  1. hi, thankyou very much for your prompt reply, not sure if they were original statements, just looked like print outs but was a few years since i requested those. think i last made a payment in 2004 but i remember there were no payments, only interest showing on the statements they sent which was why i couldn't see where the debt had come from however i did make contact, again not acknowledging the debt but did offer to pay a small fee to get the default removed sooner but this was declined. don't know if had made matters worse by doing this?
  2. Hi, I have been pestered for a debt of under £500 for many years. initially for a store card with ge capital bank taken out in 2001 which i thought i had paid but have no proof. I have liaised with link financial a few years ago to request statements but they could only provide me with information from 2006 onwards which does not show how the debt accumualted. they have denied i have ever been in contact and again i have no proof of same. they slapped a default on my file which is due to come off this april but are now threatening me with a ccj. i have tried to contact ge capital bank to see if they have any info but just get through to santander and then on hold for ages till i eventually give up. can anyone tell me if link can or will slap a ccj on me when default almost spent? if so, is there is anything to do to stop this? This is not a debt i acknowledge but seem to be going round in circles trying to rectify this and am trying to get a mortgage so this does not help! please please help

Thankyou for your help, you've given me something to try, just been hitting brick walls all day! i will go tomorrow and see the clerk, fingers crossed! can u tell me why you think baliff is talking crap? i know he is legally able to get locksmith, is he also able to apply to get me arrested for non payment of fine, even tho have offered to pay
  4. yes, the most part is for failure to respond to notice of intended prosecution, i cannot prove that i did, the court agreed was the highest i would have been ordered to pay but said it was because i didn't attend the hearing and provide my circumstances at that time
  5. please can anyone help, I had a notice of intended prosecution for speeding (accidently at 40mph)on duel carriage way in january, i returned it but it seems it was never received and i have no proof, i have been through a very difficult time, my mum is dying, has lung and brain cancer so been an emotional time and been her main carer, also single mum and working part time, i went through a phase of not opening my mail and when i did found a court date for june that i'd missed and a £600 fine, i liased straight away with the magistrates court and completed statement of means and mitigating circumsatnces and offer of payment, they were very understanding but said they could not do anything as had already been passed to marstons. have had marstons baliff letter today and spoken direct, he says i must pay £900 in 2 weeks or he will get a locksmith to enter my home and if i do not have any goods of value, which i don't he will get me arrested. I am really scared, i have offered to pay by installments but he says all he can do is 450 next week and 450 the week after. is there any thing i can do? my family need me and i can't tell them about the mess i am in.
  6. Hi, I needed an automatic as I am partially disabled and managed to purchase one cheaply. It was a bargain as had been kept in a garage and used seldom so had very low milage though was a number of years old. Two weeks after I bought the car someone ran into the back of me causing damage to the rear. The third parties insurance company wrote my car off without even seeing it a write I have obviously only been given the book price. My other half is a mechanic so he has managed to repair this but my current inurers are refusing to insure as they have already written the car off and moreover are refusing to refund me of the insurance I have paid up until january and stating that I will lose two years no claims even though it protected as I had had an accident in the hire car-also not my fault, but they cannot claim off the third party.so my insurance company staes it is therefore my fault. There has been no claims or legal action against me regarding the accidents. My insurance company is also staing that i will struggle to inure the car with anyone now even with an mot as it has bee written off. Please Help!

  9. Thankyou for your response. Yes, I have all my charges on a spreadsheet and sent this to HSBC on 4th March still have a copy but should i now be adding more interest?. Didn't realise they had to issue a response within 14 days. Have had an acknowlegement letter does this not count? sorry for my ignorance. Just getting really confused with all this. Chillipepper
  10. I posted my request for refund of bank charges on 04/06/07. Received an acknowledgement letter dated 16/03/07 stating my claim would be looked into but am still waiting! I have phoned HSBC on a few occasions who inform me there is a back log of claims but are unable to tell me if my claim has been looked at yet or how long still I might expect to receive a response. Please advise me what I should do now An unhappy chillipepper
  11. Help, got statements back..what now? Hi, I have just received my statements back and have so far worked out that HSBC has charged me £2200 for overdrawn fees and bounced cheques. Please can someone tell me if there is anything else I can claim back such as credit card interest and whether I need to allow a percentage of the 2200 for hsbc before submitting a request from them. also, how do i go about working this out and do i need to submit a breakdown of the charges to hsbc? Please Please Help very confused Chillipepper:confused:

  13. thankyou welly, this is all a bit of a minefield. is it just fees for overdraft and bounced cheques i can claim or can i claim back charges from my creedit card too- think this is probably my biggest source of anger as i didn't stand a chance of paying off this card with the interest being so high chillipepper
  14. Hello, I have recently joined this forum as i am thinking of claiming from hsbc. I held a student account with them through which they were more than happy to help me get into debt. Though I had part time work I had no other financial support whilst persuing my degree so ended up accumulating a £2000 overdraft and £2500 credit card debt (£70 a month only just covered the interest on this!) I am now working full time but have found it extremely difficult to address the debt due to being a single person and that i have got into a cycle of never receiving my full monthly wage and having to exceed my overdraft limit. I was informed sometime ago that i was paying an average of £200 a month in bankcharges! The crunch came when three months ago having phoned my bank on numerous occasions to ask for four cheques to be stopped so that i would not be charged for these to be declined and could make other arrangements for payment, I found that they hadn't been and these were rerepresented three or four times!!! as a result I was paid by work and the bank swallowed up nearly all my wage and refused to help me other than to give me a 'managed loan' which would pay off all my hsbc debt but at 12%apr and bearing in mind that the interest i have already paid for the credit card would probably have paid the card off three times over, I had no choice but to agree to this. I have filed complaints about the cheques not being stopped and the bank admitted fault but only gave me access to the cheque ammounts-including them in my managed loan and refused to refund any of the charges. I could go on as i have many more issues with this bank but am wondering if anyone can tell me if i can still claim since i am now comitted to paying this managed loan??? chillipepper:confused:
