Hi there my friend has filed her 2nd claim with RBS as we live in scotland and cannot claim more than £750. The first payment was paid in due course. Today she has had a letter to state the bank is defending it and she must attend court on Monday at 10am. Are the banks getting stricter? Are they likely to turn up to court? She's worried and doesn't want to mess it up

sorry i should add the default was issued i do remember getting it but it was due to the arrears being made up of only charges

My next mission is to get the charges back from my BOS current account which has been defaulted i am at the stage of raising a small claim but not sure what to put for the default. I have stated in previous letters to them that i wanted it removed. Does anyone know if i have to complete a separate form or can i just add a sentence in on the small claims form if so what sort of thing do i put just something like this.....? In addition to full payment of the sum plus interest mentioned above I require that you remove the default entry from the register. Please note that mere correction or amendment to the entry will not be acceptable. Thanks in advance
