Thanks again but if the effect of an annulment is to return my status to pre bankruptcy, and the Insolvency Service register REMOVES the record then how or who pronounces a CRA judge, jury and executioner by allowing it to stay on my file, whether seen or not ? My annulment also states that the original bankruptcy petition, is dismissed. I will be SAR'ing Experian, aswell as trying to get this REMOVED from my file, but i don't want to waste even 2 weeks in waffle letters ! I will reread the DPA, especially S.12, thanks car, and if its ok will post a draft for perusal
  2. Thanks Patrick, but i was thinking along the lines of an S.10, as can be found in the templates folder. That relates to defaults registered against bank charges, but think that as the information is no longer in the public domain, they shouldn't be allowed to process it, its defamation of character and has seriously affected my credit rating, just not sure how it should be worded vselym

  4. Hi all Have been reading this site for about 1 months, and was on the verge of getting started when up popped the CSA, and put me back months ! (Another story !) My initial problem is that before seeing the warnings about signing up to "CreditExpert" (Anyone upto speed on Trade Descriptions Act ?), i,d done it. Ali Thanks for the clarification, my SAR didnt include a time period, just stated 'banking history', so seeing as we both got identical letters it would prove once again, as if we needed any, of yet another automated process from the banks, they just wont learn !   6. Ali many thanks for your last post, im not attempting to hijack this thread, but did your letter make reference to the fact they would only supply 6 years worth of statements ? The fact that they have refused to include any details of possible manual intervention will only weaken their case if they later use it as a means of defence, my main concern is that they seem to have arbitarily decided on 6 years, as i cant find any reference in the DPA to substantiate this. They may of course be confusing this with the limitations act, but this pre 2000 info is critical in another case im prepari

  8. Hi FatLad I was bankrupted in my abscence aswell, not because i didnt attend knowingly, but because every paper was served on my old legally wound up ltd business address ! My trustees, god bless em, made £3500-00 into £10500-00, now thats magic. I am seriously going after them once ive got some money back from various institutions we lovingly call banks. My concern was the limitations act, but im going to have to go back past the six years, as the dear old prancing horse started the whole problem back in '97 !   9. Hi all have been reading for four days now, but need some fairly urgent help on two points that i cant see answers to. First problem is a friend was visited by Sheriff's Officers last week (we live in Scotland) over unpaid council tax for FY 04/05. She was asked a couple of questions, was she working, was she on benefit and asked to sign his 'sheet' then left with a compliment slip saying call the office re payment. He was polite, never asked to enter the house, she met him in the drive, and no figures were discussed. So 1st question is could she have innocently signed a WP ? and if not

  11. Having read as much as i can, i'm just about to start proceedings against Clydesdale Bank. Whilst i understand the procedeure, my initial contact requesting an S.A.R - (Subject Access Request) will be from a different address than the bank hold on file. Does anyone have any suggestions as to how to confirm my identity in the initial letter to avoid any delaying tactics by CB, as my understanding is the 40 days only commences once they are 'happy' that they have confirmed my identity. Would my old address, old telephone number and date of birth be sufficient ? Any musings gratefully rea
