  1. Handed my AQ in today at local court house, they didnt give me a recipt even though i asked for one, she said she would stamp it and that counts as one. I guess all i can do is wait again. I also copied out the correct information to be entered into section g and handed it in with my AQ and schedule.

You seem very well prepared, i dont think phoning really works to your advantage as barclays seems to have a fairly standard proceedure they stick to, here is a phone no of there customer relations department, all my correspondences with them have had it on the letter head 0800 282390. You could always try is and it is a freephone no. As for the offer say no and stick to your guns, its like been short changed if someone has taken YOUR money you dont just ask for half back. Its been ages since i have posted but i havent given up, taking my AQ in tomorrow, made a bit of a mess of section g, i put in a right load of gobbledygook, that was before i foung jackiej's thread with a post from welshman containing all the answers. I dont think it will make a terrible difference, at least i hope not! My court bundle is almost ready, all 200 pages of it. has everybody gone and based their bundles on jonni2bads and bookworms?
  4. MCOL entered 15.10.06, halifax folded like a badly stacked house of cards at this point so fingers crossed.

  7. They have folded and payed!!! I cant belive it, justice has been done. If an administrator could reply on how to donate via cheque or somthing that would be helpfull, i dont have a paypal account.
  8. A settlement offer came today for one fith the amount i am claiming. Will be starting money claim the second the 14 day deadline is up.

  11. I am in over my head!!! I thought i had really done well up to this point, i was uisng the CAG site to do research and double check everything without having to ask questions every 2 seconds but now am at a loss. Questions: Once the claim has been issued on MCOL am i right in thinking that you send off the schedule of charges to Northampton County Court straight away? Do i click on start under judgement in the claim menu on MCOL website, or is somthing suppose to happen first like the bank replies or you give them the fourteen days? If you do click on start straight away, what is the answer to the above post?(because it is the first option you get) Thanks.

Hello parsnipsmum, first congratulations regarding your good news, i am roughly at the same stage as you, i filed my MCOL yesterday against the halifax and my barclays claim is a week behind that one. I noticed Michael B said you had to send off schedule of charges to court, i take it i have to do this, my question's how do you know which court to send it to? and what do you include in the cover letter?

  16. Ok i might of messed up or am just being paranoid, sent LBA off dated 24.09.06. Recevied halifax reply saying "i confirm we will not refund all the charges" on 30.09.06. I then assumed because they have clearly stated they will not be refunding me i could start my MCOL so i did and entered it yesterday, 7 days before the 14 day deadline. All the other threads seem to be waiting the full 14 day deadline before entering it, will that cause any problems? thanks.

Ive been a bit slack with this claim as my halifax one is futher on ahead than my barclays and i let the pre-lim date slip. but having realised how fast time does fly i have typed my lba letter out and will be sending it monday morning. I did fill in the MCOL money claim online form in today against halifax, and if anyone is wondering what you type in claimants details, here you are: Claimant has account (A/C No) with Defendant from (Date a/c opened) conducted on their standard terms and conditions. Claimant is claiming the return of (£0.00 = amount of charges claimed) taken by Defendant in charges over (X) years. The Defendant’s charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. They are also invalid under the Unfair Contracts Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999.Para.8 and sch.2.1.e. In the event that the charges are not a penalty they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. Defendant has declined justification of charges despite repeated requests. Claimant claims interest under Sec.69 of the County Courts Act 1984 at a rate of 8% a year from(Date of 1st charge) to (Date of filing claim) of (£0.00 =The interest in the 8% spreadsheet calculation) and also interest at same rate up to the date of judgment or earlier payment at a daily rate of (£0.00p = Amount of charges claimed x 0.00022). Supplied by a very helpful moderator, you can copy and paste it and it will fit into the 1080 character spaces allowed.
