Its usual practice for the Court to request all documents/evidence to intend to rely upon to be sent to the Court & the defendant, 14 days before the hearing. All your docs seem fine, but dont forget to send copies (reg post) to Barclays If you are still worried just double check with the Court (get the name of the person etc) to back you up. But its my opinion that Barclays will be pay you up before that date

This is the usual delaying tactic for Barclays. Next you & Barclays will both receive an Allocation Questionnaire from the Court . Simply form to complete and return to the Court. After which you will receive your Court Hearing Date, but dont worry they tend to pay out before then

Yes, lots of people have received all their charges back from Barclays. However some (due to clauses) arent able to disclose this information. But if you keep reading the boards you will work it out

I've been trying to get hold of him for nearly 4 weeks but he is ignoring all correspondence. Best bet keep a record of all your correspondence so you can use this in court. Court guidelines advise that both parties attempt to resolve before the Hearing. From experience Judges hate it when one party ignores the other persons attempts to discuss or resolve the case. Obviously Mr KJ and his team think they are above this!!

Well still no reply since I have emailed him FOUR TIMES, Faxed TWICE & Posted TWICE. I hope when it gets to court the Judge takes into account Barclays failure to try and resolve before the hearing.

Yes I would not settle unless they pay all court fees

I am trying to contact KJ as I have sent all my docs to support my claim by fax and post. I have requested 3 times that he acknowledge receipt of these but have still not had the courtesey of a reply!!! I've just sent yet another email to say I will be informing the Court of the Defendants lack of co-operation in trying to resolve this matter before the court hearing date on the 19th Sept B*****DY B******K Barclays

I have been trying to contact him for the last 2 weeks, think he may be on annual leave???

I sent copies of all my evidence to support my claim to KJ 3 weeks ago. I've noticed recently that Barclays are settling so have emailed KJ twice asking him to confirm he has received the Docs but not heard anything as yet.

Those documents sound fine You could also expand on the particulars of your claim if you wanted to, but really no need Judges like all the docs to be in date order and attached, clearly numbered etc I

There is no right or wrong answer Some people find this helps and you may get a settlement. The court advise that we do try to resolve before the hearing and it will only support your cliam But KJ is legally trained and it is his job to delay as long as possible or to prevent you getting a full refund.

Standard delaying tactic by Barclays. Stick to your timetable not theirs

I understand that Barclays state in their T&C that they will only ever charge you 3 times in one month, is one of the charges for looking after your account ie Additions account? Like Bookworm said it still doesnt matter as you are entitled to all your charges back

I just to add my pennys worth and would like to say a HUGE thank you to this site and everyone who helps run it. Sometimes I have posted questions and not had an answer and sometimes the response I have received has been fantastic. This site has also given me the opportunity to talk to people in the same boat and exchange information. If it wasn't for the time and effort that this site has put into providing letters, info, spreadsheets etc I wouldnt be on my way to recovering £4k in bank charges & yes I will be donating a proportion to the site. I hope you get Judgement against the Bank But they can still claim they didnt receive the Claim Form and delaying the proceedings
