  1. So can I just confirm that First direct replied to your pre lim letter with a full offer of the amount you were requesting? I know that you have since amended that amount, but i have to say im pretty impressed, what was it within a 10 day timescale and no objections? lets see if they are as quick to cough up the real amount owed to you x
  2. We have been advised that confidentiality is something that can be passed "down the line", so if we are seen to have allowed a user to openly discuss the outcome of a case that was subject to confidentiality, we could theorically be liable to action too. I must therefore remove every post where this has happened.
  3. hi there, I sent off my pre lim request yesterday . . . ive copied this for you from their website . . . . I too originally didnt include the £30 per month as it was on every month so i assumed it was a pre agreed service charge but i found this on their site "Unauthorised overdraft interest rate 19.9% (EAR) variable, and incurs a charge of £30 on day one, and £25 for each subsequent day that the debit balance increases in any statement month." so i have included all of the £30 charges which also doubled my claim. hope this helps, good luck x
  4. thanks v much! (feeling a tiny little itty bit chuffed)
  5. im gettin mad now basically the top line of the spread sheet with blue boxes reads: penalty charged £691.5 8% interest on Penalty £48.24 interest on penalties £3.10 8% interest on penalties 25p so i assume i want the £691.5 + £3.10 now and if i have to file for court i them add on the £48.24 + 25p. Is that right?
  6. oopps. that didnt come out too good. DATE PENALTY APPLIED DETAIL OF PENALTY PENALTY CHARGED 8% ON PENALTIES INTEREST DATE INTEREST ON PENALTIES 8% ON INTEREST ON PENALTIES TOTALS: 691.50 48.24 3.10 0.25 ill try again DPA Letter sent to Hitachi Capital Bank 10/7/06 Dpa Letter sent to Next Directory 10/7/06 Prelim request sent to First Direct £694 + £3.10 interest 18/07/06
  7. Hi at least im not the only one up at this time on this site! thanks 4 your reply. I used the spread sheet with the turquoise boxes on it, i think i have done it right i filled in all my info it says at the top: DATE PENALTY APPLIEDDETAIL OF PENALTYPENALTY CHARGED8% ON PENALTIESINTEREST DATEINTEREST ON PENALTIES8% ON INTEREST ON PENALTIESTOTALS:691.5048.243.100.25 so from that I assume that at this stage i want £691.50 and £3.10 and then if i go to court i will add on the £48.24 and the 25p. Does it look like ive done it right? I know im getting ahead of myself with this spread sheet but wanted to understand everything as best i could and the only way i understand is to do it if you know what i mean. hope ive not messed up DPA Letter sent to Hitachi Capital Bank 10/7/06 Dpa Letter sent to Next Directory 10/7/06 Prelim request sent to First Direct £694 + £3.10 interest 18/07/06
  8. Hello, Luckily I still have all my statements from First Direct current account, and to my horror have incurred £694 charges in 18 months! So have read and read and read all the threads (hence why am still up at this time most nights this site is more addictive than BB!) Anyway will be sending the letter before action tomorrow for my money, plus interest, those spreadsheets are fab! I will let you know how I get one but have to admit im very very nervous, I know its just a matter of confidence (which has been beaten out of me by these institutions) and i suppose i will feel better as I do more, everyone on here seems so sassy and in control im just a little bit frightened of getting out of my depth . . . .. Data Protection Act Letter sent to Hitachi Capital Bank 10/7/06 Dpa Letter sent to Next Directory 10/7/06 Prelim request sent to First Direct £694 + £3.10 interest 18/07/06 MANY MORE TO COME. . . . THIS IS AN AMAZING SITE THANKS FOR HELPING ME GET THIS FAR THE FOUNDERS SHOULD BE KNIGHTED KEEP UP THE GOOD WORK EVERYONE YOU REALLY ARE HELPING PEOPLE CHANGE THEIR LIVES FOR THE BETTER
  9. Right well no response so ill take that as this question has been asked loads of times and just get on with it, it take it that basically yes i had an agreement with them but no matter what sort of institiution it is still unlawful to make profits from penalities, thus the penalities they levied against me are unlawful and i can follow the same proceedure?
  10. JUST WANNA SAY TO EVERYONE MEGA THANKS YOUR THREADS HAVE GIVEN ME CONFIDENCE AND I SENT MY FIRST 2 LETTERS TODAY, AM GEARING UP TO TACKLE MY CURRENT ACCOUTN WITH BARCLAYS BUT NEED A QUESTION ANSWERING - I HAVE A GRADUATE LOAN WITH THEM WHICH I HAVE MANAGED QUITE SUCCESSFULLY SO FAR, IE NO CHARGES. HOWEVER FOR ALL MY TIME AT UNIVERSITY WHEN I COULDNT EVEN AFFORD TO EAT THEY WERE HITTING ME WITH CHARGES LEFT RIGHT AND CENTRE. ONE DIRECT DEBIT TOOK ME £5 OVER MY LIMIT, FOR WHICH BARCLAYS CHARGED ME £30 TO BOUNCE, AND THEN £30 FOR THE CHARGE OF GOING OVER THE LIMIT! THEY ARE THIEVES AND I SO DESPERATLY WANT TO GET THEM, I DONT CARE IF THEY SHUT MY CURRENT AC DOWN, BUT COULD THEY ALSO SHUT MY LOAN DOWN AND DEMAND REPAYMENT FOR THAT . . . . . ANY ADVISE WOULD BE FAB KEEP UP THE GOOD WORK EVERYONE X next directory - sent dpa, chasing £500 charges hitatchi capital bank - sent dpa, chasing £750 charges BARCLAYS - estimated £1500
  11. Hi there, Ive read loads about banks, credit cards and store cards, but can anyone advise me if I can use this process against those well known furniture shops who offer interest free over 3 years, then charge the hell out of you should your direct debit be returned. Also what about the £25 cost for writing letters, etc, are they allowed to do that? Any info would be great as im a newbie . . . .
