  1. Do you recommend claiming money online? from what i have looked at so far it seems to be the less complicated way. Do you think that is correct? Regards, Tina.
  2. Hi again, I am about to start making a court claim, but don't know what to put for Claim No, Court fees, or Solicitors fees. You all prob think this is a silly question but.....Where do i get this info? Regards, Tina.
  3. Hi there, I have 2 accounts with the Halifax from which I am trying to claim back charges, I have been dealing with them seperately, and have sent claim charged letters and LBA's for both. (This is the scarey bit) I presume I should take them to court as threatened, but not sure how to go about this, or what to do next, or if i should put the 2 accounts together. I tried to paste my Halifax replies below but for some reason I couldn't. Kindest Regards, Tina.

  5. Hi there, I sent my prelim letter and got a reply which I don't understand, or know what to do about next. I would really appreciate some help, I have pasted my reply below. Thanks in advance! We believe that your complaint concerns the level, fairness or lawfulness of the charges- if it concerns something else, such as an administrative error, please let us know. We believe the charges are fair transparent and lawful Please be advised the bank (along with a number of other banks) has now become involved in legal proceedings with the Office of Fair Trading (OFT) in relation to bank charges which we believe will resolve the legal issues regarding the fairness and Legality of your bank charges It would be our normal approach to resolve your complaint through our internal complaints process as quickly as possible. However, until the determination of the legal issues in the above proceedings, we have asked the Financial Services Authority FSA) to suspend the normal timetable for dealing with bank charges complaints, arid the FSA has agreed to this request subject to conditions that protect your rights We can assure you we have registered and stored your complaint. Please retain your bark records, as this will make it easier for you to support your complaint on resolution of the test case, Once the legal proceedings between the OFT and the banks finish, we will resolve your complaint as quickly as possible. We are sorry that we have not been able to respond in full to your complaint now, but we (together with the FSA and the OFT) think that it is necessary to resolve the key legal issues before we decide how we should respond to your complaint. Obviously exactly what will happen next will depend on the courts, We do not know how long the case will take we have promised to proceed as quickly as possible but inevitably given the importance of the issues being considered this may take many months to finally resolve. But we can assure you That once the legal proceedings are completed we will resolve your complaint as quickly as possible- If at that stage you do not agree with our conclusions you will of course be able to refer your case to the Financial Ombudsman Service (FOS) (or to the courts) Given this court case we have asked the FOS not to proceed with any other case They are hearing until the test case is resolved- FOS has indicated that as a general proposition it will indeed not proceed with cases which rely on the legal issues being considered in the test case Similarly, you should be aware that if you choose to issue a claim in the Courts, the bank will immediately apply to the Court for an order to stay your action until resolution of the banks proceedings with the OFT.   8. Hi there, I'm not sure where to post, but need advice. I started trying to claim back bank charges and sent a Data Protection Act Disclosure request for the previous 6 years letter to the Halifax on 08/03/06. I then received a reply on 27/03/06 saying they could send me copies of my statements but I would have to pay them £5.00. I wrote giving them the authority debit my account on 02/05/06 which they did, but then only sent me statements for 04/01/00, 31/01/01, jumping to 13/01/05. I did not get any statements for 2002, 2003 or 2004. I wrote again explaining this to them on 23/05/06 and have heard nothing from them since. What advice can you give me, I would be extremely grateful for your help. Regards, Tina Bennett.
