  1. Still heard nothing and considering we were registering the birth of my son who is 3 in february I suggest that everyone else does the same. Just write back and advise that after the first letter you will start charging for your letters, keep copies and send registered. I said £75 per letter including the 1st so it makes their requests pale and they just go away...no other agencies involved at all
  2. Hi there we have a similar situation with Kays catalogue and they have written and advised they will not pursue the debt. You just need to be persistant and stand firm and don't sign any letters you send to them as they may be tempted to use your signature.
  3. Hi there we did apply and recieved back an unsigned copy and they admitted they did not have a signed copy. I am wondering whether they can continue to add defaults and charges. It all started when they delivered (in fact they threw it over the back gate as no-one was home) a laptop which ended up with a cracked screen. They stated it was not a manufacturing fault so we must have caused it as their drivers would never deliver items in such a fashion. The service since then has been atrocious. I would like to throw the ball back in their court and was wondering whether I could take them to co
  4. Hi there We recieved some truly shocking customer service from Kays and when they refused to deal with the issues we requested a signed copy of the consumer credit act. They admitted by letter that the debt in unenforceable as they did not have a copy but they still insist on sending letters threatening action and adding defaults. So far they have added 6. They also add charges for late payment. I did not have an issue with paying the amount but wanted my complaints dealt with properly. I now do have issues with paying them due to their constant harrassment. I am just wondering how to procee

  8. also to fill in the details we defaulted on a loan a while back and have been using payplan to make payments on the loan. They messed up and were 70p short one month and since then, because of this shortfall, the lender has acquired a charging order on our house. The loan began in oct 2004 and was for a period of 60 months. They have charged the full interest on the amount and are now adding 8% on to this. I have requested a settlement figure which removes the additional 21 months of interest as I was advised yesterday by the judge that under the consumer credit act that this is allowed. Weigh
  9. it was typed earlier when stating who has caollated the info but not in the section entitled statement of truth. I thought this would have to have something in it
  10. We recently had an application for a charging order against our house approved in the court. It took the solicitors ages (over a year) as they kept on not turning up. The jugde stated that as long as we kept up payment they are not allowed to apply for a selling order. Looking through the paperwork I noticed that the original application has no signature in the part that states its a statement of truth. Does this make any difference to the application? cheers

  12. Hi there We recently defaulted on payment to esure. My wife phoned to say the cover was no longer required with 2 months left of the 12 months. They have subsepuently passed the debt on to a collection agency. They called my wife and were agressive staing that they would send the baliffs in etc. I spoke to them and advised that unless they have a copy signed by my wife of the consumer credit agreement the debt was unenforceable. They spoke to esure and got back to us today (via phone even though we requested everything in writing) saying that esure have not passed on a copy to them
  13. Hi there some advice please. I have just recieved through the post a fixed penalty notice letter from my local council. The letter is addressed to my wife. They state that an officer authorised by the local council observed litter being thrown from the car window by a male person unknown. I imagine this may have happened and the only thing I can think this may have been is a cigarette end (dirty habit..I know!) They state that the offender is required to provide his name and address otherwise the fine could be £1000. I don't even think I was driving in the area they mention at the time th
  14. Hi there I posted a message earlier asking when I could send the baliffs in and have been advised I can do this right away if I requested immediate payment (which I did). I spoke this morning to Inga at abbey and she says that they posted a defence (not on file) and they will request for this to be put aside and they will defend it. Is it possible to ask for this not to be put aside as it's surely just a delaying tactic? Also, if they could not be bothered to put in a defence how is it possible for them to state it's not their fault? it's an online service so surely all they had to
