting married for our honeymoon. I didnt want to take the insurance as it was high and my work are good to staff for accident/sickness/redundancy. I later took voluntary redundancy as my job was being outsourced and used this money to pay off the loan - would i be able to do anything about this seeing as I was told the only way they could offer me the loan was with the insurance which was very expensive? For info I signed the loan papers in their office and got the money that same day.

  18. I just received a letter from Scott and Co regarding old council tax debts on a house I previously owned. They are for my old house I rented out to friends of friends while I stayed at my boyfriends. The first tenant had her name on the council\poll tax and paid fine but subsequent tenants did not. I spoke to the council about this and they say I need proof they stayed there and the tenants forwarding addresses. Am I liable as the owner and is the onus on me to get these addresses? One couple moved to Ireland for a live in job and another left cos their daughters husband commited suicide and went to live with her. One still stays in area but he is the only person who's address I could probably get. Also what happens if they deny they were staying there? Is there any time limit on these debts? I last had contact with the council a couple of years ago on this but what with a miscarriage then two successful pregnancies I've been kinda busy and it slipped my mind. Thanks for any info\advice.

  19. My mums ex boyfriend kept her council tax money instaead of going in to pay it as she thought he was doing - result was she got in arrears. As she has little free funds this accumulated over the years and she now owes several years. Debts were passed to Scott and Co and she was initially paying them £80 per month via direct debit. She is not sure if she missed payments as she has money problems but the direct debit was cancelled and scott and Co took her to court and she got her bank acct arrested. this failed as she didnt have money in her account. they then arrested her wages and now she has just over £170 coming off every month before she gets her wages. Due to this she cannot hope to pay the current council tax so they contacted her and the minimum they would accept for this years was £40 per month. They threatened to have her made bankrupt otherwise. She is 54 years old and is scared she will lose her house next year as she will not be able to afford more payments, she eats at her work and stays at my sisters when working to save on bus fares when she can. She cant afford a social life though she does smoke but smokes duty free tobacco and occasionally treats herself to cigarettes if she gets enough tips.

     

    Any advice on what she can do? My sister gets away with only paying them £20 per month on her arrears but this is supposedly because she stuck to the agreement? Is her only option to sell her house and apply for council housing before her next council tax bill? I am away to get her statements from bank etc to begin process for bank charges, with her funds the way they are I am sure she will have lots to claim and plan to get her to use this money to reduce her debts.

  20. My mum went to college about 8-10 years ago and got a student loan. She never heard anything from them till a few years ago when she got a demand for money. They said she had never filled in the deferrment notices that had to be filled in annually but she says she knew nothing about having to do this. She is 54 now and currently paying £30 per month which she cannot afford. She thought she would not have to pay because she wasis below the earnings threshold and is now over 50. Should they not have sent the deferment forms to her automatically, and surely if she doesnt earn enough and cannot afford she should not be penalised for something she didnt know or understand fully. Anyone any advice on how she can go about contesting this, she tried before but didnt use any legal jargon and they just said that because she didnt notify them she qualified for deferment she had to pay? She really struggles to pay this and if it can be stopped then great. A bonus would be if any payments she has made could be refunded but obviously that would be a bonus on her part as she would initially just like to have a bit extra money every month.

  21. My mum let her £200 credit card to Capital one spiral up to nearly £1000 due to charges and interest and did same with CITI card and also with a Littlewoods Flexible acct among others. She got hassled day and night by the companies and DCA's so eventually out of desperation remortgaged and paid them all off. Can she now claim the charges back? I am not sure if she has the account numbers\reference numbers and whether the debts were sold to the DCA's or who she paid off - the DCA's or the original companies? I will ask her to check through her paperwork but wanted to check out her options before I go building her hopes up that she could actually end up with some cash! She currently earns about £1050 a month but has an arrestment on her wages for council tax (Which they try to increase every year cos she cannot afford the current years cos they take too much)- Its about £170, her mortage is £560, she has a fine she pays £5 a week to, her electric and gas are about £150 a month (My youngest sister and her baby stay with her) then with phone, insurance, v license, sky tv, and bus fares of about £100 per month she basically lives on her tips she receives at her work so anything back will make her day. Her health is poor and her doc wants her to get an op due to hammer toe (she also has rheumatoid arthritis and tinitis (Spelt wrong!) but at moment she couldnt survive without her work and the tips.

     

    As an aside I will be claiming myself as I have two cards with them so will let u guys know how the two of us get on!
