  5. Hi Vix, I handed my claim in in person and was given a response by date there and then.
  6. How long after notification of success has it taken for you to receive your refund? And by what method were you paid? e.g. cheque, direct to account, etc
  7. Received a letter from RBS, offering me the full amount plus costs Although they still stressed that their charges were fair and that I stood no chance in court!!

  9. Well, my appointments for this afternoon so it will be interesting to see if the reclamation of bank charges is mentioned.
  10. Same here. To date I've not received any acknowledgement of the summons. Today however, I received a letter stating that they would like me to make an appointment to review my overdraft facility. I've had one for about 7 or 8 years and this is the first time I've had to have a review of it. Me thinks their up to something.
  11. My claim was submitted on the 6th April but the Small Claims court must be busy in my neck of the woods because my court date isn't until the 9th June!! And they have until the 2nd June to respond. In the meantime I've had one of what appears to be a standard response from one of their Customer Service offices in London, but there was no mention of the small claim!!
  12. Hopefully that's the best approach because that's what I've done. Mine came to >£900 but I submitted a claim for £701.49 which happens to be 5 years worth.
  13. I filed mine in person and the clerk told me at that time that she'd booked it into court for the 9 June and that RBS had until the 2 June to respond to the summons.
  14. I've filed my Small Claim against RBS today, I'm fully expecting them to defend it. Although I'm a bit dissapointed in having to wait until 9 June

  16. I only ever received one letter a few years to tell me that I had gone overdrawn and that they would not be sending me anymore letters. But hey were still prepared to charge me £30!
  17. I received a response fairly quickly to my first letter aswell. But unless your asking for a smallish refund, then the next letter you get will be "get stuffed"!!
  18. I've been trying to get my charges back from RBS also. Today I'm filing my small claims at court. However, before you proceed to this stage, I suggest you send them the "Stage 2" to give them another chance to pay up.   19. Well, got my Small Claims court paperwork filled out and my statement of claim details attached. I've also included the Excel spreadsheet with the list of charges. Should I include the 8% interest details or just print it out and hand it over without this? I'm handing it in today, wish me luck!
  20. So it's OK to use the full Excel spreadsheet including the interest calculations? Or should I use this without the interest part at this stage? Who's responsibility is it to work out the interest?
  21. When submitting my Small Claims to my local Sheriff court, should I include a list of all the charges applied, e.g. date, amount, reason, etc or a photocopy of the relevant pages of my bank statements, or nothing at all? Or should I use the BankCharges Excel file in the templates library?
  22. As you've stated, it's a different contract from your bank account and unless there's a specific mention of the fact that the bank can ask for the money back at any time (as they can with an overdraft), then I think you'll be OK, especially as you've never missed or been late with a payment.
  23. Received another letter today from the same department as yesterday, Group Customer Relations department. Basically re-iterating all that's been stated to date, their charges are fair, etc and if I'm not happy to go to the Financial Ombudsman. Looks like it's small claims time. Do I have to submit a claim straight away? Is there a perceived limit as to how long since the last correspondance I can wait before initiating court action?
