All done by following step by step guides backed up by the help & support of EVERY member of this brilliant community..... Now for some more cheering up...Its long but well worth reading How to Tell When You Need a New Car. * You lose the stop-light challenge to a 14-year old on a moped. * 15 minute Jiffy Lube needs to keep your car for 3 days. * When you gas up, the attendant asks, "Can I re-duct tape that windshield for you?" * While waiting at a stop-light, people run up to your car asking if anyone was hurt. * For the last five years, you've had to settle for making "vroom-vroom" noises while sitting in the driveway. * You keep losing dates on left turns. * Traffic reporters are starting to refer to you by name when discussing morning tie-ups. * Your tires are balding faster than Michael Bolton. * The engine burns more oil than gas. * You wouldn't mind if you were car-jacked. * You judge suitable parking spaces by the degree of downhill slope. * You have the local tow company on speed-dial. * The engine catches fire and you don't notice anything wrong until the firetruck pulls you over. * You can leave your car parked, unlocked, with the keys in the ignition, and not worry about it being stolen. * Public transportation starts to look good. * Your entire car isn't worth the minimum insurance deductable. * The city sends you a notice requesting that you remove the "abandoned vehicle" from your driveway. * Even homeless people look derisively at your car. * Every time you start your car, the local smog index jumps a whole point. * The local mechanic says that doing a tune-up is just "throwing good money after bad." * You double the value of your car everytime you fill the tank. * The 8-track tape deck finnally eats your last tape. * When you try to sell it, The Old Car Trader won't accept your ad because they, "have a reputation to protect." Hope that worked....
  3. No probs...They'll just send the forms etc when all the paper works completed they'll either get a man in a van to pick it up or you'll have to return it back to where they say & find your own way home (As I had to do with my last car).
  4. OK...All the help you need for filling in the A.Q. is here... Allocation Questionnaires - A guide to completion & Here Welshman v Barclays...last few pages Hope this helps???
  5. The MCOL fees all depends on how much your claiming back so it can be anything from £30-£100+ but WHEN you WIN its all claimed back... The A.Q. FEE is £100 if your claim is over £1500 if its under then theres no fee at all...again its claimed back when you win... (edited as misleading info was given...Sorry) Theres a good help guide for filling in your A Q here Allocation Questionnaires - A guide to completion & here Welshman v Barclays....the last few pages Hope it helps????
  6. Hi There If its a true HP agreement there WILL be an amount printed (usually on the schedule sheet) of how much needs to be paid before you can V.T. ...I've already done this twice without any problems... The car can then be returned to the finance company but needs to be in a condition which is expected for age & normal wear'n'tear when it was originally sold to you, ie. theres no major dents or scratches etc...if there is its best to get these sorted or patched up yourself as they'll charge you a small fortune if they do it themselves. You need to watch though as some agreements which look like HP are actually personal loans then the V.T. rules do not apply only a 14 cooling off period... Hope this helps??
  7. Well guess what jigr69 I asked this question myself only just yesterday...your answer can be found in this thread.....The last page...But the rest is good reading anyway... Welshman v Barclays Im just waiting for payday now....
  8. .....I think their Email Server is about to crash right about.....NOW.... What a great thread this has turned out to be....
  9. Martin your a gent...Thanks for your help on putting us on the right track...All the way to the.....Bank.
  10. Good Luck Matt....Dont forget to keep us updated on how your claims going....
  11. That was the point that was throwing me to... Hense why I thought djduncaz had bypassed the letter writting stages completly & was just going to the courts with all guns blazing.....
  12. Yep....Mines going off today as well I think.... A sound word from someone whos been there, Done it & wears the T-shirt with pride should alway be respected & learned from thanks Martin I just want to clear if few points first before it goes off...Here Goes... I know im sending a copy to the Court...Would I send another copy to the person who sent me the crappy under 50% offer as I sent her my letter saying thanks I'll take that & I'll see you in court for the rest... OR would I send a copy to ADRIAN RUFFHEAD (poor chap & I though my surname was bad...SHINYHEAD ok joking I am LOL) If so... a) Do I send a copy of my claim printed off from the Moneyclaim website & attach the schedule to that??? b) How do I know he'll have my details??? b) What address do I post it to??? Sorry to ask a few questions but I just want to get thing right before its highnoon at the O.K. Corall.... Thanks for your advice Martin...
  13. Hi Welshman & Martin3030.... Well I called Moneyclame the day after Issue day which was 11th sept just to double check that I had to wait 14 days for the bank to either file a defence OR totally ignore my claim & I win by default etc... Wrong...They said that it takes upto 4 days for notice to be served on Barclays THEN the 14 days start...Great I though...So now I have to wait until 2nd Oct... On the posts regarding sending a schedule of charges to Nothampton court...I Havent done that either...but would it cause a problem if I dont send it to them???? as Barclays already have ALL my charges etc so the amount im claiming will match the amount Barclays have as they've ALREADY got my schedule???? If im totally wrong then I'll just put a copy in the post today...
  14. Sorry djduncaz I was reading your post wrong.... Im glad you've sorted it out in the end... Good luck & let us all know how you've got on...
  15. I think your trying to bypass the whole buildup stage & going straight ahead with court action????... I think you may be shooting yourself in the foot as you havnt given your bank any indication of your intentions by following the recommended/tried & tested path... You havent given them any time to respond to any requests...I think they'll be taking this one all the way???? It may be best to start all over again & read the FAQs & other posts THEN & ONLY THEN start off with a Data Protection Act ect...ALLS NOT LOST just take a breath & start all over again the right way
  16. Sorry Michael Browne looks like we were thinking along the same lines & posted the same thing at the same time....
  17. If you've copied your friend then you'll already have ALL your statments???? Otherwise how did you know how much you were claiming back???? Have you gone through the sequence of template letters???? eg. Data Protection Act Request...Prelim Letter...LBA????
  18. What the hell is this???? I issued my moneyclaim online 11th Sept...I havent heard anything back from anyone yet so just waiting until 2nd Oct to enter Default Judgment... Prob wont be that lucky though.... I hope someone know what the above means??? Is this Barclays new angle of dealing with us????
  19. Well Honestknob....heres what I've found from a quick search...Hope it helps???? http://www.bankingcode.org.uk Overdraft enforcement notice - advice...please!!! http://http://www.bankingcode.org.uk...DF%20FINAL.pdf Credit Agencies - Default Data and the Banking Code http://www.bankingcode.org.uk/press/...y%20310306.doc Good luck
  20. Firt off...well done Honestknob for taking it all the way...Yet another victory for the everyday person.... With regards to them closing your account(If thats what their wording means)....Im sure they will be breaking the Banking code by closing your account as at the end of the day THEY ARE IN THE WRONG & It was THEIR UNLAWFUL charges that put you further overdraw..... Im 100% sure theres a thread here somewhere to help or someone who could give you advice(I'll have a look myself as well)... A&L are just throwing their toys out of their cot....shame on them:mad:  ...... Ill let you know what I find....
  21. They wont & cant win...they've got no defence... 1800 fellow members have got nearly 3 Million £ of their own money back so stick to your plan on attack & wait for payday....
  22. Be asured jamejo & hamster its all standard tactics from the banks...They're just trying to scare you into giving up so they dont have to pay out. The problem they ALL have is that.....THEIR BREAKING THE LAW:D & theres no judge in the country would agree with the banks (I bet even judges have had some bank charges in they're life:-? ). So dont worry & stick to your gun & wait for pay day.... Let us know how your getting on.... Im waiting for the bloodsuckers to either default on 2nd Oct or put a defence in...In which case I'll get MY money back a few weeks later....
  23. Well done....Are your going for any bank charges soon????
  24. Well done for starting the ball rolling with getting your charges back....But I think you'll get a better response from this sites members if you post your thread under you relevent banks board ie BARCLAYS, HSBC etc.....
