  3. Just to recap, as it has been a few days. Letter sent as suggested in post above, no response (so far) Time is up on Tuesday and MCOL claim will be made, I will use the short summary as suggested by BF a few posts above. I will tick the box to say more detailed Particulars of claim will be sent within 7 days. I will upload a draft of those more detailed Particulars later

I will e-mail them now to get a written response and cost for my specific report

  8. Ok, I will take what you have suggested as the MCOL initial particulars, and then put some meat on the bone with the additional particulars to send to her direct. I will use what I have posted earlier as the starting point for that and fill it out as suggested and then re-post later in the week for re-checking. On the date of the accident there were quite a few policemen and police cars on site, including ambulance and highway maintenance cars and employees. To get the name and details of the specific policeman who was behind us in the accident I would need to request a copy of the police accident report I think. There is a link on the Police Website specifically for solicitors and insurance companies to request this, but not for private individuals like me. When I called the police they said it would cost me £350 to get a copy of the accident report from them, does that sound right ? I need to keep an open mind, if there is a hearing I may need to have this as evidence I suppose
  9. She hasn't communicated at all with me, all I got from her was the letter I uploaded on Saturday. All she says is she has passed all the info to her insurers and I should talk to them. I was thinking of putting details in there on how the accident happened , but I now feel that will be too long as well.
  10. Ok, Tuesday week. It's the 4th of Feb as stated. Letter of claim was dated and posted 20th of Jan, delivered 21st of Jan. The two weeks are up on the 4th of Feb
  11. Thanks for the fast response. I will post the letter tomorrow. Day 15 is next Tuesday, i.e. 4th of February (I posted the letter of claim on the 20th of January which is the date on the letter, and it was delivered on Tuesday, 21st of Jan) Yes, I have registered with MCOL and had a look around on the site, as I have never used it before. (I took Easy Jet to court once before, but at the time you still had to do everything at your local court. This online filing is new to me.)

  15. My car is gone now, total bill from recovery yard was £850 , I got a receipt and detailed invoice from them. I will start doing the letter of claim and will post it here a little later, if someone could take a look and let me know if I should change anything I would appreciate it
  16. When dealing with companies I tend to do everything in writing. As a matter of course I do not entertain telephone calls and I don't tend to call companies back either. When I have an issue I deal in writing only, so never really had a reason to set up the facility to record calls. I find keeping a paper / letter trail simpler.
  17. The calls to the Recovery Yard about my car ? No, I don't have the facility to do so. I could maybe ask them to make a note on the invoice that nobody contacted them from Direct Line about the car until the said date ?

I have spoken to the Recovery Company again today and still nobody has contacted them about my car (apart from me), so I have sold the salvage today to a local scrap yard for £40, they will collect tomorrow from the Recovery Yard and dismantle for spares and scrap the rest. (I had an offer of £104 from a different company but they would not have been able to collect until the end of the month, so it would have cost me far more in additional storage than what I would have gained in extra money.) I will get the final bill from the recovery yard tomorrow once the car has been collected, I was told it was now over £800 in charges, which I will have to put on my credit card. Tomorrow evening or over the week end I will work out the final figure, draft a letter of claim and post on here for a quick check and some feedback. I intend to post the letter of claim early next week.
  19. No, it's OK. I won't bluff. I represented myself as a LIP through my divorce and that went to a final hearing and took almost two years to get it through the court process.. Saved myself around £30,000 in legal costs by representing myself, so I am not worried about legal paperwork or court proceedings. I will upload a neutralized Letter of Claim once I have compiled all my costs and added it all up
  20. yes, I thought it was the same for all money claims. I think I better post my letter of claim here before posting it, so someone can proof read it for me (I'll blank out all personal details)
  21. Yeah, but if I issue a letter of claim, then that will not go to an insurance company but to a private individual. And if that proceeds to court it sounded like the creditor should allow reasonable amount of time for the debtor to respond to the letter of claim and 30 days were suggested. (That's were I got that 30 days from.) But I have changed it to 14 days now anyway. I have written the letters and will post them anyway, won't harm , at least I can say I wrote four letters. They can't then say they didn't get enough warning or didn't know etc. They will have these letters on Wednesday when the deadline from my letter last week expired. I will have all the costs when the old car is gone, which should be by the end of the week. I can then compile the letter of claim and send that off. So I should then have all my 'ducks in a row'
  22. P.S. this isn't the letter of claim I am writing yet, it is just another warning letter that the next letter they will get is the Letter of Claim
  23. I just read some templates about a letter of claim / pre action protocol and in one of them it said the creditor has to allow a reasonable amount of time for the debtor to respond. The template suggested 30 days, I just took it from there , thinking it was expected to give at least 30 days. But I can change it to 14 , I haven't printed the letter yet
