Hi Laura First of all your not been a pain lol Sorry i got the impression you had done a prelim letter already if not then you need to send this first, along with a full copy of your schedule of charges.(dont minus off the partial payment at this stage). At the top of your prelim accept the partial payment like below. Thank you for your letter dated DATE I accept your offer of a refund of charges totalling ££££ on the understanding as a partial settlement towards my claim. I intend to continue with my claim against you for the remainder of charges added to my account between the date DATE and DATE. Rob
  2. Hi If you have checked your account and they have not credited your account then i would proceed as normal with the LBA. To get you APR just phone customer services and ask. My APR on my card at the highest rate was 24.9% and MBNA paid up at that rate. So make sure you get whats owed to u Rob
  3. Also in your LBA in the calculation paragraph i would take into account their partial payment. Rob
  4. Hi THe letter seems fine 2 me. Just a quick mention on the interest you are claiming. The 16.9% is that the highest rate you have paid on the card as MBNA will pay you out on the highest rate. If your unsure a quick phone call to the customer service dept will clarify. Take them for every penny Rob

    Hi You need to write a paragraph at the top of your LBA like this. Thank you for your letter dated DATE I accept your offer of a refund of charges totalling AMOUNT on the understanding as a partial settlement towards my claim. I intend to continue with my claim against you for the remainder of charges added to my account between the date DATE and DATE. Then carry on your LBA as normal. Rob
  6. Hi Sarah Why stop There? Accept the offer as a partial payment and continue to pursue for the rest. If i was in you i would be claiming for the charges + interest on the charges plus contractual interest on the whole amount. Use one of vampiress spreadsheets. u will probably find the amount they actually owe u is more than what u think. Rob
  7. Hi Yes you can cash the cheque no problem. Make sure u claim contractual interest on the charges. After the 14 day expiry for your LBA u can then submit a money claim online. Before you go down this route read other post from MBNA customers as many have claims settled before it goes to mcol. Hope this helps.
  8. Hi another update Received a letter yesterday offering £362 difference between the £12 (OFT recommendation NOT!) and the charges levied on my account. So LBA will go on Monday. I will not include the bank commissioner findings in my letters for this particular claim as i have all my statements. However i will use it when i ask for a full S.A.R.
  9. Hi got a response to my prelim letter today saying the usuall bull that we are dealing with your complaint and we will get back to u before the 28th December we have enclosed a valued customer feedback leaflet lol. I will give em another 10 days before i send my LBA. Rob
  10. Hi At the prelim stage you should decide which type interest you would like to pursue. You Can either 1. Claim interest on the actual charges and contractual interest on the whole amount.(this can be added at the prelim stage) 0r 2. Claim s.69 at 8% which is claimed when u submit mcol. As far as im aware you cannot claim for both. Yes at the beginning of your prelim accept their partial payment. But let them know u will pursue the rest. rob

    Hi Yes you can claim interest on the charges and then interest on the whole amount your claiming. My claim was for £910 over a 6 year period with interest added on my claimed more than doubled to £2300 Rob

    Hi You can claim for your charges plus interest on the charges plus contractual interest on the whole amount. If u want to go down this route add the interest on at the prelim stage. Before you can do this you need to find out the APR on your card at the highest rate. You could use a spreadsheet from vampiress chambers which will work it out for u. (Doing this way may double your claim) Or you can add the 8% at the mcol stage. But Mbna will settle before mcol. rob
  13. Hi If you are speaking to MBNA customer services its like hitting your head against a brick wall. All they will do is try and confuse you and put you off making a claim. So when it comes to data protection the best way to deal with non compliance is take MBNA to court via letter form only. Rob

  20. Hi You can claim for charges plus intrest on those charges plus contractual rate of interest at the higer rate of your card(Phone to find out). Credit insurance as far i am aware is a untried area but i could be wrong. Rob
