To answer some of the questions: Yes all money refunded + Interest + Court costs £5868.66 Cheque sent with letter, payed it into my RBS account today, and the man asked if I was going to spend it on something nice !!!! No mention of account closure(but it doesn't hurt to have a fall back). Same crap you get in all offer letters, "we think we would win", "would cost to much", "don't tell anyone......yeah right, bit late for that one !!! I respectfully decline your offer of settlement and request that you refund to me all charges that have been taken from my account now totaling £xxxx.xx I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder in the County Court if necessary. Micking, You need to respond to there letter excepting there offer as an interim payment but will still be going for full hit after your stated date. If you title this letter "before action" but keep the dates in line with your original time table. Hope this helps

Big C & DH, Surely the N244 route is only viable if you have not claimed the full 6 years !!!!!! As i have claimed 6 years to the day, I have no chance in adding more charges to the claim. So do I start a totaly new claim after the current one is finished ???

Roger, No claim has gone to court !!!! They always pay up before, None of the Banks can afford to go to court, becuase if anyone wins it will set a presedent, then the floodgates would open.....not just for the previous 6yr but for the entire life of the contract !!!!!!! They would have to kiss goodbye to £3billion profits........... in other words, don't stress !!!!:grin:

All, Got two letters this morning, an offer from Cobetts, and another Hearing notice from WXM county court ??? Cobbetts offer is the same speal as usual and offering 3K, better but not good enough !!!!!! WXM County court notice has changed from a telephone conference to a 30 min hearing, so hoping after I turn this latest offer down, cobbetts will make a cheque out for the full amount:cool: Get in..........

Way hay !!! I'm wrong, called the courts today, it will be decided by the judge what track on the allocation/case management Hearing. The reason is due to when the AQ's was submitted, I requested Small claim Track & our freinds at Cobbetts requested the Multi !!!!!! Anything to slow the procedure down..........Boo !!

Hi, Been reading up today on Her Majesty's Courts Service website, and found out why i'm so special......... I should have received a "Notice of allocation" which specifies which track the Judge has placed the case, this includes his reasons.(NOT RECEIVED) The case summary & draft order is only required for the Multi track ????? Me thinks I will be calling the court tomorrow as my claim is for £4640 and not very complicated.

OK, Cheers BigCol, Been in touch with the Mod (who thought it was a strange order) & called the courts, basically the case summary is exactly that "a summary of the case so far" & the draft order is what I would like the outcome to be. ie ALL MY MONEY BACK!!!! Anyway, the Hearing (by phone) will take place 10th October @ 12.30pm I may be the first to have this, so will keep thread upto date......... Also asked if they had many other cases like this, one or two was the reply !!!!!!!

OK I NEED A LITTLE GUIDENCE NOW !!!! Received letter from the court today: Upon the district judge considering the allocation questionnaires filed herein IT IS ORDERED that there be an allocation Hearing and Case Management Hearing (by phone) to take at WXM Court. The Claiment's/Defendent's Legal representation must serve a case summary and draft order no later than 4pm on the last working day before the hearing.:? :?

Hi All, Quick update, called the courts today and the case has gone to the Judge and he has requested a "case management meeting". I asked the lady what this was, and basically, he calls both parties into his office to see what is happening. Anyone heard of this ??? Its on 20th October, so not sure if this is good or bad !!!!!!
