  1. What address do I use for issuing Claims. Do I use the registered office address in Reading or do I use the Salford address?
  2. The bank has settled out of Court for the full amount, but they have not removed the default, What now?
  3. Let me rephrase the question, I can't understand it so dont think anyone else can. We have sent: Prelim letter asking for charges back and removal of deafult notice. LBA asking for charges back and removal of default notice. Deadline has now passed. Just looking at Particulars of Claim and there is nothing in it to say about the removal of the default notice. I note there is a Notice pursuant to s.10 of The Data Protection Act 1998. But we dont know what that is for. I'd like to issue this claim tomorrow (20/4) if possible. Can anyone give some answers tonight?
  4. We are just about to start a claim to CC for charges. The wife had a default recorded against her. This was because of the charges. Just realised that there is nothing in the POC that covers the removal of the default from file. What text do we use and where do we put it? Please reply soonest.
  5. So can I still claim the Unpaid Direct Debit charges, even though I will have to pay their Legal fees if it goes to court. What letter do I use and what spreadsheet.
  6. I am claiming against Southern Pacific Personal Loans. I borrowed a total of £12,100 this included a broker admin fee of £1,100. I do mean £577. So can I claim anything then even though I must pay their legal costs. If so, am I ok using the credit card spreadsheet or is there another spreadsheet for mortgages. Please provide link to letters to use.
  7. I have now received my statement. I have been charged a total of £50 for unpaid Direct Debit. I redeemed by mortgage within 2 years of completion. The contract states that they will charge me 5% of the outstanding balance on which interest is charged as at the date on which I repay the loan. I have been charged an early repayment charge of £577.62. I have also been charged a repayment charge of £100.00. This I assume is in the contract which states that if I make a repayment of more than £1000.00 then they will charge me 5% of the repayment amount. The contract does state

  10. The mortgage I had, I paid off early. In the statements, I accrued: Unpaid Direct Debit Fees Early Repayment & Deeds Release Charge Early Repayment Charge I've read lots on this part of the financial world, but can someone tell me what can I actually claim back?
  11. Received the AQ from the Defence. They say that they want to put a stay on proceedings for 6 weeks so they can negotiate settlement with me. Cool
  12. Still no letter from the solicitors. Recieved an order today now saying that they must file a AQ by the 14th March otherwise the claim will be struck out and I can request Judgement.

  14. Just recently issued claim for credit card charges and interest for the measly amount of £84.78 plus interest £15.01. They have Acknowledged service and have noted that they wish to defend all the claim. I know I have to wait 28 days from date of service, (14/2/07) before I Request Judgement. Anyone got any tips, if they do file their defence within the time limit.
