  1. ok so ive searched through the forum for what to do next, all info is very helpful, many thanks there, with regards to recieving letter im going to just wait until the 14 days are up from when sent lba letter, and will keep posted if i recieve any response
  2. im just starting my claim against capital one, i have all my statements sent to me from when account opened which they didnt charge me £10 (how very kind of them) so do i just send them the preliminary letter with a list of all charges and dates etc to start the ball rolling
  3. i am about to start my claim with capital one, ive only had account just over 2 years and they have taken £640 in charges to date in overlimit fees charged and late payment fees charged, over the last 5 months ive been paying them at least £35 - £40pm but they still charge me as the date they request the payment i send through internet banking which takes upto 3 days to clear in there accaount hence putting me over the limit, its been a constant battle with capital one, in january my ballance was over £400 due to charges, so i had to find £221 to pay them in feb 06 to stop the default they threatened me with. i already have recieved my statements since opening the account, so now i take it i should send the preliminary letter, i have also done the list of charges on one of your helpful spreadsheets, but please can someone tell me - i dont include the 8% interest at this time do i? just a list of charges and dates. is this correct or is it different claiming on credit cards to what its is claiming bank charges id appreciate any advice lol
  4. so do i just wait and see if they reply to the lba letter sent, which will probably be the same letter i just recieved above.... or do i take the next step which is ??? im really not 100% on this
  5. i recieved a letter back today from lloyds tsb reagrding my 1st preliminary letter which states: dear miss like any business, we do make a charge for some of our extra services. when a customer doesnt have enough in there account to cover a payment, this always means additional work. we must either make the payment for you via an over draft or send the payment request back. either way, it has to be speedily. we feel its only fair to charge for the extra work involved. of course it is only fair, too, that we're completely open minded about any charged for services before you take them up, thats why we take care to provide every new customer with the latest guide to our charges. you can also get up-to-date details about fees and borrowing rate at all our branches, via our helpline and on our website. if you know a payment is going to take you over the limit, you're welcome to see if we can raise your limit - and we can usually give you a answer straight away, and we never charge an overdraft excess fee more than three tines in any one month, however many times you go over your limit. you've mentioned the new guidlines from the OFT on credit card default charges, we dont agree with the OFT's thinking on this and we're still talking it through with them. but the important point is that the guidelines only concern 'default' charges. the fees we charge for going over the overdraft limit and for returned payments are not any kind of default penalty. they are fixed standard prices for the service we provide in these situations. so according to our legal experts, the OFT's guidelines on credit card default charges do not in any way apply. i do hope you can see that we make our charging system as fair as possible - and why i cannot agree to cancel your charges. this letter is the banks final response, which means if you stay dissatisfied you may refer your complaint to the Financial Ombudsman Service. If you decide to pursue your complaint through the Financial Ombudsman Service you must do so within 6 months from the date of this letter. thankyou once again for taking time to raise your concern with us. i have sent my LBA letter on 09/08/06 and also recieved this letter on this date, i dont really understand is this lloyds tsb's standard letter? or are they basically trying to tell me i dont stand a chance and i dont really understand the 4th paragraph regarding OFT and defaults can anyone guide me on how to deal with this please lol case against lloyds tsb- sent 1st letter 25/07/06 recieved the above letter on 09/08/06 sent LBA letter on 09/08/06 PS IM ALSO CONFUSED AS THE LBA LETTER I SENT STATES ''I am very disappointed that you have failed to respond to my letter of the 25th July 2006''.BUT THEY HAVE RESPONDED WITH THE ABOVE LETTER, I just dont no what my next step is to be???

  8. please can anyone help me with this, i am currently claiming bank charges bank, which is all down to this amazing website, but i have also done a creDit check on myself and have seen a default has been put there jan 06 for £1,100, now im so angry with this as i never recieved a letter stating a default was going to be put in place, AND ALSO i believe i closed this account end of 2004, and they have just been putting charges on every month, i remember i recieved letters stating i needed to get account upto date, and when ive actually managed to get through to them ive requested my invoices for the months they were saying i still o/s so i can dispute them, they said yes they in the post and i never recieved anything, ive had nothing but trouble with 02 since day 1, the lack of communication is hideous, and the fact i have a default against me without any warning - well surely something can be done... does anybody have any advise on what the best way to deal with this many thanx... i am unhappy that a default has been put against me without previous warning or any letters stating this

  10. sent my preliminary letter of today recorded delivery, along with the last 3 years statements which i downloaded from online banking, in total am claiming back 1500, so we will just wait and see now lloyds tsb response
