I know you said you have seen some logs of sorts but did you SAR them you or just ask them in general for the evidence, you may get extra infomation from them that they where unlikely to give you for free with a SAR, just ask for every thing they hold with your name/username etc on it. It may be enough to absolve or may show naff all, dont know untill you try. If you did do a SAR then you might want to talk to CAB to see where you stand, especially if the logs/reciepts are inconclusive. Was you on the website until the auction finished, somebody may have inadvertainly bid for you, be it by accident or on purpose, is the IP address on the logs the same as you computers address for all the bids?
  2. Rubbish, if you haven't signed the inventory how are you to verify if it is a true account of the property and furnishings law or not. Does this mean the landlord can claim for the three plasma screens, AGA etc etc that are on thier own list. It has been proved many times that if the inventory isn't signed it makes it extremely hard for the landlord to reclaim against the tennant for that type of damages, usually losing out because of the lack of signed inventory. If your agents wish to use assumptive procedures then at least you can try to claim aginst them for poor procedure when you lose out. If the OP has any pictures gather these for future use. You will have to open a dispute with the relvant deposit protection scheme (if you have one, but thats another story) if you want your money back. Try at first to be civilised but dont let them fob you off. MrShed is the numero uno around here so he will correct me if I'm wrong and will no doubt give you further guidance.
  3. Wouldn't have thought so or else every one would pull out and no-one would be liable, sounds like they where artificailly increasing the bids to me and went one too far. SAR them for all details they have on you for that auction, easily retrievable as the auction will be numbered in an easy to find manner. Might gat some infomation from them that they don't want you to have i.e actual bids

The union can help with the working issues for example, 14 hour straight shifts with no breaks, not only is the op not getting a break but the 11 hours mandatory break between shifts will be being breached aswell. I now work for the forces so doing certain task in unpleasant conditions doeant really hit the heart strings I'm afraid, yes I chose to join up but you dont know every aspect of a job until your actually in it. As you said, the op should get in touch with the union but see a regional officail rather than a local one and get the real issues sorted, I skimmed the post the first time and missed the main gripes of the post, sorry for that, the point still stands about the camera in thier room though, if laws are being broken then what regulatary bodies other bodies can help in the specific sector they work in i.e defence contractors have good unions but something like this would be an oppsition MP's little gem for turning the screw. Could they use the health and safety exec, Are they laws that are being broken with the screens and timing or just guidleines, for example its recomended that you do take a 10 minute break inside every hour that you are on a computer, guideline not a law. In my pre forces experience, the unions always needed a push before they gathered momentum so just keep on at them and if they dont act use thier greivance procedure until they do.   5. They had it in a part of a factory I used to maintain to stop the staff from stealing, bit unpleasant maybe but unlikely to be illegal. They are wachting thier staff and belongings which every company has a right to do for various reasons, if they put one in the bogs I'd question it. They may be watching one of your collegues but just having it on when they are in would be discrimitary. Same with super markets or banks, they dont switch thiers off to give the staff a break. If you dont feel comfortable with it then change job. You could also ask for a staff/tea room etc that doesn't have a camera so you can have a break with out being watched but the company that ran that factory mentioned above also had cameras thier too so dont worry about it unless your doing something wrong. Its the 24hr CCTV that the government wants that I'm concerned about.
  6. Most of these DCA's have a habit of sending letters that look like court orders but actually aren't. Is there court details on it, etc, if it is a court order it will be from a court and will tell you to reply to that court not the DCA. Its likely to be a bluff, nasty tactic they are trying at the moment. If it is a court order, you will have a few option including trying to hold of any action untill you have had sufficient time to prepare yourself. The good caggers about will help you either way so dont worry to much yet, read the stickies and give whatever info you can about the letter/debt etc without giving away any personal/delicate details. people will then have more of an idea where it stems from and how best to take action be it paying up or crossing swords.
  7. Have to buy and sell through the site, isn't that restricting the owners right, thought we live in a free market, that sounds more like a monopoly all be it on a 3 acre scale. I thought the consumer with unrestricted goods can buy and sell from whomever they wish to, can understand charging a delivery fee i.e the time for somebody to over see a delivery etc but I didn't think they can restrict you buying and selling rights.

As 389Shell said, before you do alter your licence, take it to the bank with your marriage certificate, my wife also had to do this for changing the name on her bank accounts before she changed her licence over, passport had ran out or was about to so there wasn't any point in dealing with that at the time.

Check your statements, didn't pay it then cough up, but I would tell them they're cheeky bugg3rs for saying it was an oversight on your part, normally you give your card details as you did and thats it, they dont normally send a bill in the post, tell them to rescind that comment because 17 months since they took your details and they want payment now, it is clearly not your fault but it does sound like you still need to pay though.
  10. The reason I asked if she was being pedantic was yourbank offered viable otions only to get a reply that seemed to be looking for a row rather than help. ''Nope'' followed by fairly bad examples does not count as a reply that is asking for help. I have mentioned an alternative for a viable photo I.D which would also suit the other posters that seem to find it hard for one reason or another (not discounting all of them) to get I.D.. Lady P your talking third party again, if its a genuine issue get your doctor, community bobby etc to sign a passport photo of your self, generally free to certain groups, or a solictor will probably do it for a small fee. Patdavies, someone mentioned they upgraded thier paper licence for free, my wife got her photo card changed to her married name for free when we got married, if a certain photo ID is so important for a job (signed passport photo as said earlier should suffice so long as its signed by certain people) then the small outlay for this would be recouped in the long run many times. Prioratise what you want, driving licence photo card for job or watch Jeremy kyle re-runs again, sorry to sound a little condascending but its your choice, the options are there.
  11. lady python Nope. How about housewife, not working, not claiming benefits, all utility bills on spouse's name, no bank account, over 18 but under 65? Birth certificate, National Insurance card. Seems to me many housewives who don't have photo ID driving licences or passports (not everyone can go on holiday abroad) are non-persons!!! .................. I think your just being pedantic here. A house wife who doesn't work. not claiming benefits and bills in the spouses name between those ages can clearly get the money from hubby dearest to pay for a passport or provisional driving licence for the need of a picture I.D if it is that important. Most banks will also allow a passport photo signed by a responsable/proffesional person (policeman, doctor etc) should they not have any of the above. Not every one can go on holiday but the finances must be getting pretty poor if they are not entitled to benefits due to hubby's wage yet the wife still chooses to be a housewife. I would suggest that said housewife gets a job and some of these issues will go away. There will be so few people in that situation that it isn't a need for a change, don't go giving the government ideas for the ID card they want to impose on us
  12. My head agrees with bookie but I am a vindictive swine so I would let him e-mail you more and more then you might have a case for harrassment. Dont think they are racist as such but derogitory yes, fine line but not crossed with those examples, if you say its been going on for quite some time then it will start to have a racist element so keep the evidence then hand it to the police.

It s even more simple than showing a price or not, it was taken to the till, the till said it was x amount and she paid that amount as shown on the reciept, if it said £3 a tub she would still have paid it. I bought a load of running tops from tesco's like that, label stated £17 reduced to £10, the till said £3, hence why I bought more. The op accepted the price offered by boots doesn't matter what the stand says. The greatest problem will be getting any finger prints or DNA erased from the police files.

Keep on pushing, tell them your going inform watchdog, travel guide websites etc etc with your experience and the dvd. they might have a change of heart if they think they will get a name for shoddy standards, especially when its one of thier better rooms, I wouldn't let it go. Maybe when you have exhausted those routes a an LBA might be in need, you paid for a service with certian standards and extras expected yet you recived none of these. breach of contract maybe, dont know but there will be other routes, just try all the noraml routes first.

That will be calculated in to the statments you have from halifax, they are providing you with the actual cost that you have paid including all the different rates of interest that are applicable , i.e more when overdrawn, normal rate when within the credit limit. You just need to know what you should have paid for a comparrison. As for legal pickle, if MrShed won and was awrded the money owed plus the 8% then that I thought would be the status quo, thats the position they would have been in had halifax not taken the PPI. I might be using the term status quo wrong but the courts should decide an outcome on the evidence given and in this case, then put it right by awarding hopefully MrShed, MrShed gets his monewy back and halifax lose the money, with the interest there to re-address halifax's temporary gain and MrSheds temporary loss. Either way there is more than one way to skin a cat and legalpickle (who cleary has more experience than me) has suggested another option which you wasn't sure you could do, this may negate the need for a court appearance but I dont know how the FOS works.

TBH this is what you pay your insurers for, they get your money so they do the leg work, if you are so convinced your in the right give them all the details and they should sort it out, including finding those officers and previous drivers. If your not convinced then dont pay your excess or get your motor fixed untill the facts are clear, that way you wont have registered a claim.
  18. Not sure where it say it but either SOGA or distance selling regs basically say the seller is to foot the bill for faulty, damaged, incorrect goods etc. I'm sure a walking law book will direct you properly where to find what but you are not liable for their mistake.
  19. I cant get in to your file MrShed, probably me being a biff. What i have tried to do is give two examples of a credit card, one with and one with out PPI. The second one is with PPI, after a certain amount of time just like yours it was paid off, say 6 months, I have tried to show an example of what cost might be involved for that card, you actually heva the real cost in your statements. In the first one I have shown what the cost should have been had PPi not been added. The difference between the two is what you are owed to make the status quo. All you need to do is work out what it should have cost, i.e minimum payment up to the month before the balance was cleared, then add the balance which would have been the final payment to end the debt the same time as the real debt, i.e when you paid it of to close the account. So if you made 10 payments in real life followed by the final payment to close the account, on the ''should have cost'' version you work out ten months of minimum payment (this is what you should have paid) followed by the balance which would clear the debt and put you in the position you should be in. The difference between the two as i say is what you are owed, minus anything they have already paid plus 8%. I know it isn't particularly clear but its the best solution I can think of for working out what your owed. If this is too much, you cant claim legal cost in the CC but can you claim an accountants cost. £200 probably for an even more accurate figure but if you can claim it back stick it in the bill

  21. From what you say MrShed I agree with you points, the court system tries to put people back at the status quo. Bit busy for now but I will try to get a clearish example soon on how to work out what your owed as you kept on paying with no or little effect on the balance. As far as the ombudsman is concerned I dont know but if you send another letter wanting the outsatnding money then the issue has not been resovled so the accounts being closed shouldn't affect it. After all the help you have given here I was begining to think you are infallable, I'm sure there will be plenty of offers for help
  22. start a new thread and I am sure people could help you, I left FF and they wanted 3 months I think (years ago now). I just stopped the payment, they rang me I said I had sent a letter giving them my notice, they accepted that and nothing more was said. get looking through your contract for any caluses that might be of use and ask away in another thread. If your having a knee operation wouldn't you get some kind of physio after that that you can do your self, might be worth postponement.

I had a similar message from them about using my card in the states, it wasn't halifax's normal call centre it was the fraud prevention lot. then had an arguement about why I wasn't giving my details to somebody who rang me that 1; I dont know and 2; who should know these details as they rang me. Eventually I rang the number on the back of the card and got back to the fraud fraud prevention team, the number they rang me on didn't even match that one. All inocent in the end they just wanted to confirm it was me using it, even though I had to confirm it was me when I payed. Not often I shop a Tiffanys so I can see why they checked but they go about it in a bad way. If you get another phone call, call the fruad prevention team or whatever they are called now as it might be them checking certain payments, they should just say to phone the number on your card though rather p!ss about with ''press 2 if you want to eat my ass''
