  3. Hi everyone - been approached by a claims company making guarantee's they can get most of my credit card debts written off within a few months for 10% charge. Up front fee only £150. They seem to be making a big thing about the card companies increaing my limit (due to good payments) without me asking for it or signing a new agreement. Obviously having already claimed back bank charges with your help I thought I'd do my own investigation first. So - from what I've read this is my understanding. * Request copy of my credit agreement (signed etc...) which I know they won't have * Stop paying my monthly payments as my account is in legal dispute when the deadline for providing this information is passed and they've not coughed up * Fend off the letters threats and most likely end up in court (offer them a settlement prior to this ?) Best outcome is they write off the debt? really? Likely outcome is - I make a final offer to settle the account which they accpet and its closed down. My Q's are - what happens to my credit rating during and after this process? From what I understand they can't impact my credit file as I've not signed a valid credit agreement, but does this actually stop them? I want to apply for a mortgage in a few years time and don't want to ruin my credit rating. Has anyone actually gone all the way and won? And in winning what was the outcome of their case? Also, my barclaycard platinum was originally an Liverpool Victoria card but they sold their credit card book recently to BC. Does this make a difference? Thanks LouLou

I think the fine is great news for us all but i do have this one criticism of the FSA, in the grand scheme of things LV is small fry, they sold a tiny proportion of loans and I wonder why the FSA didn't go for the 'big guns' as after all they all appear to be miss selling PPI. From the reports I read LV told the FSA of the problems it wasn't like they were 'caught' miss selling. Either way it sets a great example of the consequences when you get it wrong so hopefully the key players will be urgently reviewing their processes and selling tactics for the benefit of all of us.

  6. My husband is in the armed forces and has recently earned a well deserved promotion which along with the higher risks comes a higher wage. Unfortunately he has not seen any of this money yet as the 'system' hasn't updated yet and he's been under paid for 3 months. He'll get the money eventually but some of the lads have been waiting over six months for their pay rise!! Can they do this?
  7. Thanks for all your replies, I have set up a contingency account with NatWest which was a lot easier than I thought, so I shall go for the 2nd Claim. You are right £400 is a lot and I'm going to go all the way!
  8. I have already received £2400 from Barclays after successfully following the process, so I thought I'd claim back charges I have received recently. After my first letter, I have a response which says, the first payment they made was a gesture of good will and that I should consider banking elsewhere if I do not agree to the terms and conditions. Reading between the lines it looks like they may close my account if I go ahead with the second claim (its for £400) Has anyone else made a successful second claim from Barclays? Are these empty threats? Thanks Louise
  9. Barclays did not close my account and paid out in full, however, I have just made a claim for further charges. Their reply was the first refund was a 'gesture of goodwill' if I attempt to claim further charges they have suggested I consider banking somewhere else. It seems that even if they are going to close your account, they give some idication of this before you get too far down the process, so you can make an 'informed decision'

Well, you are not going to believe this, I was just preparing for a day of hell in front of the computer preparing my court bundle (left it to the last minute as usual), my court date is not until next year, when I get a letter of full settlement! It's about £150 short of the full amount but at the end of the day, payment this side of Christmas, no more worrying about the court date, not having to do my court bundle and actually getting my money is worth the £150 lost. This is amazing, I always thought I would get my money but you always have the tiny bit of doubt that you'll mess up somewhere in the process by not filling in the forms rights or forgetting to do something. Or you'll be the one they take all the way to court! Without the help of this website I would never had stood a chance so thankyou so much. Donation will be on its way as soon as money is in my account. (How do you do this by the way?) To all those other Barclays customers in the process, don't give up, no matter what happens, get organised and stick to deadlines and you'll be a winner too! I am chuffed to bits!

Just wanted to let everyone know that my brother was claiming £1400 from First Direct, and has today received a full settlement, he didn't even have to go as far as filling in the allocation questionnaire!! As his big sister who had to nag and nag him to do his letters, fill in forms, screamed at him when he nearly settled for half the amount I am pleased for him but frustrated as my Barclays claim is not going as easliy and yet I have done everything by the book!! So good luck to all those First Direct Customers who are just starting or have just done the money claim website bit, looks like you might not have to wait too long.....
  13. I have a quick question - I have filed my allocation questionnaire and paid the £100. As I did not want to hold up the process of my claim I am intending to make another seperate claim for charges I have received in the last 3 months. (yes well I never learn!) Do you think this will be a problem or should I wait until the first claim is finished with? Also, am I right in thinking that NO ONE claiming from barclays has actually made it to court? I am assuming all cases are settled very close the court date. I just read a thread that said Barclays have sent a 'see you in court letter', is this a standard one we are all getting? Hope someone can help me out here. (and put my mind at rest!) thanks Lou

  15. I started this whole process a long time ago and have finally got to the stage now where I submitted my claim and have just returned the allocation questionnaire to my local courts. Since submitting my claim I have incurred further charges, can I claim for these as well, or do I need to follow the same process but as a seperate request for a refund? There were a few things in the defense statement that bothered me and would welcome any advice on this. "The particulars of claim do not provide details or particulars of the account in question and or the precise charges alleged to have been unlawful, or the date thereof." (I was going to send a copy of the excel spreadsheet with each charge, reason and date back with the allocation questionnaire, is this OK?) Getting a bit nervous now, especially as there are few settled claims in the Barclays folder, those that have gone through the process, what is likely to happen now? Many thanks and wish me luck!   16. I have today received an offer of £700 as a good will payment ( I am claiming 2K) Obviously I won't be accepting so I will be going to the next stage. Does anyone have any ideas on what has happened to all the other Barclays claims and why there are few details in the concluded cases? I have picked up info on threads about 'gagging orders' is this really true? Will keep you posted Lou
  17. I have had a reply to my DPA request letter (they just made 40 day deadline) and I am a bit cheased off cos they only sent statements til may 2004. They say in the letter all data before this date is not held on a computer system or a structure filing system and thus does not fall under DPA regulations!! However if I want the info prior to May 2004 I have to pay £3 per statement. I am a bit confused now as what to do. How can thy say they data they hold before may 2004 does not come under DPA and yet it is available if I am prepared to pay for it? Is this a loophole that banks are going to use to their advantage, barclaycard being the first? I am intending to call legal department at Barclacard to dispute tomorrow. Also my other claim against Barclays, well they missed their deadline to reply to my request for refund, I am not havig much luck! Lou
  18. Now that I have started my claims with Barclays and are waiting until the 8th May for a reply I thought I'd get the ball rolling with Barclaycard. What a total joke they are!!! I sent the DPA request letter recorded delivery with a cheque stapled to it for £10. The muppets went and paid the £10 onto my card as a payment (despite the fact I pay by direct debit) and have totally ignored the letter and deny receiving it! I have had to go through several difficult phone calls to get my data sent to me, finally getting a call from their call cent at 11pm (better late than never?!) last night to say it would be with me within 40 days. I corected them on that, it would be with me within 40 days of the 7th April when they banked the cheque for £10. From other threads I can see this is not the first time this has happened, delaying tactics or just bloody stupidity? I am also concerned at the lack of concluded cases with Barclays..... I won't be accepting any offers except the full amount! LouLou
  19. I have had my first reply to my letter requesting a refund of just under 2K, (usual one saying they are investigating) so I am waiting now for my offer. I am a little concerned at the lack of cases concluded with Barclays, are there many Barclays customers out there who have accepted the 50% offer? I hope not and that many are now court claims with dates approaching, I see Barclays are deffending, has anyone actually gone to court yet with Barclays? I have just been charged another £30 recently, ( I will never learn!) so they don't seems too concerned with dishing out the punishment! Also, I did not get any clarity in the reply to my DPA letter about manual intervention, do I need to be concerned about this? Will of course keep you updated.... Lou I passed on details of this claim/website to atleast 10 family and friends and despite their initial enthusiasm no one has yet written off to claim their money back! Shame on them.. They seem to think its all going to fall flat on its face soon and all I will end up with is no money and a bank manager out to get me!
  20. Hi there, I was very successful in hand delivering my letter to my local Barclays Branch. I received my Statements in under a week and they did not charge me either! The branch said they would forward it to the customer services department. (i presume they faxed it over due to how quickly I received a reply) Good Luck with your claim. Lou

  22. Well I am amazed. Dropped my DPA letter into local branch and got my copy statements 1 week later at NO CHARGE. After having fun with the highlighter pen I can't believe I have paid £1990 in charges, well I can cos I am crap but blimey! So, next letter is on its way and I now start the same process with Barclaycard and my husbands Barclays Bank Account. Might also consider GE Capital. Thanks again for the help. A Voucher will be on its way soon for some books. LOULOU
  23. Just wanted to let you know that my brother rang first direct today, he said he wanted Bank Statements for last 6 yrs, they said OK that will be £130 please. He replied with the DPA and actually the most you can charge is £10, the girl said well I soppose we could compromise.... My brother said, well yes thats fine as long as you only charge me £10! After a discussion with her supervisor she cam back to my bro and said she had been mistaken and the statements were on their way for £10. Hopefully you will have the same response, good luck. LouLou
  24. I have delivered the DPA letter to my branch a few days ago and am now just waiting to hear if/when they plan to send me my Bank Statements or list of charges. My credit rating is pretty poor due to late payments but I managed to set up an account with Nat West as my contingency. (Step account, nothing speacial but atleast I can pay bills and receive my salary) The personal banker was not too impressed and tried to investigate what I was up too, had I been on the BBC website about bank charges blah blah blah, for once I managed to keep my mouth shut! Will keep you updated on my progress, thanks for all the help, some of the threads have been very interesting! By the way my best friend, brother and sister are all starting the prcess too!
