  6. My claim for £449.07, was issued through mcol on 31st July. I received the Halifax's defence letter from Optima Legal Services yesterday. As yet I have not had any notification of the case being transfered to a nearer court, nor have I received any information of a stay being applied. The status on mcol remains as defence (it previously said halted ). What (if any) is the normal chain of events with regards to going to court after the defence has been issued? What is the average time scale? Sorry for the questions, this is the first time I have actually been issued with the defence documents. I have previously been lucky enough to receive settlement before it gets to the court stage. Thank you in advance

  8. I am posting on behalf of my aunty who is without an internet connection at the moment. On 10th July a claim against the Abbey was issued through MCOL, it was deemed served on 15th July. On the notice of issue it stated that the defendant had until the 29th July to reply. No acknowledgement has ever been received. On 7th August Abbey filed their defence and on the 13th August MCOL sent a notice of transfer of proceedings to our local court in Newport, Gwent. As the Abbey did not respond by the 29th July, doesn't this automatically go in my aunts favour, especailly as the OFT test case wasnt announced until 31st July? Where does she go from here? We would be very grateful for any advice/help offered.
  9. Thanks both, I have just contacted my local Count Court, they are going to send out a small claims pack today. I have saved a copy of the N1 and will amend accordingly. Am a little bit terrified :o if I'm honest, so any help/tips/advice would be very welcome. Andrea
  10. Hi there Hope someone can help me. After having no joy from lloyds with regards to the prelim/lba letters, it is now time for me to head down the court route. My question is, do I use MoneyClaim online as I have done previously with my other claims?? Its been a while since I have done this part and I am aware that sooo much has changed recently with regards to claims etc. Any advice/recommendations would be grately recieved. Many thanks Andrea
  11. Hi all, I sent a prelim letter to Barclaycard on 23 March claiming a refund of £492. On 28 March, I checked my account to find that a credit of £216 had been made which was listed as a 'late payment refund'. I have not received any correspondence from Barclaycard regarding this credit or the outstanding £276 (which I will still claim for). Has anyone else experienced this? I am due to send out my letter before action this saturday, obviously it will now be minus the £216. Many thanks

  13. Just a quick one, its been a while since I last posted. Im in the process of taking lloyds plus a few others through the claims process. In the letters that I have had back they stipulate that the FSA gives them 8 weeks to investigate and respond to the complaint. Is this now the case or are we still going by our set timeframe ie 2 wks from prelim, then 2wks from LBA etc? Many thanks
  14. Hi Elbarto, I too have successfully claimed back all charges plus interest from the Halifax (£821), and yes I did have to start court proceedings. The fees for the court were also refunded by Halifax (£80 for mine). I am in the process of claiming back charges with my second account I hold with them, and no doubt that will go to court too..lol! Stick with you timescale and dont give up, you WILL get your money back!! Good luck Andrea
  15. Have been in hospital since 6 May, but still not heard anything from the Halifax, so today I will send them the LBA today, they have had more than enough time to reply!! After winning my claim on my other halifax account, I am very confident about this one
