  1. To the OP. Get a formal complaint in with LS as soon as possible. Make sure you mark it 'Formal Complaint'. Then if no luck after the 8 weeks is up then make a complaint to the FOS. From my experience if they ignore the complaint then they will just carry in that way eventually assigning it to a DCA.
  2. Sorry for derailing the thread. We didn't push it any further. The complaint itself was not a major one. It was just the conduct of MH whilst a complaint was in process that really got to me lol.

  6. I know. Was just showing 'willing' to see whether they would listen or not. As for the FOS are they much better. My last complaint to them pretty much told me that DCA can harass you despite being in contact with them and can pretty much make things up as they go along.
  7. They are a pain. I'm waiting to hear from them from sometime last year to answer my formal complaint after ignoring 2 previous emails for a repayment plan. I've even contacted their trade association who they are more or less ignoring too.
  8. Could this be the same thing that myself and another user are facing? Basically the agreement is that when the loan is due to be paid they take the interest and loan out in 2 seperate transactions. However, they have been taking just the interest and automatically rolling it over, despite what their agreement says.
  9. She kept on top of the statements, there's nothing questionable about the amount owed. The rest I will check, especially the paperwork as the person who was in charge of her wasn't exactly a stranger to cutting corners.
  10. Sorry for the delay,this debt is actually my sister in laws so had to wait. it's an Ann Summers debt as she was a party planner(?). She used the little she was making by putting it back into ordering things to top up her things that she already had. Things were going well so she could keep on top of it but then it got a little slow and it all caught up with her. Now she doesn't work for them anymore.
  11. Would it be at all possible I have a look at he letter you sent. I know what to ask for but don't know what to put in the 'or else' section, if anything.
  12. Yeah - I just read through the T&C you posted. They are quite clear on what should happen and when.
  13. This is similar to our situation. I need to do some detailed looking into it but from what my wife can remember the roll over is taken automatically on the day the balance is due.
  14. If automatic rollovers are against the rules then why do CG seem to use them as a matter of factly? Also, if they are against the rules the surely there must be some process to get he money back as they should not have taken the money in the first place? A bit like theft really. I'm not saying it isn't against the rules just wording it that way for the question btw
  15. I know. But they wouldn't. I had a long conversation with the woman at Santander who, interestingly, not once denied that I had the right to cancel but stated that they wouldn't.
  16. Having the exact same problem with them. I have a thread here somewhere about it. I tried to cancel the CPA but the bank said that they couldn't so ended up cancelling the card. I did get the last payment back from the bank though. As for Cash Genie I sent them a complaint about 10 weeks ago and have just sent a reminder to them.
  17. Funny you should say that. Just a few minutes ago I opened yet another letter from BCW claiming they can't agree to my offer without it filling in. I'm ok with that
  18. They can also reject it if they regard it as excessive. I sent one to a DCA who claimed I should be spending x amount on groceries. Yet wherever I looked online the amount given were far higher than they claimed. In fact, what they claimed a family of five should be spending was less than what was given in the CAB website for just our 3 children!
  19. Just a quick question regarding what a DCA can and cannot add to a debt. We received a letter today as a debt has been passed onto STA International. As well as the original debt there is an extra £63.83 for 'Collection Costs'. This seems a little ott just to send a letter. Are there any guidelines as to what they can add to the debt? Thanks Lee.
  20. It is a shame. I know I don't visit all the forums and with my experience I have little to offer in way of advice but the signing only took a minute and was my contribution back to CAG and all the people that have helped me.
  21. Just signed it however I'm surprised at there being so few who have. I had to recheck the OP date as I assumed it was posted this year but it was last year.
  22. Just after some advice. We have an outstanding bill to YW on a former address. We were initially contacted by Rockford who wanted £50 paying monthly but we told them we can only afford £5. They agreed to this but kept sending letters to us claiming that a repayment plan had not been set up. We have paid this for a few months now. Last month we were contacted by LCS and I replied telling them how we have been paying an agreed sum of £5 to Rockford and that we will continue with this and to provide their banking details for a standing order. In response to this I have received a letter asking me to call them to discuss this. It also says in regards to the call: 'There are a number of reasons for this and may be a simple clarity of details held pertaining to you'. Obviously there are not problems with any of the details they hold. They have my address and that's all they need so this is obviously just to get me to call. My question really relates to the repayment plan I had with Rockford. They weren't at all happy with the set up so this looks to me as though it's been passed on in the hope that LCS can get more money out of us, but good luck to them. So basically is there anything that says LCS should continue with my prior arrangement set up with Rockford? Thanks Lee.
  23. Thanks Jimmy. I've seen this recommended quite often. However, the company will still believe that they are owed something wouldn't they? I mean, if we paid £10 per month they will still add £25.50 plus late charges so in their minds it's still owed. They would still go after us as they do now. This is still probably the best in my mind because they add loads to the amount simply for agreeing to a repayment plan usually. Just wished we'd cancelled as soon as we realised we had no hope of finding the capital to pay them off as it would have been the cheaper option.
