  1. Hmmm makes me wonder if I under calculated the charges. Good luck with them!
  2. Just been informed by Smile that they have today credited my account with the full amount I claimed for!!!!!! Fan-bleeding-tastic!! Thanks for all your advice!
  3. I have now issued my letter to Smile requesting that they repay the charges on my account for the past 6 years which comes to a staggering £3,300!
  4. I know I can't claim for the charge for the overdraft i.e authorised overdraft fee but can I claim for "service charge"?
  5. Have contacted Smile and they say they have sent out the statements. They also said they have passed on the deals to their complaints department to work out the charges, but they aslo said it would take them up to 7 weeks to contact me. Should I wait or go ahead with the first letter after I have been through and calculated the charges from my statments?
  6. Have given Smile 40 days in which to forward my last 6 years statments. This time is up tomorrow so should it not arrive I will be issuing them with a request for my estimated charges. If it arrives I will calculate how much I have been charged and write to them requesting that.

    SMILE - question!

    Hi All I wrote to smile with the £10 charge and then followed it up with an email. I heard nothing from them so after 14 days I sent them the first request for payment of charges that had been put on my account for the last 6 years which I have estimated to be £4500 (based on £1500 for the past two years). I have now recieved an email saying they have 40 days to responed to my original request for statements. I have pointed out that I gave them 14 days followed by another 14 days to act on my request for payment but they still responed with the 40 days email. What should I do next?

  9. Could some one have a look at the wording of my letter to my bank and to let me know if its ok? I am very disappointed that you have failed to respond to my letter of the 21/07/06 I now understand that the regime of 'fees' which you have been applying to my account in relation to direct debit refusals, exceeding overdraft limits and so forth are unlawful at Common Law, Statute and recent Consumer regulations. I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law. I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary. I calculate that you have taken £1500 over the period from 17/08/2004 to 23/05/2006 plus £3000 which I have calculated as an average for the 4 years prior to 17/08/2004. This calculation has been made as a result of your bank not sending me the requested statements and is based on the charges made during the period 17/08/2004 to 23/05/3006 giving a total amount claimed of £4500 I am enclosing a copy of the schedule of the charges for the period 17/08/2004 to 23/05/ for which I am claiming. I require repayment in full of this money. If you do not comply fully within 14 days then I shall begin a claim against you for the full amount plus interest plus my costs and without further notice.
  10. Hi Folks Has anyone carried out a claim with Smile internet bank, a co-operative bank subsidiary bank? I have gone back through 2 years statements and the charges I have been charged come to £1500!! if I can get the statements from further back it could be 3 times that amount!
