I have: 1.) a recent invoice form them with that address 2.) in the N244 bundle they submitted a letter with that address on as evidence dated 4 months after they claimed it was not received 3.) An email from them stating a change of address 3 months after 4.) possibly some other bits and pieces along the same lines
  11. I have just checked the N244 guidance notes and it appears you should not apply for it without a hearing unless the other parties agree?
  12. Hi Everyone, I am after a quick bit of help. I won a CCJ against a company that owes me money for unpaid invoices. I won the case in default because they did not respond. I have found out they are applying to have it set aside on the grounds they did not receive the forms which is a blatant lie. I am a bit confused because they have selected the "without a hearing" option. Obviously I want to object to this at a hearing because I have evidence they did receive the forms. I worry that their application will be granted without chance for me to dispute it. Is there anything I can do? can I send some information/forms to the court? Many thanks!

Yes im guessing when you sign up to see your credit file its in burried the T+C's Just a warning to people really, If you are trying to lay low from an old debt don't check your file online as they will come all out the wood work, probably best to check the manual way, by post. I am now 99% sure checking my file online brought heat back on me!

  17. I would like to share a worrying development with you. I have just received an email from a DCA with accurate info concerning a debt, so it is legit. I have never ever given this DCA this email address and the original creditor did not have it either, infact I never put it on forms etc! This is the address I use for Creditexpert so I can only assume they have passed it on!!!!! It even has a credit expert advert at the bottom of the email: Managing your credit report is very important, visit http://www.creditexpert.co.uk now and get unlimited access to your Experian credit report with a 30-day free trial. See what lenders see about you. Look for potential inaccuracies and unauthorised activity preventing ID Fraud. Get ID fraud alerts via SMS or e-mail. Know when your credit report changes. Improve your credit rating and get credit report advice. Higher scores usually mean lower interest rates on new credit applications, which could save you money. Watch out when requesting your file people!

  19. I disagree, I have never used one of those sites, I think companies like Aqua buy a list from Experian/others of people who A) dont have a good credit rating and B) have checked their file within the last X number of days. It is not far fetched to believe that.
  20. I am in no doubt this goes on. About 2 years ago I checked my file, up to this point I had heard little from creditors for about 3-4 years. Within a month of checking my file I had 4 or 5 of them crawl out of the woodwork and start sending me letters, one even launched a CCJ. I also started to get letters from bad credit type cards Aqua etc and I remember reading in one of the letters something along the lines "We notice you are trying to improve your credit rating" Also I recently moved house, I updated my address via my bank. I have had no letters for about a year and today I notice DCA's have started searching my file again. So I am expecting another round of letters! I firmly believe some sort flag or data is stored on your profile that says when it was last checked/updated and creditors are given access to this because if you are checking your file you usually want to clean it up and possibly pay bills. It also shows that the information is valid and up to date so you are an easier target. My advice is if you dont need to check your file and you have old debts dont, just lay low!!
  21. Thanks CitizenB No I didnt ever make the request, I thought I would wait and see if the fought the N244 before I did that, I think asking for that might possibly kick them in to restarting the claim, what do you think? I have waited this long a few more days wont hurt
  22. Hi All, Its been a while and I have still not heard anything and this is still hanging over me, I am going to file a N244 to get this thrown out. Can I just confirm this is the correct way to fill the form in and my arguments are valid: N244 Form 2. defendant 3. An order that this claim be struck out under CPR 3.4 (2a, 2b) as the Particulars of Claim have not been sufficiently particularised to enable the defendant to understand what charges he has to answer & the Claimant has not responded to requests made by the Defendant that they submit an amended Particulars of Claim nor have they responded to the Defendant's multiple requests made under CPR31.14. The Claimant contends that the Claimant's claim so issued is a claim in contract and is statute barred pursuant to the provisions of section 5 of the Limitation Act 1980. If, which is denied, the Claimant contends that the Defendant is in breach of the alleged contract, in excess of 6 years have elapsed since the date on which any cause of action for breach accrued for the benefit of the Claimant. 4. Yes 5. Without a hearing 6/7/ Left Blank 8. District Judge 9 HL Legal 10 blank 11 Sign etc Draft Order 1. This claim is struck out under CPR 3.4(2) by order of the court 2. The Claimant shall pay the Defendant his costs of this case to be assessed on the standard basis and pursuant to the provisions of The Litigants in Person (Costs and Expenses) Act 1975.
  23. Ignoring this now but just received a nice letter from Meritforce, giving me a whole 3 days to pay LOL! Thats nice of them!
  24. Its also worth noting they have still not provided me with a copy of the credit agreement in my last CPR request, I have a copy but I got that from cap 1 myself.
