I purchased a part from a company called Phenox car spares on 13/07/09 how delivered the wrong air conditioning compressor for my car despite me giving the car make, model, year, reg number and even the part number. Despite numerous phone calls and promises that they will be delivering the correct part and pick up the incorrect part nothing has ever turned up. The delivery address is my works address and there is always someone there between 8:00 and 6:00. I am now at the end of my tether and have drafted this letter Could anyone comment on if it is appropriate and if this is the cause of action I should now be taking? "Phenox Car spares The Warehouse Otterham Quay Lane Rainham Kent ME8 7UX RE: Letter before action To whom it may concern I purchased an air conditioning compressor for £65 on my credit card for an Astra SXI 1.8 16v on the 13/07/09. The incorrect part was delivered on the 14/07/09. I promptly rang and informed you of this. You have still failed to supply the correct part to me. The part that was requested had a part number of 09174396 As you should know goods supplied must be fit for purpose as stated in the sales of goods act 1979 section 14 sub section 3. You are in breach of contract. The sales of goods act 1979 will require you to supply goods that are fit for purpose. If you cannot supply the correct goods then I want to cancel the contract and receive a full refund for the price paid which is £65. The delivery address for the part was XXXXXXX XXXXXXXX XXXXXX I will give you 7 days to deliver a replacement or to cancel the contract and give a full refund. Regards James Palmer" Thanks in advance
  3. Thanks very much to every ones post so far! I should point out that they where all UNPAIDS OUT or PAID REFERRAL FEE I have not included his ADDITIONS ACCOUNT FEES , although he only had some of those ADDITIONS ACCOUNT FEES earlier on but then his account was changed to a student account these ADDITIONS ACCOUNT FEES where then WAVERED for the duration. The £10 and £15 pound charges probably all occured during this time while hiss account was a student account? then the larger charges £25 to £35 have happened after he left uni, has anyone else experenced this? And if this is the case are Barclays saying that it cost them less to process a students for going overdrawn!?! LOL Once again thank you everyone so far and thanks to all that help that i am going to receive! James Palmer
  4. from what i have heard barclays still settle out of court just before the court date. also the claiment that lost was against lloyds TSB not barclays. I hope that gives you some encoragement Anyway i wish you the best of luck
  5. I am helping my brother out with reclaiming some of hs bank charges over the past 3 years. I have had disputes of my own with banks and have won every case that was taken to court. So i know the roughly what i am doing. However my brother has had 14 x £10, 3 x £15, 2 x £25, 15 x £30, and 1 x £35 and from going though the all the information in the past when i claimed i am aware that a £12 charge for late payment on credit cards is accaptable. does this apply to bank accounts what charges should he try to reclaim?   7. can someone please tell me the relavent parts of these acts? Unfair (Contracts) Terms Act 1977 s.4 Unfair Terms in Consumer Contracts Regulations 1999. Para.8 and sch.2(1)(e). Supply of Goods and Services Act 1982 s.15. or even better if someone can send me all the things they are sending to barclays. kind have left it to the last minute so a quick responce would be appreciated. ie have to put in postoffice tommorrow with special delivery, to get there monday. many thanks in advance James

  9. well today i have submitted a claim though money claim! I will let you know how I get on! Has anyone actually been to court with barclays yet???? Hope to hear from someone soon
  10. Sent of a preliminarily letter about a week and a half ago, then a few days later got a letter back from Barclays saying we will reply to your complaint within 14 days. Now I have received that reply within my original 14 days saying Thank you for you letter dated 23 march 2006 I am sorry you feel the bank charges you have incurred are unfair and represent a penalty. I note you are claiming a refund of £315 for the period of the last four years. In your correspondence of 23 March you have referred to common law, statute and recent consumer regulations, which you say supports your view. Barclays is aware off all the information you have drawn to our attention. I must inform you however, that we disagree with your legal analysis. When an account is opened with us, our customer is provided with a copy of terms and conditions relating to the use of their account including details of these charges. bla bla bla Putting the above aside, on this occasion as a gesture of goodwill I confirm I am willing to refund some of the charges totalling £170. I hope you will agree this is fair and reasonable. If you would like to accept this offer please let me know in writing. I have enclosed a prepaid envelope for your use. I will then arrange for the payment to be credited directly to your account. If you wish to discus this letter, or you feel there are further issues I need to consider, please contact me on my direct telephone number (London number). If you are dissatisfied with my proposal for resolving your complaint you may ultimately be eligible to refer to the Financial Ombudsman Service ... bla bla bla So they have offered me half back! But I want the full amount, any suggestions? should I ring them on the number and ask for the full amount back (which I would prefer not to do), send another letter giving another 14 days and saying that I will not settle for anything but the total amount, any one been here? I know this is about barclay card and not a barclays current account, can anyone explain to me what manual interventions are? i have just requested all my bank statements for the past 6 years from barclays and have paid £5 for them to be sent to me. Are the bank statements not enough to start sending letters to claim the money they owe me? Many thanks in advance for any information I recive and thanks for such a great site!
