  8. My problem is that the sheriff in the dumbarton region is granting all sists 9something which he practically told me before i had even got up to state my case so i was on a loser to start with) so i dont know what grounds to appeal i would have to try and turn him around

The Judge granted the sist which i thought he would when after using the arguments from the GLC and the case in inverness he said that he was aware of the inverness case but had a different opinion than the sheriff there. He also said that whilst he is aware that i am frustrated he wanted to wait untill the OFT case was finalised. I said that that case was not binding in scottish law and although he agreed he felt that it would filter down to here or words to that effect. He felt that if he did not grant the sist then it would be almost certainly appealed which would waste valuable c
  10. Would it be worth appealing against the decision to sist my case or is it not worth it. The sheriff never mentioned the practice note in his decision.

  12. i settled a couple of accounts early, accepted there offer of full and final settlement, the amounts were not that great so was not bothered too much but i am still getting charges on those accounts does that mean i can make a fresh claim.
  13. Yes just fire them away, there not going to change there minds now unless you have asked them to refund the charges.
  14. Well done and good luck, i had yo appear in front of the sheriff yesterday to oppose a sist but the sheriff granted it. He said before i even spoke that he doesnt agree with other sheriffs who dont grant them and in his jurisdiction he will always grant them. My case was in the Dumbarton court
  15. Thanks for that, i am fine just hoping that the test goes the right way and i can wait a litle longer. When the sheriff said that he didnt want the court time wasted i nearly laughed because by god they will be busy if the test case goes against the banks. My feeling is you will just apply for your money back through the banks and the halifax seems to have changed its fees. It is now £30 for them to pay something if you have not enough money in your account, this then takes you over your credit limit which the then charge you another £28.
