  1. I'm currently in the process of claiming against halifax, my MCOL will be issued in the next week or so, as soon as I have the funds. I'm claiming for 2 bank accounts and 1 credit card, but keeping it as 2 claims (1 claim for the 2 bank accounts and 1 claim for the visa card). I'm not claiming the interest that they took from me for being overdrawn, I'm only claiming the charges plus [email protected]% APR. They've offered me 50% of the charges back for each of my 2 bank accounts. I called up to reject this (they'd already credited it to my account without my knowledge). I was asked "have you spoken to anyone who tried to negotiate with you". When I replied "No", I was then asked "Has noone even offered you the full amount" I said they'd not and that I wouldn't accept it anyway as I beleive I am just in claiming interest at Hfx's unauthorised overdraft rate (around 28.8% If i recall correctly). Does anyone have any advice for me in light of this alleged High Court Precedent? Should I still file my claim, including CI, as I've not had a formal written offer of the full amount of charges, it was merely mentioned "in passing" in a telephone convo. I've had an offer for £220.00 for my Visa card charges, as full and final settlement. I can only see that they've charged me £182.00 but Hfx maintain that they owe me £220 in charges. I don't understand it. So, should I accept this offer (which came waaaay outside the deadline I set them) or file my claim including CI?

  3. How long has the person worked for the bank? If less than 12 months, there's not really anything they can do, unless they are a woman/disabled/a member of an "ethnic minority" then they could try and twist the "unfair" dismissal into a "sex/disablility/race discrimination" case. And no, I don't condone this behaviour, in fact it makes my blood boil when certain groups of society play on their situation, but the bank shouldn't be behaving like this either. Unless of course, the person was using the bank's computer systems to access CAG, in which case, I'd advise them to start looking for another job PDQ.
  4. Noticed yesterday that the £581 wasn't in my account anymore. It'd not been just debited from my account, the transaction had totally disappeared. Luckily I pre-empted this and took a screenshot of my online statement with it showing! Spoke to my contact there yesterday and she said it'd been taken out as I was only accepting it as part settlement.

  6. Oh yea, regarding the credit made to my accout earlier, I've made them aware that this is strictly as partial settlement (I've not signed anything anyway to say I accept it as full and final) and my claim is going in as we speak.
  7. called visa dept who are offering £220.00 which they say is the amount they've taken in charges, against my £182 figure that they've taken. Explained I'd accept in partial settlement and gave them a deadline of 3pm today to either reject this proposal, credit my visa with £220.00 as partial settlement or credit it with £375.94 which represents £182 they've taken in charges plus interest at 28.8%APR compound of £193.44.
  8. Just called them the amounts are from them: £140.00 and £441.00 totalling £581.00 They allegedly sent me a letter on 30th May telling me that they were crediting this amount to my account. I'm awaiting a call back from the charges department, chap called Jonathon Foulkes who was apparently the guy who put the money in there. I'm going to tell him that I will accept £375.94 of this amount as full settlement of my Visa claim, and then I'll have to talk to him about the rest!

Just got back from my holiday, and found that there's an entry on my online banking statement for my bank account "30 May 2007 Cash 581.00" Now I've no idea where this is from, but suspect it is Halifax using sly tactics. I'm going to ring them in a bit. I'm also preparing my MCOL to submit, probably today
  10. Of course you should send the LBA. You set the deadlines, not them! STICK TO YOUR DEADLINES!!!
  11. Wife?! You really should let your bank know of your change of address asap. Different banks have different rules. Some will do it over the phone, some will require you to write in to them, some will even try insisting that you go to a branch to do it. Call up/pop into a branch and ask, that's the best advice.
  12. A bit risky IMHO. Strictly speaking, I'd not advise changing what you're wanting part way through a claim. I guess if you're been aksing for 8% in your prelim and LBA then you'd have nothing much to lose by adding contractual to your claim. Though if it was me, I'd do the same throughout (i.e claim no interest in prelim/LBA, then ask for 8% when filing at court, OR 8% in Prelim, LBA, and at court, OR contractual in prelim, LBA and either contractual or 8% at court). It's your call.
  13. Thanks Sally, though up until court I know what I'm doing as I'm very experienced in all this (I'm an ex-mod of this site!). I don't believe the court will forwn upon me not accepting their offer. I'm not in a great rush for the case (though I'd like it in the next month or two!) so I have no reason to accept really.
  14. Yes, I asked for it in the prelim and the lba's. This is how you should do it, you can't really change things when it comes to the court stage. It's up to you how to proceed, whether to go ahead and file your claim with s69 8% interest or send the prelims and lba's again with contractual interest added. Either way, if you've not done so already, start a thread on here and keep it as your diary. Best of luck!

  16. Exactly, justification is needed. I'm stood at a bus stop, if a copper tells me to "move on" I'd ask him why, if he could give no reason, or no valid reason then I'd be staying put. If he decided to lift me for it then so be it. That'd be his problem not mine.

  19. So, noone can take photos anywhere anymore then? Taking photos is a Public Order offence? rofl! What tripe! They can insist can they? What legistlation are you reading this from? I'd be interested in seeing it, if you can produce it... It is long held that taking photographs in public places is not illegal, I was looking at a whole website set up about this issue a while ago, but I forget the name and url of it right now. It is also legal to take photographs on private property that is usually open to the public (prime example being a supermarket), although I'm not quite 100% sure on the 2nd point.
