    Thank you for your reply Michael. I have included the acc no in the original mc but i haven't submitted it yet. Do you think the wording is accurate and do i need to say why i am going for the contractual rate of interest?

    The claimant has an account with HSBC opened January 2002. Since March 2002 the defendant debited charges and interest in respect of purported breaches of contract. Defendant is aware of all details as a list of charges has already been supplied. Another copy will be sent. Claimant contends the charges exceed the defendants losses caused by the breaches. The term permitting the defendant to levy such charges is unenforceable under the unfair terms in consumer contracts regulations 1999, Unfair contract terms 1977 and at common law. Claimant claims return of the amounts debited of xxxxx plus interest of 15.9% continuing at 15.9% until judgement or settlement at daily rate of 80 pence. Alternatively, interest per S69 county courts act 1984 of 8%. If the charges are a fee for a service then they must be reasonable under S.15 of the supply of goods and services act 1982. Costs allowed by court. This is just a rough draft of what i have already written in the mcol. Also, do i need to send another copy of the charges to the bank and the court? Any help or advice would be much appreciated.

  5. Thank you for your reply libertie, i shall do as you suggest and amend the LBA. Do you think i should ignore the offer letter and just send the amended LBA? I have read so many posts again tonight my head is spinning, i know i have read about the lba and amendment somewhere but can't find what i am looking for.

  7. Hi all, Son has received partial offer even before he has sent his LBA, is this normal? I expected him to get it between LBA and Court. Many thanks for any comments.

Hi Bill-k, Glad to see you have had a nice long lie in today:p Yes, Mindzai has been really patient with me and so helpful, it turns out it's because i am using OpenOffice, i feel so silly not realising it. I have offered to go into the Dunces corner, I think Mindzai is being very gentlemanly by not responding to my offer I shall do as you advise, use a folder to put all my bank files in, instead of saving them all over the place.

  10. Hi Mindzai, Thank you for your reply, i have tried to upload it onto MYsharefile, but it was uploading for over 10 minutes, so i stopped it, it shouldn't take that long, should it? As it was i lost the original file, so had to input all the info again, that's why it has taken me so long to reply to you, sorry. Hopefully i have saved it this time to somewhere i can find it again!!!! I have also printed it. Also, if i do manage to upload it, how do i PM you?
  11. Hi Bill-k, How is your head after consuming all those fermented bananas in liquid form? Hope it's clear enough to answer a couple of questions....You said to yell if i didn't succeed with the ss, well i didn't. I have put all the information in manually and even tried again to change the date on line 51, but it still does the same, aligns to the left. I have sent the prelim letter off and the fourteen days were up last Thursday. It won't matter if the LBA is sent off late, will it? I really want to get the totals correct, also the wording. Especially as i want to claim for contractual interest. Or would it be ok to send off the LBA as it stands without the contractual interest and then add it on at the N1 stage?
  12. thanks for the reply Bill-k and the giggle, i can see you trying to peel a banana while looking through the bottom of a glass or maybe even a bottle, with one eye on the screen..................I appreciate your help, many thanks, will have to wait until Mindzai is here though, spreadsheets?? they are as clear as mud to novices like me.

  14. Thanks for your reply Bill-k, On the charges/interest page, line 51, the date is aligned to the left, where all the other dates are to the right?? It is the interest daily sheet that i have been hoping to read, but on the totals boxes in the first box i have £2965.50 the next 2 boxes have #NAME? Then the interest side, the date of interest is entered, int paid on penalties is 0, then compound int and combined int boxes have #NAME? Any ideas? Many Thanks
