  1. A post came up today over at moneysavingexpert. A member there posted an interesting response from Cahoot that may prove very useful for customers of this company................. Quote........... I appreciate the points you've raised in your letter and can confirm that the charges levied contribute towards our costs for administering delinquent and overlimit accounts. This looks like an admission they are using these charges to fund other accounts. It may be handy to add this to any court pack in claims against them.   2. A friend issued his claim against Natwest a few weeks ago. He phoned the court today to find out if there was any response. The court told him that Natwest had replied, and had now till the 16th November for their defence. My question is............... My friend is going abroad on Sunday for five weeks. Obviously he wants to be able to turn up at court/deal with the case if he needs to. Can he take a letter to the court explaining that he will be away, and to delay the case until he gets back?
  3. Thanks for that. The papers will go to court in the next few days. The amount claimed for is £2610.50 charges, plus £577.90 interest, plus court costs. I'll keep everyone updated on the situation.
  4. I'm filling in form N1, and have adjusted the wording on the template for the particulars of claim. Can anyone give me any wording I could use for the Brief details of claim please? (I don't want to get this wrong). On the value, I am looking to include........ Total of charges.......... 8% interest on charges............ Court costs........... Total When I've filled these in. I presume I need to take to the court two copies of....... Form N1 (completed) Particulars of claim (attatched) Schedule of charges (attatched) Printout of spreadsheet with interest worked out (attatched) Do I need to include all of these, or have I missed anything?   5. I'm posting this on behalf of a friend. I have been helping him prepare all his contact/paperwork so far with Natwest. I've asked his permission to post here, and he's agreed. The situation so far......................... Sent request for last six years statements under the DPA. After 40 days (nearer 50), he had received no reply. Sent a letter giving seven days more for the statements, or he will contact the information commissioner. Statements arrived four days later (after a call from the bank to say they were on the way). Sent the first request for reclaiming the charges, including the schedule of charges. The amount claimed is £2610. Got a reply that stated the bank disagrees, but offered £264 as a gesture of goodwill. Sent off the LBA refusing to settle in full for this amount. Received a letter two days before the deadline offering £1300. .................. We are now preparing to go to court. I'm here doing the legwork and getting all the relevent info together. The claim will be for the charges, plus interest, plus court costs. Has anyone that has already taken Natwest to court got a checklist of all the paperwork I need to get together? Are there any statements/comments I need to include to back the case up? In the last letter, it mentioned that if my friend goes to court. The papers should be served to the registered office address at 135 Bishopsgate, London. Is this correct? All the letters so far have been addressed to his local branch. I appreciate any help we can get before we go to court. I'm trying to get everything together within the next couple of days. I read the thread of the Natwest case that went to court (and lost), so I'd like to cover all angles before we proceed to this next step. Cheers
