  1. Spoke with James Arrundale and have just agreed full 100% settlement so I guess I can say I'VE WON. Would like to say a big thankyou for all the help and advice, couldn't of done it with out you. Oh and yes, when I have received payment and cleared funds donation will be on the way. Can a mod please change my thread Thanks guys:D :D

  3. Hi Fuzzgun19 It looks like abbey are playing us at the same game. They failed to comply in my case with the orders of District Judge Brown. I wrote to the judge requesting it to be struke it out. The Judge issued them with a judgement or order giving abbey a further ten days to comply with the original order of 8.1.07. Again abbey failed to comply so I am now entitled to enter judgement, this I have done today. So hang in there the end is near!!
  4. Sorry but dont hold your breath, I e-mailed both Inga and James 27.1.07 received a reply back from Inga, she said that she would get my file out and get straight back to me. Well I am still waiting!

  6. Please can anyone help me with completing a N225? I am at a loss what to enter on the below: Judgment details Sub Total Amount of claim as admitted (including interest at date of issue) does this include all charges and my costs? Interest since date of claim (if any) what date do I enter here? Period from to what date do I enter here? Rate % Court fees shown on claim Solicitor’s costs (if any) on issuing claim Thanks for your help:confused:
  7. NEARLY THERE!!! I have contacted the court today and abbey have failed to comply with the above Judge's order therefore, I am now entitled to enter judgement. Does anyone know how I go about this, do I have to write to the Judge asking for judgement or is there a form that I need to complete? J:D

  11. Sent e-mail to Inga who replied saying that she would get my file out and get back to me, that was over a week ago and I am still waiting. However, today I received the following reply from District Judge Brown to my request for it to be struck out: Upon reading letter from claimant This order, in part or in whole, has been made on the application of one party, without notice to another. Any party affected by it may apply within 7 days of service of it upon him/her/it to have it set aside or varied. IT IS ORDERED THAT 1. The Defendant do comply with paragraphs 1,2 & 4 of the order dated 8th January 2007 by 15th February 2007. In default the defence shall stand struck out and the claimant shall be at liberty to enter judgment for the sum claimed and costs. Hopefully the end is near.
  12. Congratulations Mrs P I got my bundle in by the given time however, abbey did not, so I have written to the judge asking to strike it out. Also I e-mailed Inga who replied on Tuesday saying she would fish out my file and get back to me later on, guess what I am still waiting!
  13. Thanks Karn and srfrench I have done the letter to the judge requesting that the case be struck out. As my hearing is not until 13.4.07 I thought by sending the above e-mail to Abbey they may like to settle now rather than more costs being added (I'm all heart you know). Sorry srfrench but I am being a bit thick here, do you suggest that I dont add "without prejudice" to the top of the e-mail? Thanks both J:)

I am about to send the follwoing e-mail to Inga can someone take a look and advise: without prejudice Dear Ms Kirkman I write in relation to the claim as detailed above, and specifically the order made by District Judge Brown dated 8th January 2007. You were ordered by the court to by 25th January 2007 file and serve the documents upon which your client intends to rely at the forthcoming hearing. I have, to date, received no such documents and accordingly I now will be asking District Judge Brown to grant me judgement by default. To date the charges and costs as at 27th January 2007 stand at: Charges/Interest @ 8% £3205.07 Court Costs £ 220.00 Other Costs £ 33.20 Total Claim £3458.27 If you wish to discuss settlement I can be contacted on ………..
