Hi Sarah, Just waiting for the court date now, RBS filed a defence, but it was just the standard one, which also asked for some more info qouting cpr18 (dont fall for that one !! loads of info in threads) But so i've been informed RBS have always settled out of court, they just like making you sweat a little. Nice aren't they !!!!!!

Has your bank been in arrears ??? They tend to pass accounts that are in arrears to this branch in Scotland. I had the same issue, but sent everything to the branch I opened with. Everything is going according to plan. So don't worry, just send it all to your local bank and they will do the necessary.

So what you are saying is that you had been pushed into a loan due to your financ ial position ??? There has been one thread on this site where they claimed a similar story, and won all there charges and the loan amount from RBS. Unfortunatly cannot remember who it was, or how they did it. So not much use then...............

Davidhannam, Just a quick question, did you fill the questionaire from the court and pay the fee, it's not clear in the thread. As mine is well over £1500. Is the questionaire to do with cpr18 ??

I note from your recent correspondence that you have requested further information from me under Part 18 of the CPR. I must advise you that CPR P.18 has no relevance to Small Claims procedures and, as such, I consider that the inquiry to be intimidating and I intend to bring this matter to the notice of the court, should my case proceed that far. As a gesture of goodwill and in the interests of concluding my claim, I have enclosed a breakdown of the charges imposed, their value and the interest being claimed on each charge."

Hi ann-marie, 1) Not to clued up on the Scottish system but I included the 8% when i claimed, which took me over the small claims limit, but it was allowed, just cost me a little more. 2) there are a couple of templates to use in the library, looks like you have picked the all singin and dancin version. there is one that just needs dates and charges. hope this is a help

I was worried for a while, but I found a few threads saying only one has gone to court. The reason Litigation Conlcuded does not have many, is becuase once poeple get the cash, they are off.............never to return. My defence is due before the 8th Aug, so if you are interested keep an eye on tomba90 vs RBS.

I had similar problem, RBS new I was suffering so they kindly offered me a massive loan at a crazy interest rate, and basically told me I had to have it....... I still struggle to pay it now, 2 years on !!!!!! As for your question..........Don't have a clue, but get those charges back fella.

I'm waiting on defence from Cobetts also. I have seen some info on the "extra charges". How did you claim, Was it in person or over the moneyclaim site ?

"£10 per phone call and variable charges per letter £10, £20 and even £100, all in black and white direct from themselves" You have to ask wether the charges are reasonable, by the looks of things they are not, if the charges are deemed to be punitive, they are unlawfull and you should be able to get it refunded. In other words, Yes i think it would be similer to what everyone is doing with the banks. But i'm no expert...

There is a section on litigation ended, i think you put it in there ??
