  1. Looking for a bit of advice...

     

    I had my phone stolen on Saturday evening at a music festival. I was sitting down on the grass & it was there on minute & when I turned round it had gone.

     

    Now I cancelled the contract with Vodafone Saturday night, I phoned up the police & got a crime reference number on Sunday morning

     

    Now I am getting worried (I worry a lot lol) that somehow the insurance company (Premier Plan) are gonna try & squirm out of paying up for a new phone??

     

    Anybody got ANY tips about making a claim with the bastards???

  2. RESULT!!!

     

    I just got a cheque for 2K in the post!!!!

     

    It says in the letter "As previously stated, acceptance by you of this goodwill payment will be in full and final settlement of your claim against our client and strictly on the basis that you write to the Court withdrawing your claim"

     

    The cheque has to be paid into my current account too...

     

    Is there anything else I should know/do???

  3. Well when my AQ date was up I phoned the court to see if Cobbetts had returned theirs so might be worth you doing the same. Cobbetts will have until 4pm to submit their AQ otherwise your file will go before the judge who will make directions on yor claim.

     

    If my case is anything to go by it should only be a matter of weeks now before you receive your full settlement. I was refunded last Friday, 15 days after the AQ deadline.

  4. I am seriously surprised that the banks are allowed to get away with these charges, if they do truely believe they are legal then they should prove it - IN COURT

     

    NOT waste the courts time when their time/resources can be spent convicting murderers, rapists, burglars, drug dealers etc etc etc

     

    This makes me abolutely LIVID to be honest, their blatant greed is not only affecting the poorest of people but the WHOLE population if you agree the courts time is being wasted

    New on here and a bit daunted. However, having read some success stories I am left wondering if there are any unsuccessful claims, where the bank has just rejected the claim and gone to the court and won.

     

    I have started the ball rolling by paying the £10 and getting the statements but was just wondering - if it goes to court - thenwhat?

    Read people success stories etc etc, you will get a feel for the steps you are likely to take...

  6. I recieved an offer (half the amount) on Friday, I am getting ready to send my rejection letter.

     

    Im not sure whether to include this part:

     

    I first contacted your client regarding their unlawful charges on 12th July 2006 and therefore disagree with your contention that some of these charges fall outside the scope of the Limitations Act 1980. However I am happy to let the court decide on this matter.

    In their offer letter they say:

    Our client considers that your challenge to its charges would fail in Court. Our client believes that its charges are fair bla bla bla. It considers that the amounts debited to your account ahve been applied strictly in accordance with your agreement with it and its published tarriff. Our client is also committed to ensuring the transparency of the information that it gives to its customer about the operation of its products. As such our cliend does not believe that your claim has any prospect of succeeding.

    What should I write???

  7. I am also not prepared to agree to any confidentially clauses you try to impose, unless of course your client wishes to make an offer of due consideration in addition to the amount of £xxxxx, in order to be afforded this privilege by myself.

     

    Cobbetts have offered me £950, my question is whether the banks have actually agreed to give more money to claimants for confidentiality clauses - thinking about it shouldn't that be how it's spelt?????

  8. Received a date for the allocation hearing today, it's on the 14th February 2007, which seems absolutely ages away.

     

    I've got to admit, I'm getting tired of waiting for this now. By the time that hearing comes around, it'll have been around 8 months and still a settlement isn't close. Seems like a ridiculous amount of time to wait, since a lot of claims are sorted from start to finish in less than half that time.

     

    Yeah I agree but if you do get it surely it'll be worth the wait!!

  9. Ask them to attach this to your claim as you were unable to fully detail your POC when submitting your claim online due to the limited space provided.

     

    Sorry to be a pain, do you have a copy of what you wrote to attach the new POC??

     

    I want to get everything right!
