  1. I would give them another call today, I got both sheets of charges and statements within 48 Hrs. I just told them that it was unaccepable and asked them what they intended to do. My next line would have been I want them within 5 working days, but it never even came to that. Just don't lose the rag with them I did that once before on the phone and it gets you nowhere.
  2. something I forgot to ask. I don't need the English based address for my initial letter asking for my money back, I can just use my own address, is this correct?
  3. I'm now thinking of getting the english address and claiming 5 1/2 years instead of 5 using MCOL, as one claim is £6153 I double checked and they calculated it wrong. Total claim is now just under £10,000:D
  4. Yes SSlady, I understand I can file an N1 in England, and if I have to attend court then I will travel. Have I got this right?
  5. Unfortunately I've not got an English address so MCOL is out it's either N1 or the FOS. I know the FOS route can take some time and I'd quite like MY money sooner rather than later, I was thinking on suggesting to them that it would save my time and more of their money if they just settled quickly as they would incur interest plus court costs/FOS investigation costs. I don't know how open they would be to this suggestion though.
  6. I've checked all the charges on the sheets against my statements and I'm £5300 on one account and £3700 on the other. Im missing a year of statements although the charge sheet seems to have them all there, condensed. So I'm just over £9000, not sure which route to take yet though:confused:

  8. My phone call worked, both statements AND a list of charges through the door this morning. Going by the list alone, with a year missing, it's around £9500 Now my wife is getting scared because of the amount involved, she feels more comfortable going through the FOS although I'd personally like to go through the courts to speed it up a bit. Any advice at this stage would be most welcome. Is it worth trying a phone call to customer relations just to see what they say.
  9. I gave them a call yesterday on 084560379232 (customer relations) and was told they were being posted personally yesterday. It might be worth trying a call. I was 60 days BTW
  10. Good luck Carl, I hope you get your money in time for a great holiday. Also you are right, judging by the amount of posts I've read on here SSlady is an absolute star.
  11. Right, I phoned customer relations today and spoke to a very nice woman who agreed that I should be unhappy as I've waited 60 days, and she would send the statements out ASAP. When prompted to explain exactly what she meant by ASAP she replied "today if possible". Then she called back this afternoon to say she had put them out for posting personally. So hopefully my phone call has done the trick, I'll let you all know later in the week if they arrive or not.

  13. That's exactly what I'm thinking my request was sent 60 days ago. Then when I called them after almost 40 days I was told they received nothing from me but would send me a list of charges. About a week after that I received written confirmation of the request following the phone call. Now they have sent another letter about the original request saying the cheques are cancelled and they will send my details free of charge. I really don't want to wait any longer, I'm fed up getting messed about with their lies. I think I'll just phone them tomorrow and see what excuse they give me about lying to me the last time I called.
  14. A quick update on this one. Yesterday I receive a letter in the post about my SAR, which Halifax claimed not to receive, saying they have cancelled my cheques and will be providing my details to me for free. Considering I sent the original on the 10th of April, do you think I should either give them a call demanding my statements within 5 working days or send a non complience letter? I'm really starting to get p***ed off here and they have just trodden on their own foot by sending me a letter more or less admitting they lied to me on the phone.

  16. Thanks for replying. The cheques have not been cashed but I'll keep an eye on it just in case. I'll wait and see what the charges amount to before deciding my next move as I'm in Scotland and don't know whether to go through the courts or the FOS yet, as I'd prefer to claim the whole amount in one go.
  17. Yes Sea sidelady I sent a cheque to cover both accounts but it wasn't cashed. Thanks Suzie that makes me feel a bit better, hopefully they won't try to fleece me over it.
  18. Hi everyone, I've been a bit of a lurker for a while now and having sent away my SAR nearly forty days ago now I don't know if I've made a hash of it already. I've read quite a lot on here, and used the template for my SAR on 2 accounts. My wife then posted them and forgot to get proof of delivery, anyway, I decided to give customer relations a call on thursday to hurry them along and guess what? Yup never received any SAR from you blah blah blah! To cut a long story short they offered to send me a list of charges ( not statements charges only ) for which there is no cost. They also said that it could take 40 days again before I recieve them. Has anyone else had any experience of receiving a list of charges only? and can the banks be trusted on this? I've agreed to them sending a list of charges but the only thing bothering me is that if I think they may be wrong I'll have to wait a further 40 days. To be honest I've a feeling if they see how much they owe me they might not send all the charges because I've a pretty good idea that it's well over £5000.
