  2. I've checked the library template for completing the N150, and have looked through others' threads, but I'm not sure on a couple of the questions. 1. Under Case Management Information - Witnesses - I've included the defendent's name as witness, but don't know what to put under 'witness to which facts'. 2. Under Experts - once I've ticked 'no' to the first question, I'm assuming I don't need to answer any of the other questions. Is that correct? If not, please advise. 3. In the Other Information section, do I need to attached the spreadsheet to the questionnaire yet again? And since I've sent them to the other party several times, I assumer I can tick 'yes' to the next question, stating the approximate date when they would have been last received. then it goes on to say do you intend to make any applications in the immediate future - presumably no again? As far as I can tell, we have no other information that needs to be included since the claim is less than £5000. thanks very much for your help with this. I want to get this form finished tonight so it can be posted and (hopefully) settled in the very near future.

  4. I am a volunteer Personal Budget Counsellor and am helping several people to reclaim their unlawful bank charges. The first person is at the N1 stage (others soon to follow) and I'm trying to figure out exactly what goes where on the form. I have looked at many threads on this site and have also purchased the Small Claims Proceedure book. I would be grateful for some advice on a couple of issues: 1. Do we put our local court in the top box on the N1? In our case, it is Reading, so I'm assuming we add "Court of Reading" after the words 'In The...' 2. In the section headed Value, do we simply put the total amount we are claiming? Or should we put the amount of the bank charges, then list the amount of interest, and a total figure? I'm puzzled about this heading as we have the Amount Claimed box at the bottom of the page. 3. Is the best address to use for the Defendent the Swindon one I found on one of the threads? We haven't had any direct contact with that address in this claim, so I was wondering if we should continue to use the Northampton address we have been using for the prelim & LBA. 4. My client is on benefits. When we complete the Amount Claimed section, what should we put in the Court fee section? Should we just leave it blank and when she takes the form to court, she also takes in the Application for Fee Exemption (EX160) - then the court can sort it out? 5. In the Particulars of Claim, I have copied the information I found in the library section, changing the details as appropriate. Under point 5, where I am writing what the Claimant claims, there is a section for interest. The wording I am using is "Interest pursuant to section 69 of the County Courts Act 1984 at the rate of 8% a year from 14th November 2000 to 5th July 2006 of £541.61 and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of ???" The ??? is because I'm not sure what to put there. Can someone help me out with this daily rate please. I really appreciate the guidance which is available on this site, but I do sometimes find it difficult to follow everything in a systematic way. Once I've done this first claim from start to finish (successful, I hope!), I'll be fine. Thanks so much for making the site available, and taking the time to answer our queries. A Quick extra request: Should there be any attachments to the N1? Should I attach a schedule of the bank charges & how we calculated the interest? Or is that something we hold onto and take to court, if necessary? Thanks
  5. I'm helping a single mother with a claim for unfair bank charges to the tune of £1985.06 (incl interest). We've sent the prelim letter, got standard 'our charges are fair & transparent' response. Then we sent the LBA, and the reply which has come back says that her letter of complaint has been sent to some other department and the FSA allow them eight weeks to respond. Does this mean we have to wait until they process the complaint? Everything I've read on this site seems to indicate we should just go ahead and lodge the moneyclaim now - NOT wait another eight weeks for them to come back and say 'our charges are fair etc etc'. Can someone please let me know if my interpretation is correct and I will assist this lady with her money claim. Thanks so much.
  6. I did read the post from colour me happy. However there was a comment in that post that said the bank can't cancel your mortgage out of spite unless you default (or other negative financial things). In this case there is a history of default (dating back about two years) where the mortgage was not paid at all for several months, then payments for several more months was only what DSS was contributing. It is getting back on track now, and hopefully there will be no more default. Unless I hear anything else on this forum, I'll help her write a letter to Halifax and we'll see how we go.
  7. I am helping a single mum sort out her finances post-divorce (messy one). Ex-husband defaulted on mortgage payments for months so the mortgage is way in arrears. Each defaulted payment led to a £35 letter being sent. She has - finally - got things sorted out and there should be no more defaults (as long as ex-hubby pays his portion of the mortgage). I'm happy to help this lady to make a claim against Halifax for the charges, but I'm concerned that they might then ask her to repay the mortgage in full. She has absolutely no way of getting a mortgage from any other company (we've tried, very hard, to do this). Is it worth making a claim? There must be over £500 in charges over the past two years.
