  1. teaboy2 is right. As defendant and a litigant in person, you have the right to request that the case is transferred to a court of your choice, usually the one nearest to your home. You don't have to do this yet. Els
  2. You don't need to contest jurisdiction. From MCOL website: Filing of an acknowledgement of service might also be used to tell the court that the defendant intends to contest the court's jurisdiction. This means that the defendant believes that the court does not have legal authority to hear the claim that has been made against him. Jurisdiction in this context does not refer to geographical location, for example - if the defendant lives in London and the claim was issued through Northampton, this cannot be considered as grounds to contest the court's jurisdiction.   5. Presumably her lawyer suggested 2 days in her allocation questionnaire. That will have been to deter you. How much time did the judge allocate? But I hear what you say, although I don't see the cost to you if you win. The alternative is to do as bazaar suggests - nothing. Els
  6. If you are truly confident of your position, why not apply to the court for the stay to be lifted and for the case to continue to trial. You can state in the application that the stay was at the request of the claimant and that all attempts to negotiate a settlement have failed. This should concentrate the mind of your antagonist. She will have to come up with some very good reasons for prolonging the stay (especially as she is the claimant!) to convince a judge not to allow your application. If she cannot, then you will have your day in court or she will pull the claim. Els
  7. Hi DD, Presumably there was a hearing scheduled for last November but you agreed to’adjourn’ to negotiate. Did the court order a stay as a result of a request for an ‘adjournment’? If so, was it indefinite or time specific? Els
  8. Hi DD. Were you formally appointed as a director of the company and does (did) your name appear in the register of directors? If so, then Companies Act 2006, Part 10, Chapter 1 comes into play.   9. Really? It didn't say that in my T&Cs. Nor in the charges leaflet (not that I received one at the time). Moreover there was no mention of any potential charge should the bank decide to return an item unpaid. In fact, there was no mention of returning items at all! And I rejected the notion that such actions would have been covered by an implied term, because it was far too fundamental to have been so. Els
