  1. They write that in all letters I think!! You have a few of options. 1. Accept the offer 2. Say, Thank you for you letter dated...... I accept your offer of...... as a PARTIAL refund and you have 14 days to credit the rest to my account. Put that at the top of the LBA letter and follow the normal procedure of MCOL or N1 form. 3. Send LBA stating you want all money back and decline the partial refund - again follow normal procedure. They probably won't put anything like that about the statements in writing as there is proof then that they are in breach of DPA. They are no doubt hoping you haven't kept copies. Hope that helps!
  2. It is amazing what these banks have gotten away with so far. I have added my interest for when they have put me over my overdraft due to charges and that works out an extra 251.00 let alone when I add 8% when I file claim. Well, we can all thnk of our charges as investments now!!

    Hi ya! Is the co-op cashminder acc any good if you have a poor credit rating? Or can anyone suggest an account which would be? I only want something to set up dd's, So's and take cash out!!
  6. Good for you! Just about to send LBA myself! I know I will end up having to file N1but apparently Nationwide pay up pretty quickly after they get that. Definitely going to take the kids on holiday once all this is done!! I hope it all goes well for you.

    Hi. After sending my prelim letter asking for full charges to be refunded (£140.00) I found they had put 68.00 into my account a couple of days ago. I received a letter in the post stating they have refunded the difference between the £20.00 per fee and £12.00 that OFT suggest. Can I go for the rest? Or do I have to settle? Thanks
  10. Tell me about it!! I am so impatient too. Should be getting all three letters this week from Nationwide / cap 1 and Monument. Just want to get on with it!
  11. If the fourteen days are up, you should file the moneyclaim form or N1. They are stalling. You need to stick to your time limits not theirs. Good luck!

  16. Good luck! Keep us updated. I am awaiting to hear from Nationwide for exact details of what I have paid. It is over £4000.00 which is madness but someone told me to think of it as savings for the future!!
  17. In the FAQs, they suggest you take it as a part settlement then file papers for the rest. Good luck!!
  18. Hi Shozie. You can either accept their offer as PART settlement saying that you will be taking them to court fir the rest. Then fill in a moneyclaim form online or N1 form. Or refuse and fill in moneyclaim or N1 form. They are such sods.

    Just spoke to Nationwide DP team to find out how they are getting on with my copies of statements. I was told it will be with me by Thurs. She said it hasn't been any earlier because they have a backlog of 800 requests!!!! Get in there!!!! They are going to be very busy for a long time!! Anyway, just to warn anyone sending the DPA request, it is likely to be the full 40 days that they take to get back to you. It is a pain but at least people are standing up and getting what is rightfully theirs.

  22. Hi! I sent the DPA letter to Cap 1 a couple of weeks ago and thought I had better check they had received it last week. They told me that as I sent letter to Head office rather than Customer Services, it would have been destroyed. Anyway, I asked them to send out a list of charges etc which they said yes to. The point is, call them first as you may not have to pay the £10 fee for your statements. Called them today and they were put in post today. I phoned on 20 July and they were sent 24 July. If it saves you money it is worth it and they seem to do it quickly.
  23. I am so pleased this thread got started as I was originally going to go with the moneyclaim option but will definitley do the N1. How do I get an N1 form? Do I just go to the court?

    Please Help!!

    I have just been on the phone to Paragon Finance Company as my agreement (buying a sofa from DFS) with them should finish in 2 months. I have just been informed that I have charges on my account with them for returned DD's and as they sent me letters back in 2003!! They said they are sending out a statement and I have to pay these charges. What should I do?

    Thanks oooeee, I appreciate that. Am getting quite excited about it actually! I am unsure as to whether I can claim exemption. I have looked at the leaflet and it says you are exempt ‘if you and your partner receive Working tax credit and Child tax credit’. I receive these but I am a single mum so I don’t know. Any ideas or suggestions anyone?
