  1. Ive contacted the courts....... Turns out this guy isnt certified!!!!! I have 2 receipts from him with his headed note paper and certified bailiffs in brackets!
  2. Hello, Really need your help on this one people Basically I was charged a fee of £880 to a bailiff for literally changing the locks on my unit (due to the landlord claiming he had not recieved a cheque which is false but we have since left so thats no longer an issue) I had to pay at the time as all my equiptment was inside and I was hoping to extend our lease which had been given its 6 months notice by the landlord. I asked for a breakdown and I did check this forum before I paid but I was stuck as I had to get inside the unit and wanted to see if there was a chance I could change the landlords mind and keep the unit for longer....now Im out of there I dont give a rats .... about upsetting the guy so I want to claim back my money which was extorted out of me. I recieved NO breakdown of the costs/charges which I asked for and was told would be sent...witness's and tenants tell me the bailiffs where onsite for only 30 minutes as the landlord has a full set of keys so they had an easy job. I have filled in this form: http://www.hmcourts-service.gov.uk/courtfinder/forms/form4_0606.pdf Question is what now? Should I ask for a breakdown using the S7 Data protection act form or should I make my case as they have failed to give me a breakdown I asked for and go straight to court? Thanks so much for checking this out, its money I need back as Im self employed! J
  3. That looks great Martin thanks! I will start procedings right away!
  4. I was told there where there for 1/2 an Hour! This man is nowhere near generous
  5. Even tho I specified to the Passport office when I went for a "on the day" passport collection they still issued me with a biometric passport........to be honest I feel sick as I am strongly opposed to this kind of thing and I feel already I have had my basic human rights comprimised. Basically I know these are not mandatory and I would like to know if anyone can help: Can I ask for a standard digital and get them to clear my biometric details in the same way that you can do this with companys? Any help would be great And have my rights been violated especially as I asked NOT to have one! Thanks Jake
  6. Hello there, Ive been an Abbey customer for nearly 6 years now so Im able to get back everything they have taken I hope Just put in my Data protection claim, I have recieved statements going back 1 year after a phone request, they sent me the form to ask for the rest of the statements. Ive already added up over £550 of charges in the last 12 months alone! Wish me luck Thanks Jake
  7. Thanks for the comments above, basically if the landlord allows us to stay I will hold off on the court action with the baliff as he is buddies with the landlord and might be able to get us our lease back.......well its worth a shot, soon as I know we cannot stay Im on the case and getting my money back! Thanks again and to be honest Im glad to beout of the place as the landlord is just a tyrant! Thanks Jake
  8. Hello Trevor Thanks for your comments, well our problem was that our lease has been forfitured so I no longer had one, and its a commercial lease so he has more power to do this, the baliff charge is outrageous I know but best we pay and keep quiet and get the money back later, I just wanted back in the unit then we can deal with the charge........he is a baliff for sure but I know that him and the landlord are def taking a cut of the excess..... We have paid out last quater now so its all over I think...
  9. The Baliff came into the unit with me so we could check the place, nothing missing I can see so thats good. Paid up with no problems, will see how it goes for the future about claiming back monies etc with the data protection act letter. But for now main thing is we are in! Thanks for the advice so far I will keep you posted!
  10. Just spoke to him, can meet us there now but I doubt I can get there, otherwise he wants to meet in at his offices........ I should insist on meeting at the unit correct? Thanks
  11. Hmm this Baliff was ment to call me in the afternoon on Thursday, didnt hear from him so sent a text message to arrange a meet today at unit at 1pm. Just called it went to voicemail........ Whats my situation if he becomes uncontactable?? Basically I think the Landlord didnt count on us having the rent etc so if suprised we are paying and getting back in the unit! Also there is alot of things in the unit that are not ours, other bands etc.....whats the deal with that? Can we go in and get it
  12. In this case tho our lease has been terminated so I dont think that stands. I can have a soliciter look at it but I really have to get back in first thats the problem.
  13. Yea dont worry soon as he confirmed he hadnt got it, (lying or not) we stopped the cheque! Thanks
  14. Hi Elsinore, Yes we had a lease with this character and he served the notice of forfiture in April 2006 so we have until sept to leave. The notice was served to my home address and my business partners as well as puttin up a notice on the unit door. No covering letter from the Landlord tho, he is quick to shift blame as in person he is spineless and will shake your hand and stab you in the back at the same time. We are meeting him at 1pm tomorrow (friday) I will ask for the breakdown prior to the payment for sure. The Landlord is very very slippy and a bully but this is because no one has attempted to stand up to him as of yet and look where it has got us! But I believe I am right to look after myself and not just take crap from these people! We are looking for a place as we speak, we just want to get back in the and sort it out and leave in Sept but I would def like to continue to take legal action against this guy if I can. Thanks again J
