  1. I might be a bit slow but I have finally sent my summons as below total claimed £1,567.13. Just doing this makes me feel better. 1. The Claimant has an account 50676306 with the Defendant 2. Since 05/06/00 the Defendant debited charges and interest in respect of purported breaches of contract. 3. Defendant is aware of all details as a list of charges has already been supplied. Another copy will be sent. 4. Claimant contends: (a) The charges exceed the Defendant's losses caused by the breaches; (b) The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law. 5. Claimant claims: (a) return of the amounts debited of £1,290; (b) Interest per S.69 County Courts Act 1984 of 8% - £277.13 continuing at 8% until judgment or settlement at a daily rate of £0.28; 6. Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. 7. Costs allowed by the Court.

I am in exactly the same situation and havent decided which to do yet. Good luck !

  4. I worked for Barclaycard until 99. They introduced automatic out of order fees around 98/99 as the American Card companies such as MBNA became competition in the UK and made so much money from them. Previously the out or order fees were only applied after being threatened when overdue/overlimit and not paid. The fees were therefore to cover the costs in chasing up the overdue/overlimit payment rather than just automatically apply to any account overdue/overlimit without any additional cost.
  5. I already have statements going to may 2004 but not earlier and am aware of the microfiche situation. Should I estimate charges for the previous 4 years? What response have others had when estimating charges against Barclaycard have they offered to refund estimated charges less £12?

  7. Hello I have got fantastic information from this site. Just letting you know how I have got on. 1. Wrote to Barclays requesting charges. 2. Barclays wrote back returning £10 and sent statements showimg £1,045 charges over 6 years. 3. Sent letter before action. 4. Barclays denied responsibility but offered £500. 5. 26 Jul sent letter rejecting offer. Had no response and am about to issue claim through money claim online will let you know how it goes.
