  1. Well I think I owe them about £25 on that account but I am planning on paying that all off today or tomorrow so the account is clear once and for all. I will draft a letter up to go with the acceptance form and get it in the post asap. Thanks for your help
  2. I think that is what I am going to try doing. I don't really want to go back to the beginning again as if I go back 6 years from now I think most of my charges were taken from my account in the year 2000 so it wouldn't equate to much (if anything). I suppose it can't hurt to send a covering letter confirming I hadn't recieved that letter and enclosing the form accepting their offer. They say the amount will be credited to my account but my account was closed in 2002 so is it ok for me to ask for them to send the amount in the form of a cheque instead?
  3. I need some advice. I was claiming back some charges from Barclays Bank. I had basically got to the stage where I was claiming back roughly £360 in charges and Barclays had offered me £235 as a last chance settlement. The letter they sent me had a form to fill in if I accepted the offer and send back. I wasn’t sure whether to just take the money and run or put in a court claim. Unfortunately this was all happening at the same time as my house in Nottingham going up for sale, me moving to a new city moving in with my boyfriend, starting a new job which I consequently lost and then being unemployed and having to use all my time into finding a new job. As there was limited room at my boyfriends I have been living out of bags and boxes and I tried to find the letter as I thought it said I had six months to respond but I couldn’t find it so I presumed it was still at my house in Nottingham as I had left a lot of stuff there. Then I found the letter and to my dismay it said I had 8 weeks to respond or they would close the case. After talking it through with a couple of people we decided the best plan of action was to say I hadn’t received the letter as I had moved address so I sent a letter to Barclays making out I hadn’t heard back from them since the previous letter. On Saturday they sent me a copy of the offer letter with “copy” written in black biro on the top. The thing is I don’t know what to do now. There is a number on the letter that I can ring with any queries so I’m not sure if I should ring that as I have decided to just take the money they have offered me (if I can still get it) or if I should fill in the acceptance form and see what happens next? I'm so annoyed with myself as it is totally my fault but I honestly thought the letter said I had 6 months to respond and with everything else going on I had to put everything else on the sidelines until I found a new job etc. Any ideas anyone?

My Capital One account is being dealt with being Interim Justitia, I am still paying off a remaining debt with them but my account is closed andI haven't been able to make purchases and have had a payment plan in place for 3.5 years which is ongoing until the debt is paid. I have a CCJ on this account. Right, I sent my preliminary approach for replayment letter asking for £480 of charges to be refunded to me. Today I have had a letter back saying that I signed the T & C's when I took out the card which stated about the charges and that they have lowered their charges to £12 and in light of that have basically decided to refund me as a goodwill payment anything they charged me over £12 on each charge. So in total they have refunded £90 back to my account as they say they agree they had charged me too much. However they do not admit the charges were unlawful. Has anyone else had this letter? Is it a standard letter? Can I proceed further with this or do I have no choice. They have already told Interim Justitia to take £90 off my remaining balance. I'm confused I haven't heard of anywhere doing this before
  5. Hi Libby I think you can. Barclays closed my account as I had run up such a lot of charges and had gone well over my overdraft. I remembered my account number off by heart (it was pretty easy) but I had no idea of my sort code. I just wrote to them stating that my account had been closed, the account number and the address I was living at when I held my account with them. I don't know if the fact I could remember my account number made much difference though. I suppose it may be worth giving their cutomer service department a ring to see if there is anyway you can find out what your account number was.
  6. I had sent a Preliminary approrach for Repayment letter claiming £420 in fees from Barclays. They sent back the standard letter saying they were looking into the situation and that they would reply by the 16th, which was the last day they could reply before I could make a court application. Today I have recieved a letter basically telling me that they disagree with my view of the charges being unlawful and that I was provided with a copy of the terms & conditions which included all details of the charges. It also says....... "Despite my comments above in relation to your views, on this occasion, and without any admissions of liability, I am willing to offer the sum of £235 towards the total amount you are seeking. This is with cost and inconvienience inherent in a further dispute in mind and is intended as a gesture of good willm in full and final settlement of your complaint. If you would like to accept my offer please sign and return the enclosed form to the above freepost address. I will arrange for the payment to be credited to your account within seven working days of receipt of your acceptance at this office" Firstly my account is closed and has been for over 4 years so how can they credit the payment to my account? Is it worth pushing for the full amount? Including interest at 8% the total comes to £688. Which is obviously a lot greater than what they have offered me. I have looked at the templates library and I am confused as to what I have to do next. As tomorrow is the day I can put in a court claim can I skip straight to that or do I have to send a refusal letter first? I don't want to mess this up - if I have a chance of getting the whole amount I'm going to go for it but I need to know which letter and paperwork I need to send or the next step I need to take. Any advice greatly appreciated
  7. Ozzy please check your PM's. I won't say too much on here but I'm afraid my problems with Powergen run deeper than just this problem in fact I have had 6 years of misery with them.

  9. Hmmm I am about to send back my letter claiming back my charges that were put onto my account in 2001. My account is closed now but I am still repaying them what I owe under an agreement that I have with them. I was wondering this morning if they would just refund the money to my account rather than send me a cheque. Looks like this may be the case. I'm not really bothered, even though a cheque would be nice. Having my debt reduced would be just as good in a way as it will help me get it paid off quicker in the long run.
  10. Well I added the interest and sent the letter. I had a reply back yesterday and they said they are looking into it and will reply by the 16th November so we shall see what happens next.
  11. Hmmm I'm not sure if I should add the interest on or not. I am claiming £440 back from Barclays and according to the works spreadsheet my interest comes to another £167. My account was closed by the bank in 2002 though so surely I cannot claim interest back for the epriod between 2002 and 2006? I want to make sure I fill the letter and everything in properly before I send it off because I really don't want to jeopardise my claim. Any advice anyone?
  12. I used to be with Barclays and it is them I am going after. I am also going after Capital One, and Royal Bank of Scotland for my Credit Cards and if I can Co-Operative Bank for my loan. I do have a few other things like catalogues and stuff but am not sure if I can make a claim back against them.
  13. I used to have a pre-payment meter with Powergen and they wouldn't swap it back to a normal meter. In the end I pleaded and pleaded with them once I'd paid off what I owed and got to Zero balance and then set up a heft DD to cover any charges on my account and they did it for me. It did take a hell of a lot of sweet talking to the man on the phone though!
  14. Hi Peter Yes I am hoping to make a claim against mt bank and credit/store card companies for charges levied on my accounts. Have printed out the letters requesting my statements today and am goingto get them off in the post. Been thinking about it for ages but am taking the bull by the horns so to speak today!
