  1. I have read this thread, in fact I reckon i've read every thread on this site:eek: , I still can't see whether there is any other downside apart from the possibility of losing a max of £750. Is the fact that everyone says keep claims under 5k and split them if they do go over only because of the £750 costs?
  2. Saw a good friend last night who I hadn't seen for 2 years. I brought the subject up of bank charges, this website etc and she reckons she's had charges of approx £200 a month for pretty much the last 10 years. I said about claiming back 5k at the time but she said she would like to do it in one go, she said whats the worst that could happen and I said she could lose costs of up to £750. My question is, is this the worst that could happen??
  3. Libby like bigaid said if you can track the postal order and can see it has been cashed then thats ok. If you have sent a postal order that has not been cashed, you have no track or trace through Royal Mail and you get no response from Capital One within a week then I would be inclined to phone them and find out if they have recieved it. If they haven't your going to have to send another payment and see if you can get the original one back somehow (not sure how it works with postal orders). I phoned Capital One a few days after I sent the request to chase them up and a guy said he could not see anything on the system and would order statements and they would be with me within 7 - 10 days, so you could try that as well. In future send everything recorded. Regards
  4. I sent it here Capital One Card Services PO Box 5281 Nottingham NG2 3YJ recorded delivery and they sent back an acknowledgement a few days later. They should pass it on but if you phone them as well they say they will order them so you get them 7 - 10 days. Just be aware if you haven't sent it recorded, it could get to 40 days and deny all knowledge of recieving it.

  9. MMmmmm tricky one. I would say speak with them but really you know they are just going to fob you off. If it was me I would make a clean start, in the mean time try opening a new bank account with a different bank that way you'll have something to fall back on if they did close, even if your credits bad you can still a new bank account. I wouldn't let them get away with it to be honest and i'm doing what i've suggested i.e opened another account just in case, i'm pretty sure Nationwide will close my account as they seem to be the worst for it. So in answer to your question if your pi$$ed off that they took £250 off you in your hour of need, don't mind a bit of stress over the next few months, don't mind spending some cash and possibly have to get a new bank account then go for it but if you don't fancy these things then write it off.
  10. Its certainly not to late to get your charges back, I would send a SAR as soon as possible requesting all info & statements for the last 6 years. As for the where would the cash be paid. I'm not 100% sure but I have heard that Natinwide pay into your account, as you haven't got one they may just clear the debt off. Another possibility is that you make clear that you want the claim settled by cheque when you win as you are already in an arrangement to clear the debt off.
  11. Yep stalling tactic, your timetables not theirs. Go ahead with money claim, you've come this far only a little bit further to go. Court isn't anything to worry about anyway, I did one for a matter with my house all it is, is going into a room with a judge dressed normally and their solicitor. It won't get that far anyway!!!
  12. Sent SAR on 11th July and received 12th July. They have been ringing up constantly because my account is about £3 over its limit, so I turned the screw and said I want to know where my statements ARE. The Indian guy with a very strong accent said he could see no request had been made on the system however he put a request in there and then for all statements since my account opened (which I think was 1997) and said it would take 7 - 10 working days for ll of them to come through. I'll be interested to see if this works and how far back they actually send. So if I do get them back quickly, in future it might be worth sending the SAR but also phoning them on the same day saying you are waiting for your statements, can you see a request on the system, no, can you order them for me then please.

  16. I would start a prelimianary letter with an estimation of charges, if you know what the last 2 years are just X that by 3 (6 years). Also send a letter of to the information commisioner.

I think you've pretty much answered it, give them details of your old address and a copy of your passport or driving license etc and make sure you send recorded delivery, I sent here and got an acknowledgement back in a few days..   18. Send a letter to the data commisioner (think theres a template in the library) Send a preliminary letter to Barclays estimating the amount i.e all your charges for 1 year X 6, that'll give them a kick up the ar$e!!

    Hi, I'm know where near the stage your at but I think I may have read every page on this website:o . The way I see the 8% interest is that you add onto each charge individually i.e a £30 unpaid DD from 01/08/2000 will work out at say £21.08 interest whereas a £30 unpaid DD from 01/06/2006 will be 17p. The spreadsheet adds all the individual charges and all the individual interest amounts relating to those charges. As for replying to the bank, I have read two things. Either send a letter saying you are happy to accept this as part payment but you still owe the difference and carry on or ignore and just stick to your timetables which I believe for you is money claim time. Hope this helps
  20. Not sure, but I don't think it matters anyway. Even if you tried speaking/phoning 10 people they are not going to close your account just for that. Give it a go and just act slightly stupid and apologetic:grin:

Hi ABigail, AT the end of July you will probably get your statements, on the bottom of one of them it will probably say list of charges = £150 will be debited 28 days from this statement, so basically I think the charges will come out roughly end of AUgust. I would definately ring up/write them a letter and say you made a mistake and can you reverse them. I'm not sure how far you'll get and wouldn't be suprised if they said no. If they say no then you'll have to decide whether you want to fight them for your money back. If you fight and win then they may close all 3 accounts. Regards

Hi, I'm not at that stage yet but if the 40 days passes without receiving my statements then I shall be doing 2 things. 1) Writing a letter to the Information Commissioner, copying Nationwide in on it. 2) Putting in an estimate of 6 years worth of charges. I don't know if you've read one of my previous posts but you can get all your statements online back from the last 27 months. I think for the last 27 months my charges come to around £2300, so I shall being doing a simple calculation...... £2300 divided by 27 months = £85 per month. £85 x 72 months (6 years) = £6120. In fact I will be claiming more as I know the first 3 years were much worst than the most recent 3 years. Hope this helps

Hi, First get the step by step instructions from here http://www.consumeractiongroup.co.uk/forum/faqs-please-read-these/243-step-step-instructions.html Templates are from here http://www.consumeractiongroup.co.uk/forum/bank-templates-library/ Once you have statements you can work out charges and add the first bit of interest, you'll have to read up a bit but I think its only really if your charges were part of an unauthorised overdraft. Most people don't bother with this bit of interest as its usually pretty minimal and quite hard to work out. So you send your preliminary letter i.e you owe me this (all charges added up + the bit of interest if you wish), give them 14 days Then send your Letter Before Action give them 14 days then start your claim, this is where you can claim 8% on all your charges, the spreadsheet is in the template library. You basically put in type of charge, amount and date and this will give you a figure of 8% interest i.e Returned DD, £30 09/09/2000 interest = £21.91 I may have missed a bit but this is roughly what you need to do, hope this helps
