  2. I have had a email from Cobbetts .They are sending me a cheque for the full amount. I HAVE WON HOORAY
  3. I rang Cobbetts today and said i would take of all prelimitation charges. They asked me to email the revised schedule. So fingers crossed.
  4. Hi All I have received another letter and the same cheque back from Cobbetts for £7911.91. The amount i am claiming is just over £10000. The letter is saying about Limitation Act 1980 as in the previous letter but the last paragraph reads Our client views this matter as concluded and awaits a Notice of Discontinuance. If you fail to provide us with a completed Notice of Discontinuance we will write to the court seeking an order that the remainder of the claim dismissed. Furthermore we reserve the right to refer to this letter on the issue of costs. What do i do now? Have i go any chance of getting the rest of the money?

  8. I have sent the cheque back today. Hope this all works out for me now i have made this decission. It's a lot of money to loose.

  10. OK Have just read a posting from Gizmo111 which makes it clear that if i cash the check i am agreeing to full and final settlement. After much pondering i have decided that myself and Natwest have been fighting this for too long to end this loving relationship at this stage so the fight goes on. I take it i send the cheque back with a letter saying thanks but no thanks. My next problem is the limitations act 1980 which they keep quoting to me as my claim runs for longer than 6 years is this going to be a major problem. Any advice anyone???????????
  11. Hi Silkysmooth I am in the same boat as you. The cheque is burning a hole in my pocket and i would really love to cash it but at the same time i really dont want to let Natwest off the hook. Decisions Decisions.

Hi All Have received a cheque from Cobbetts for nearly £8000 with the usual conditions, my problem is my claim is for over £10000 but because i am desperate for money at the moment i really need to cash this. Is there any way i can cash the cheque and still try to get the rest of the money from them or am i just being greedy.

  16. Paul is of any help. Consumer Credit Act 1974 s78 (1) Demand 1. I require you to supply me with a true copy of the credit agreement under which this account is conducted. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.78 (1) for running – account credit) - your obligation also extends to providing a statement of account. I enclose a £1 cheque (xxxxxx) in payment of the statutory fee. 3. You are notified that you are obliged to supply these documents, under S189 of the Consumer Credit Act 1974. Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities. Take note at this stage, that any legal action you may contemplate will be both vigorously defended and contested. As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the Consumer Credit Act and therefore is a complete defence to any court claim that is issued. Furthermore you are reminded that under s78 sub section (6) whilst the default continues you are not entitled to enforce the agreement in law

  21. I have received this from the court. Is it standard and what do i do. Upon the Courts own motion. The Court has made this order of it's own initiative without a hearing. If you object to the order, you may make an application to have it set aside, varied or stayed within 7 days of receiving it. 1. Directions will be given in this case by the Designated Civil Judge, His Honour Judge G xxxxxxxxxx. On the 26th March at 10.30 am at Cardiff justice Centre. 2. The parties may appear in person or make written representation as to how the case should proceed provided a copy of the representation is the court and the other side at least 7 working days prior to the hearing.
  22. Received exactly the same letter as last week from Cobbetts, they are saying they had not received an answer which of coure they have, it was sent recorded and signed for.
  23. Received a copy of Natwests AQ this morning.
