  5. hello to all, latest update. here is a court letter i received today. The DISTRICT JUDGE has considered the statements of case and allocation questionnaires filed and allocated the claim to the small claims track. — The claim shall be listed for a preliminary hearing on the 19 January 2007 at 10:45am with an estimated length of hearing of 5 minutes at which time the judge will consider how the claim should be conducted. The preliminary hearing is required because the court wishes to assess and limit the amount of disclosure that may be required to determine the issues. The preliminary hearing shall be before the District Judge The parties should not bring witnesses to the preliminary hearing. If the claimant fails to attend the preliminary hearing without proper explanation the court may strike out the claim. If the defendant fails to attend the preliminary hearing without proper explanation the defence may be struck out and judgment entered in favour of the claimant. Because this order has been made by the court without considering representations from the parties, the parties have the right to apply to have the order set aside, varied or stayed. A party wishing to make an application must send or deliver the application to the court (together with any appropriate fee) to arrive within seven days of service of this order.

  12. evening to all, I'm just about to reprint ( errors!!) all my 3 copies of this form, but could someone clarify first as to what "address" they put at the bottom of the form where it asks for "defendents name and address." Also, at the top right hand side of the form, "In The " ................ do i fill in the name of my local county court, or leave blank for them to do? my claim for £1350.00 Lloyds tsb will keep you all updated cheers s williams
  13. hi lorfatz, you should go through the small claims court, what you received back was a standard letter. Do not let them put you off, carry on with your claim, as scary as it seems, others have followed this route and won. good luck s williams
  14. hi there, here is a link to the templates library http://www.consumeractiongroup.co.uk/forum/bank-templates-library/ when you post a new question, you will need to be in the correct forum ie:- this is the Lloyds tsb forum. there is a "button to click on called new thread" at the top of each page, use this to post your questions, then it will be read by all the forum and you will have more chance of help. hope this helps s williams
