  1. I had an allocation hearing and rang barclays 7 days prior to it, i asked them if they had received my court bundle and if they wanted to settle. They tried to delay paying me up untill the last minute, but still ended up paying before the allocation hearing.
  2. I have completed both claims (halifax and barclays) and they both paid out, barclays took a little longer but it was so worth the wait. Good Luck

  7. 40 days including weekends holidays etc, good luck.
  8. 1. If you are exempt from the costs you cannot claim them back. 2. You can ask to be paid back by cheque keeping you in control of your cash. 3. Yes 4. Yes its where you turn up at court, the judge decides how to proceed, then you are given a date from that. Its highly unlikely you will end up stood in front of the judge. If you do take your court bundle, notes, questions pen and paper, just so you are prepared.
  9. Here is the online way to court www.moneyclaim.gov.uk (you need a debit or credit card) it will tell you what to do, or get a copy of an N1 form from your local court house. Good luck
  10. I wouldnt telephone the bank yet, once the 14 day deadline has expired begin court action, it will show them just how serious you are.
  11. 40 Days. Here is a very helpfull section http://www.consumeractiongroup.co.uk/forum/faqs-please-read-these/
  12. 1. Personally i didnt claim the interest as the charges i incurred were mostly within the past 2 years, however i would claim if i had a few dating back 6 years, that will add up to a fair bit. 2.Yes
  13. Thanks bai and sand, I would imagine you wont be far off a settlement sand, It does feel good to know the many hours preparing everything have paid off.
  14. Plus, have you opened a parachute account in case they do close it, it can have an effect on your credit rating making it difficult to open an other one?
  15. I beleive you can request the charges be paid back by cheque, keeping you in control of your money, i also think its pretty rare that they close accounts, i have only heard it happen twice.
  16. Hi LETTER BEFORE ACTION Section 7 – Data Protection Act 1998 Dear Sir/Madam Account: xxxxxxxx You have failed to comply with my Data Protection Act Subject Access Request dated (Insert Date). 19. Hi sand, glad to hear you can see the light at the end of the tunnel, Barclays do like to cut it close dont they! Good luck keep us all posted.
  20. LoL, dont worry i doubt you will end up in court, i almost passed out when i saw the bundle and to put your simple mind at rest http://www.consumeractiongroup.co.uk/forum/guidance-notes/641-case-guidance-notes-going.html http://www.consumeractiongroup.co.uk/forum/guidance-notes/637-case-guidance-notes-bringing.html
  21. Hi No you do not need to send a cheque, That only applies to claims over £1500. You dont have to send copies of the AQ to Barclays, but make sure you photocopy it for your court bundle. You can get help here with the AQ http://www.consumeractiongroup.co.uk/forum/bank-templates-library/11644-allocation-questionnaires-guide-completion.html
  22. I cant answer about counterclaim section as i didnt come across this in either of my claims. Yes its to (a) be preprepared for court (b) scare the hell out of Barclays and © give the impression you know what you are doing. You will learn a few things too. Its highly unlikely.
  23. Hi delly. Yes Barclays always file a defence and its perfectly normal, you should receive "NOTIFICATION OF DEFENCE FILED BY BARCLAYS" document from the court and a copy of the allocation questionaire roughly at the same time. Here is a link to help on completeing the AQ.... http://www.consumeractiongroup.co.uk/forum/bank-templates-library/11644-allocation-questionnaires-guide-completion.html Hope that helps. To follow my claim against barclays Msa V Barclays Bank 1 day till court
