Thank you for your reply Michael. I have included the acc no in the original mc but i haven't submitted it yet. Do you think the wording is accurate and do i need to say why i am going for the contractual rate of interest?

The claimant has an account with HSBC opened January 2002. Since March 2002 the defendant debited charges and interest in respect of purported breaches of contract. Defendant is aware of all details as a list of charges has already been supplied. Another copy will be sent. Claimant contends the charges exceed the defendants losses caused by the breaches. The term permitting the defendant to levy such charges is unenforceable under the unfair terms in consumer contracts regulations 1999, Unfair contract terms 1977 and at common law. Claimant claims return of the amounts debited of xxxxx plus interest of 15.9% continuing at 15.9% until judgement or settlement at daily rate of 80 pence. Alternatively, interest per S69 county courts act 1984 of 8%. If the charges are a fee for a service then they must be reasonable under S.15 of the supply of goods and services act 1982. Costs allowed by court. This is just a rough draft of what i have already written in the mcol. Also, do i need to send another copy of the charges to the bank and the court? Any help or advice would be much appreciated.
  4. Thank you for your reply crusher, have draughted LAB with acceptance of offer as part payment.
  5. Thank you for your reply libertie, i shall do as you suggest and amend the LBA. Do you think i should ignore the offer letter and just send the amended LBA? I have read so many posts again tonight my head is spinning, i know i have read about the lba and amendment somewhere but can't find what i am looking for.
  6. Should i ignore the partial offer and just send the LBA?
  7. Hi all, Son has received partial offer even before he has sent his LBA, is this normal? I expected him to get it between LBA and Court. Many thanks for any comments.
  8. Hi Bill-k, Glad to see you have had a nice long lie in today:p Yes, Mindzai has been really patient with me and so helpful, it turns out it's because i am using OpenOffice, i feel so silly not realising it. I have offered to go into the Dunces corner, I think Mindzai is being very gentlemanly by not responding to my offer I shall do as you advise, use a folder to put all my bank files in, instead of saving them all over the place.
  9. Hi Bill-k. You must have been up before the lark yesterday morning:p It's all that jungle juice confusing you:D I had a reply from Mindzai, but as you will see from my post to him i am a bit useless at getting my computer doing things i want it to do, maybe i should try fermented bananas
  10. Hi Mindzai, Thank you for your reply, i have tried to upload it onto MYsharefile, but it was uploading for over 10 minutes, so i stopped it, it shouldn't take that long, should it? As it was i lost the original file, so had to input all the info again, that's why it has taken me so long to reply to you, sorry. Hopefully i have saved it this time to somewhere i can find it again!!!! I have also printed it. Also, if i do manage to upload it, how do i PM you?
  11. Hi Bill-k, How is your head after consuming all those fermented bananas in liquid form? Hope it's clear enough to answer a couple of questions....You said to yell if i didn't succeed with the ss, well i didn't. I have put all the information in manually and even tried again to change the date on line 51, but it still does the same, aligns to the left. I have sent the prelim letter off and the fourteen days were up last Thursday. It won't matter if the LBA is sent off late, will it? I really want to get the totals correct, also the wording. Especially as i want to claim for contractual interest. Or would it be ok to send off the LBA as it stands without the contractual interest and then add it on at the N1 stage?
  12. thanks for the reply Bill-k and the giggle, i can see you trying to peel a banana while looking through the bottom of a glass or maybe even a bottle, with one eye on the screen..................I appreciate your help, many thanks, will have to wait until Mindzai is here though, spreadsheets?? they are as clear as mud to novices like me.
  13. The problem date is 25/09/2004. I have re-entered it a few times, but it still aligns to the left.....
  14. Thanks for your reply Bill-k, On the charges/interest page, line 51, the date is aligned to the left, where all the other dates are to the right?? It is the interest daily sheet that i have been hoping to read, but on the totals boxes in the first box i have £2965.50 the next 2 boxes have #NAME? Then the interest side, the date of interest is entered, int paid on penalties is 0, then compound int and combined int boxes have #NAME? Any ideas? Many Thanks
  15. You have probably gathered by now i am not used to spreadsheets, but i am enjoying the challenge, along with the frustration of not knowing what i am doing wrong.
  16. Hi again, My problem is that i am unsure how to word the LBA to include the contractual interest i want to add. Which i cant do because i am having the same trouble as Ecobabe had............... I have just looked at the dates again, there is one date line which is out of line with all the others, i have tried to change it to get it in line, with no luck. I wonder if that could be the problem?
  17. Hi Ecobabe, I would love to advise you, but as much as i have read these sites, i am still rather confused with a lot of things. I would hate to advise you wrongly. I am sure someone will come along to help you. Good Luck.
  18. Hi again Bill-k, I have filled in all the information starting from the front page. Name, sort code and bank account, etc.
  19. Hi Bill-k Thank you for replying. I have checked the dates and they look ok. In the correct format, but then, i have been on for quite a while and things are beginning to blur. I shall have a look at the opening page and get back to you, if you are still around, it is getting late.
  20. Hi All, i have downloaded Mindzais spreadsheet, but for some reason i am getting ### name?? in some of the boxes. I have seen a similar question asked elsewhere about this, but do you think i can find it, i am going cross eyed reading different threads where i thought i had seen it, but to no avail. So, if anyone knows what thread or who asked the question i would appreciate being pointed in the right direction. Many Thanks in advance.
  21. Really impressed with both of your letters. I would love to be a fly on the wall when they are read by Mr O'neill and Penny Berryman....... They disregard the letters at their peril, i'd say. He doesn't hold back your Mindzai, does he? Good for him. Hopefully, now they will take him seriously and reply to these letters in a professional manner.
  22. Hi Cornucopia, How rude and bad mannered these people running the bank are showing themselves to be. An acknowledgement of some kind should have been sent to you. I read what you are being subjected too and i think it is appalling. How can they get away with it and sleep at night, talk about a bit of power going to their head. They don't seem to realise they are causing so much misery to so many people and the worst of it is, they don't care. Well, i am sure anyone who reads your story do care about you and your husband and are supporting you from the sidelines, so to speak. I don't know anything about putting in a complaint to the OFT, but, from what you have written you certainly have cause to complain to someone. They have no right to treat you like this. Best wishes to you and your husband. Pinkychops.
  23. I can't wait to read the next update, it has been so interesting following your thread. Myself, i would probably have given up ages ago. I admire you both for your determination to see it through. Best wishes and Good Luck.
  24. Son sent his preliminary letter 28th september by recorded delivery. Can he add the postage to his claim? Thanks in advance for any replies.
