  1. The old search engine was very limited because it could search postings for only one keyword, and I believe only for keywords of length 5 characters or longer. Any productivity improvement is of course welcomed. Change came like revolution not evolution, cutting off heads. Without one word announcing the new release, old familiar buttons and drilldowns disappeared or relocated with no forwarding address. By all means lets receive the new girl with an open mind, but lets not bury the old girl of 5 years without a word. The colours have gone wishy-washy pastel. The blonde has become a brunette.

If Egg will not play ball re extortionate interest rate rises at a time of virtually 0% interest rate from the Bank of England, then they can face their regulators, and they should be left in no doubt you know chapter and verse.   4. It is still possible to nominate a userid in the search. But it is no longer possible to nominate a userid as having STARTED a thread, distinct from contributing to the thread. I could find a limited number of threads started by BANKFODDER with or without keyword match. I could not possibly wade through all the postings made by BANKFODDER. (found it now, the old option hiding in drilldown after an additional click not so described. Perhaps a legend of "old search format" might be more informative?)   6. What claims are being made? What part do Egg lawyers say they are going to defend? This is your case to proceed as you choose and as you are able, if proceed you wish. Why on earth would Egg lawyers back down, from what they can already sense?
  7. Decision to order full disclosure is up to the judge. If that happens I believe the thousand-pound-per-day Egg barrister will instantly offer full refund, and the claimant must accept, end of case fullstop. Egg will have no appetite for this expensive score-draw outcome, but may be tempted to try if the other side looks irresolute. Small Claims Court is constituted to redistribute money up to £5K, not to fight out legal principles and establish precedents after an offer of full refund, that is for higher courts.
  8. Your situation is better than the other guy. Egg would be encouraged by the FOS decision there to dig in and refuse refund. The judiciary court is not bound by the decision made by FOS the executive branch, but a pound to a penny Egg will try to milk it in court. This situation will not arise in your case, but even here Egg might try to milk a cow not in court. A decision by the court overriding FOS's explicit decision could be interpreted as a slap in FOS's face, and a Small Claims Court judge (often a senior barrister) may shy away from that. In such a court fight the claimant will need to be very articulate indeed.

They used to be far more obliging in 2007/2008, but since then they have fallen on hard times and now play hard ball more. They are calling your bluff, but you could also call their bluff. The N1 will not cost much, and on the eve of a court hearing Egg have to decide whether they want to risk facing the Small Claims judge and a claimant who very reasonably makes an embarassing demand for disclosure of Egg actual accounts after the event instead of "genuine pre-estimates" presented to the OFT as justification for £16 penalty charge. It is up to you to run your own case as you choose, weighing pros against cons. You may have no appetite for attending court, but Egg will have even less. For this reason a convincing display of resolution for battle may end up with no battle.
  11. Discounted payment as full and final settlement invariably come with a gagging clause, so not many cardholders have posted whether this hairsplitting text is standard Egg spiel. If they insist this is payment in part and not in full and will register part and not full on CRA, that's fair enough. The fatal clause is "accepted as a partial settlement". In court it could be put that any layman will have understood partial settlement is not full settlement -- instalment payment? interim payment? Satisfaction today but not necessarily tomorrow, or next year if a new owner buys Egg. As you say, if Egg writes a letter to say that in public this is technically partial payment (I would prefer "discounted payment"), but in private they the thoroughly good eggs will declare unambiguously in writing that they accept this as full and final settlement for all time. Both sides undertake to accept this and make no further claims on ANY other aspect. And they the thoroughly good eggs require you not to broadcast this concession and encourage other debtors to haggle. So if you cannot come back with info, then posting just a smiley will be understood.
  12. The problem arises over the alarming wording of partial settlement. If this is one part then by definition there can be another part to come later on. In court this could be successfully argued as such. As letsdothis said, I believe Egg's anxious preoccupation is to say that this one settlement shall finalise for all time any present and future disputes including PPI, CCA enforceability, penalty charges, interest etc. They would not like to give away the words Full and Final Settlement over one dispute without guaranteed immunity from all possible future disputes. Perhaps you could suggest to them the alternative wording such as "This discounted payment is accepted as full and final settlement of ALL financial claims which may arise between rennuz and Egg, at present and in the future, from either party."
  13. Fallen on hard times, Citigroup are trying to sell Egg. For a card with 2 million cardholders an astonishingly low value of £250 million asking price has been mentioned in print. Until a test case rules otherwise in court, the presumption would be that all balances remain legally due on 161,00 accounts with agreements quoted in Eggspeak as "ended" in January 2008. Currently disputed debts on 8% of Egg cards would otherefore continue to be listed in Egg's balance sheet book value. It may be that Citigroup's highest priority is to flog Egg at the present book value and not to jeopardise a shock court verdict before completing the sale. Legal showdown could come when a new owner is in the saddle.

  17. Helen, 2 separate responses: (1) To invalidate Egg's latest demand on the grounds of 6-year Statute of Limitations. To succeed in this you would need to trawl for precedents and advice, best to open a separate thread in Legal-Issues forum. Even if you win on this there remains a small risk that Egg will not go to court to claim the debt, but still pester you through DCAs and blacken your credit rating. A few months ago a Mercantile Court judge ruled that this practice would be ok. The OFT frowns on this, but whether they would do more than frown is questionable. (2) If the circumstances of your PPI enrolment turn out to be such that it fits regulatory definition of mis-selling, then not only will your outstanding unpaid PPI premiums balance be wiped to zero, but your PPI premiums paid up till 2003 will now be refunded to you in full as a lump sum plus 8% p.a. interest. This would be the cleaner end -- if yours fits PPI mis-selling criteria.
  18. Helen, Firstly congratulations on your honouring a debt without fail over 7 years even after your circircumstances went sour. For Egg to make a huge cock-up then seven years and full repayment later to hound you with a surprise demand really raises eyebrows. The 6-year statute of limitations I believe starts running from the date of your last payment. In your case you were paying as recently as this year, but you were paying against the amount demanded in 2003, not the amount they have just discovered. Egg are now demanding a debt which they never asked for 7 years ago, so 6 years have elapsed since the time repayment was due, and you never paid against the PPI balance because it was never asked. This is a legal fine point, you would be better off browsing in forum/legal-issues. Or click the blue SEARCH on the top blue bar, click ADVANCED SEARCH, search keyword LIMITATIONS in thread titles. The regulators have heavily swung against EGG on the issue of PPI refunds. In a borderline situation they now give cardholders the benefit of the doubt and rule against Egg, sometimes levying a fine on top of ordering full refund of premiums already paid, plus statutory interest 8% per annum. If you research the origins of your PPI "enrolment". If there is no proof you willingly enrolled, and there is no chance of you claiming against PPI, then more than likely the regulators will take your side.   20. Irish Republic banks have raised their penalty charges slightly, I think around ten or twelve euros, nothing like the £39 a time that NatWest and Abbey used to charge. UK banks despite finally winning in the Supreme Court against the OFT, have I believe also reduced their charges somewhat, particularly Barclays. However Lloyds remain fierce on this front. If anybody has the spread of latest figures it would be interesting to see. In the old days if you went accidentally 10p overdrawn you could be hit with a total of £400 charges within one month, so for those in dire straits there was no way out of this. Irish banks are unrelated to Egg, just to make the point that £30 penalty charges in the UK never were an inescapable law of nature. If you google AIB or ACCbank you should see their scale of charges published online.
  21. No harm to make as if you intend to see them in court, showing Egg all legal papers correctly filed. Egg lawyers will make as if they will meet you in court. Chances are they will quietly back down at the last minute and pay, because over 4 years they have shown no appetite for a showdown whose outcome would affect the entire credit card industry. Equally the court verdict in your case if adverse will do no favours for others still waiting to reclaim.
  22. Sticky: V-E Day: Victory over Egg 5) The thread above has been pinned by CAG management at the top of Egg Forum for 2 years for the benefit of all who wish to help themselves. See 30 April 2007 template letter by Mock1982. Egg DID go to Small Claims Court in November 2006 (listed as the first of 122 claimant wins). The judge's ruling on a fair charge was £5. Evidently Egg had no appetite to further publicize this precedent, and never again defended penalty charge refund claims in court, defending against other claims yes. It does not help that you got the Financial Ombudsman Service to rule against you, then got a second "Ombudsman (?)" to rule against you. Egg might therefore be encouraged to contest in court and quote the above two in support. Any adverse ruling against you in court would of course strengthen Egg and weaken future claimants.
  23. 1) If Egg file a defence, will they refer to the ombudsmans decision of support for them? The ombudsman is the executive branch, the court is the judiciary branch independent of the executive, answerable to their own interpretation of the statute books and precedents established in higher courts of which there are none in this case. If the courts were bound by executive decisions then there would have been no point in the OFT mounting a multimillionpound lawsuit on bank charges all the way up to the Supreme court. 2) Again, if a defence is filed will they refer to their claim of satisfying the OFT? The OFT for pragmatic reasons decided not to tackle cards levying £12, £16 for Egg. The OFT were at pains to point out repeatedly they did not declare £16 was a fair price, just that they would not intervene at the £16 level - in April 2006. The OFT based their decision on Egg's "genuine pre-estimates". Your case is to bring these pre-estimates into ajudication by open court, with figures then becoming available for nationwide publication. 3) How likely is it that the claim will be allocated to another track an raise the possibility that if Egg win, they can reclaim their costs from me? If your claim is below £5,000 there is no reason to switch from Small Claims to higher courts. You could also abandon your claim if a reallocation were ordered by the judge. Small Claims Court is about redistribution of money, the High Court is about legal principles. Unless you want a definitive fight about principle there is no reason for either party to go there. Legal eagles can confirm, I believe there is no appeal allowed on the verdict of Small Claims Court. You may like to consider Egg has more to lose than you.

    Demands!

    Before debt management intermediaries (both profit-making and non-profit outfits) secure any global agreement with creditors they also come clean with a full listing all debts to all creditors. This is to assure creditors that the ones shouting less are not paid less than the ones shouting more, and that all possible blood is squeezed out of a stone. Egg have no right to demand full disclosure or even an I&E list, but in the absence of what they regard as adequate disclosure they have no obligation to suspend legal escalation. Without question it is not nice to have personal finances probed.
