Hello all, I have been in an extended letter writing campaign with capital one re:CCA. I have recently received a bogoff letter claiming amongst other things that provision of the current terms and conditions complies with section 78 of the CCA 1974 and that the agreement is properly executed. (see scan below) Obviously, what i have been sent is an application form which is very much precontractual. Can anyone advice as to the best course of action PLEASE!!

I guess the information commissioner is the next move. You need to contact that office to report the non compliance. They could be toying with their licence Trying PMing one of the mods for more info -
WHAT A MAN YOU ARE, WELL DONE!!!!! Such guts and such spineless defense. Wishing you the very best and let us hope the judge ses the banks concealment strategies for what they are. Did they thus tell the court what the scale of their charges are or will they be sending that in to the court?

Very well spoken Rich 44. If gbzstro had been that hip on his own accounting, he wont be on this forum to dish judgement. I strongly believe we all here are a collective help not a judge and jury panel. i will strongly advice Nickyandmidgets to contact her local council or CAB for advice IMMEDIATELY or better still PM one of the mods- Bankfodder or Martin himself and seek expert opinion. iam sure you will receive a sympathetic ear and high quality advice.

yes i believe so. late payment charges is part of what this site is dedicated to claiming back for you. I do not believe that you are able to wriggle out of the 3 or 4 year finance agreement you signed up to but you should be able to reclaim any late penalty charge. Byall means go for it.

Hello Folks, I banked with lloyds between 1997 & 2000. I have just discovered i can claim back my unfair charges which i believe will come to £+000.00 without interests. Can i claim for that period considering i have just recently realised that i could have claimed all these years/ Thanks for any advice
